Online Training for Nurses and PCAs in Aged Care: Understanding Your Legal Obligations and Mitigating Risk.
This online training is designed for nurses and personal care assistants (PCAs) working in residential aged care across Australia.
This interactive training session will guide you through your legal obligations as nurses and PCAs in aged care and your potential liabilities. Importantly, it will discuss how you can mitigate your risk by understanding your obligations around issues such as consent, as well as good record-keeping practice (and why this is crucial).
Dr Melanie Tan will start by explaining the concept of duty of care and what this means in your day-to-day practice. Your duty of care underpins all other obligations. Melanie will explain how duty of care relates to issues such as informed consent, consumer-centred care and effective record keeping, and will walk you through the relevant principles. In particular, and given its pervasive importance, Melanie will offer useful tips on documentation, including in electronic record systems.
With her combined perspectives of a medical practitioner and a lawyer in health and aged care (having previously practised in medical negligence), Melanie will explain legal principles and potential liabilities in a way that is meaningful to you as clinicians and carers. She will use real-life examples to illustrate how your legal obligations translate into practice, and invite questions and discussion. Being a clinician herself, there will be no need for translation!
Melanie will also discuss areas of national regulation which can impact you personally, and your employer - such as privacy and principles around consumer-centred care.
Aged care providers will benefit from improved staff understanding of potential liabilities, and how to manage legal risk.

Dr Melanie Tan, Senior Associate in Russell Kennedy’s Aged Care team will deliver this training. As a medical practitioner, previously a medical negligence lawyer, and now an aged care lawyer, Melanie has a practical understanding of the legal issues and risks associated with the provision of care and services in residential aged care.
