Terms and Conditions  −  Nature Connection Training

These Terms and Conditions have been put in place to ensure that all Birdwings events may support best practice with children, families and nature. Confirmation of all bookings occurs with acceptance of these Terms and Conditions.

• “Birdwings” refers to the business owned and operated by Narell Neville and Jennifer McCormack.
• “Staff Member” refers to any person paid by Birdwings to facilitate events offered by Birdwings. All staff members hold a current Blue Card and Senior First Aid Certificate.
• “Volunteer” refers to any person who is supported a staff member to facilitate events offered by Birdwings. Volunteers may be students, parents, unpaid educators and must have a Blue Card.
• “Participant” refers to any person who is booked in to participate in a Birdwings event, either free or ticketed.
• “Child” refers to any participant who is under the age of 18, and who has been signed in as a participant by a parent or guardian.
• “Booking” refers to the enrolment of any participant in any Birdwings event that has been confirmed by acceptance of the Terms and Conditions, paid in full prior to the commencement of the event, and whose name appears on the register of event participants.

1. PARTICIPATION IN ACTIVITIES INVOLVING RISK OF PERSONAL INJURY. Birdwings offers outdoor experiences may present an element of risk or personal injury. Benefit Risk Assessments are completed and available to view for all Birdwings activities, procedures and locations. By booking in to a Birdwings event attendees agree to the following conditions:
1.1 Attendees may be involved in activities which carry a degree of personal risk and injury such bushwalking, tree climbing, water activities (wading, swimming, rafting, kayaking), building with natural materials, using sharp and heavy tools. Attendees may be at risk of broken bones, head injury, drowning, bitten by insects/ticks/spiders/snakes, scratches, grazes and wounds.
1.2 Attendees may be involved in the creation of agreements regarding procedures for safe and respectful relationships with others, use of areas, tool use, particular activities, emergency procedures, and facilitated discussions around dynamic risk assessments in the course of their activities.

2. MEDICAL DECLARATIONS AND FIRST AID. Birdwings staff members must be able to respond quickly and appropriately to every attendee’s medical needs. Attendance at any Birdwings session is conditional upon attendees providing accurate information regarding their medical needs. Attendees agree to the following:
2.1 To declare upon booking, any known physical, cognitive, medical or other conditions which may affect participants effective and safe participation in any Birdwings activities.
2.2 To declare any known condition requiring medical treatment AND provide an accurate prevention/treatment plan and access to appropriate medication if required.
2.3 To give permission for Birdwings staff members to administer appropriate First Aid treatment.
2.4 To give permission for Birdwings staff members to call an ambulance, at the participant’s expense, if required for urgent medical attention.
2.5 Non-medical, holistic treatments (including, but not limited to, essential oils, flower essences, herbal and homemade treatments, vitamins/minerals) may or may not be applied by Birdwings staff members. Application of non-medical holistic treatments will depend upon circumstances manageable to the staff member at the time.
2.6 Participants who are feeling unwell, have an injury, are presenting with symptoms of illness or who have demonstrated symptoms of illness within the previous 48 hours (including evidence viruses, communicable diseases/rashes, vomiting and diahorrea) will not be able to attend Birdwings events.

3. ALL WEATHER EVENTS Birdwings offers all-weather outdoor events. All participants must be prepared accordingly for inclement weather. Attendees are required to understand and agree to the following conditions for all-weather activity:
3.1 Participants will be playing outside in all weather and may become wet and dirty during their activities at Birdwings events.
3.2 Birdwings staff will monitor each participant’s wellbeing and safety during all-weather play.
3.3 All participants must bring their own clothing and equipment appropriate to the activities and expected weather for the day. Participants may excluded from activities that require specific clothing and equipment and might be refused attendance, without refund, if they do not have appropriate clothing and footwear for the activity and expected weather for the session.
3.4 Birdwings events may be cancelled suddenly if a severe weather event occurs and parents/guardians may be required to collect participants early if the weather is unsuitable or unsafe for the planned activity session.

4. BOOKINGS, PAYMENTS AND REFUNDS. Bookings at any Birdwings event are not considered confirmed without agreement to the following Booking and Refund Conditions:
4.1 Places in Birdwings sessions are not considered confirmed bookings until full payment is received.
4.2 Cancellations by participants are accepted up until five days prior to the booked event. Refunds of payments are available up five days prior to the booked session, however a service fee of $20 per booking will apply for all refunds.
4.3 Full or partial refunds are not given for cancellations by participants within five days prior to the booked event, or in the event of non-attendance on the date of the booked event.
4.4 Participants who leave early from an event are not eligible for a refund or partial refund.
4.5 Full refunds are available for all bookings in the event of cancellation due to severe weather event or sudden staff unavailability.

5 PHOTOGRAPHY AND SOCIAL MEDIA. Birdwings takes photographs and videos of the participants, their activities and creations during their events for the purpose of documentation of experiences and also for promotional purposes. These media images may be used on the Birdwings website, Instagram and Facebook accounts and may also be used in fliers and other print promotional material. All images are shared respectfully, however may share identifiable features of each participant. By booking in to a Birdwings event, participants and their parent/guardians give permission to Birdwings to:
5.1 use photography and video to capture images of participants, their likenesses and creations during Birdwings events, and;
5.2 use these images in promotional purposes by Birdwings at any time.

TryBooking is an online system for organisations and community groups that has been designed to look after the entire event ticketing and registration needs.

All issues relating to the sale of tickets and the hosting of their associated event(s) are the responsibility of the “Event Organiser” and not that of TryBooking Pty Ltd (Australian Business Number 71126987915).
