These Terms and Conditions of Entry apply to entry into and participation at events operated by MH & Sons Ltd, trading as Monty Hammond & Sons Funfairs.

Where an event is promoted, ticketed or operated in association with London Carnival Funfairs, additional terms may apply. Any additional terms displayed at the point of purchase or at the event will be brought to your attention where applicable.

In these terms, “we”, “us” and “our” mean the relevant event operator, and “you” and “your” mean the person entering the event or purchasing or using a ticket or wristband.

By purchasing an entry ticket or wristband, or by entering the event, you confirm that you have read, understood and agree to comply with these Terms and Conditions, together with all safety instructions, ride restrictions, notices and directions issued by our staff.

Definitions

Ticket: A physical ticket, electronic ticket or other confirmation that grants the bearer entry to the event and, where applicable, access to eligible rides, attractions, refreshments or food.

Price: Individual tickets cost £1.20 each. A book of 10 tickets costs £10.00.

Rides cost between 2 and 5 tickets each. Guests must check the individual ride or attraction for the number of tickets required.

Where indicated at the event, tickets may also be redeemed for refreshments or food at participating stalls. The relevant stall’s terms and availability may apply.

Wristband: A wearable band costing £15.00 that grants the wearer unlimited access to eligible moving rides for a period of four hours.

Wristbands are available for purchase on the hour, every hour, subject to availability. Wristbands are non-transferable and must be worn securely by the person to whom they are issued.

Wristbands include event entry but do not include access to game stalls, bungee trampolines, play centres, catering services or any other attraction or service expressly excluded at the time of purchase.

Entry options and payment

Tickets

Individual tickets cost £1.20 each. A book of 10 tickets costs £10.00.

Tickets include entry to the event and may be redeemed for eligible rides or, where stated, refreshments or food.

Tickets are valid only for the applicable event date and cannot normally be transferred or exchanged.

Wristbands

Wristbands cost £15.00 and include entry to the event together with four hours of unlimited access to eligible moving rides.

Wristbands do not include game stalls, bungee trampolines, play centres, catering services or other attractions or services expressly excluded.

Wristbands must be worn by the person to whom they are issued and are non-transferable. We may refuse access where a wristband appears to have been altered, damaged, duplicated, transferred or misused.

Payment methods

We accept cash, credit cards and debit cards, subject to availability, connectivity and the terms of the relevant payment provider.

Online ticket fees

Online ticket purchases may be subject to booking fees, transaction fees or other charges imposed by the relevant ticket reseller or payment provider. Any such charges should be checked before completing the purchase.

Tickets, wristbands and refunds

All tickets and wristbands are subject to availability and the terms displayed at the time of purchase.

Tickets and wristbands are non-refundable except where a refund is required by law or where the event, ticketed attraction or relevant service is cancelled or is not provided in accordance with the contract.

Nothing in these terms affects your statutory rights.

Where an event or attraction is affected by weather, safety concerns, operational issues, maintenance, capacity restrictions, circumstances outside our reasonable control or other legitimate operational requirements, we may delay, suspend, close, withdraw or alter access to rides or attractions.

Entry to the event does not guarantee access to every ride or attraction.

Ride access and safety restrictions

Each ride and attraction has its own safety rules, height requirements, age restrictions, health restrictions, weight restrictions and operating procedures.

Guests must read and comply with all notices displayed at the ride or attraction and must follow the instructions of ride operators and other authorised staff.

Guests must not enter or use a ride or attraction if they do not meet the applicable requirements or if a staff member reasonably believes that their participation may create a safety risk.

Guests must not use rides or attractions while under the influence of alcohol, illegal drugs or any other substance that may impair their judgement, balance, coordination or ability to follow instructions.

Guests must remain seated, secured and positioned as instructed throughout the ride and must not attempt to leave, interfere with, obstruct or interfere with the operation of a ride.

Loose articles must be secured or removed before boarding where required by the ride operator. We may refuse access to a ride where a guest has an item that cannot be safely secured.

Health and medical considerations

Guests should consider their own health and suitability before using any ride or attraction.

Guests must comply with all displayed health warnings and restrictions. These may relate to pregnancy, heart conditions, blood pressure, epilepsy, recent surgery, back or neck conditions, mobility limitations, motion sensitivity or other medical circumstances.

Guests who are unsure whether a ride is suitable for them should ask the ride operator before entering.

Supervision of children

Children under the age of 12 must be supervised by a responsible adult aged 18 or over.

The supervising adult remains responsible for the child’s conduct, safety and compliance with these terms, ride restrictions, safety instructions and staff directions.

Some rides and attractions may impose additional age, height or supervision requirements. Those requirements must be followed.

Customer belongings and valuables

Monty Hammond & Sons Funfairs does not provide a cloakroom, locker, safe-keeping or property-storage service for guests.

Guests are responsible for their own belongings, including jewellery, watches, phones, wallets, money, bags, keys and other personal items.

Guests should secure valuable, loose or unsecured items before entering a ride and should not take items onto a ride unless the ride’s rules expressly permit them.

Staff, ride operators, security personnel and contractors are not authorised to accept, hold, carry or store a guest’s belongings or valuables for safekeeping while the guest uses a ride or attraction.

Guests must not hand personal items to staff for this purpose. Guests must retain their belongings or make their own secure arrangements before using a ride or attraction.

Where a member of staff receives an item in error, the item must be reported to the duty manager immediately and recorded under the company’s incident and property procedures.

Staff must not pass the item informally between employees or make any representation that the company has accepted responsibility for it.

Where a guest reports that an item has been lost, stolen, damaged, altered, exchanged or is not the item originally held, the guest should report the matter immediately to the duty manager or ticket desk.

We may record the report and preserve relevant information or evidence, including CCTV, staff records and witness details, where available and appropriate.

To the extent permitted by law, we do not accept responsibility for the loss, theft, damage, alteration or exchange of a guest’s belongings.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

Lost property

Guests who find property at the event should hand it to a staff member or take it to the ticket desk as soon as reasonably practicable.

Found property will be recorded and handled under the company’s lost-property procedure.

Guests seeking to report or recover lost property should contact the ticket desk or email events@mhandsons.co.uk.

We may request a description of the item and evidence of ownership before releasing property.

Unclaimed property may be disposed of, donated, returned, securely destroyed or otherwise dealt with after 21 days, subject to the nature of the item, applicable law, data-protection obligations and any requirement to retain it as potential evidence.

The company does not guarantee that lost property will be recovered or returned.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

Behaviour and security

Aggressive, abusive, threatening, intimidating, discriminatory, disorderly or unlawful behaviour will not be tolerated.

We may refuse admission or remove a guest where reasonably necessary for safety, security, public order, the proper operation of the event or the enjoyment of other guests.
This may include circumstances involving:

• Verbal abuse or threats.
• Physical intimidation or violence.
• Harassment or unwanted conduct.
• Intoxication or impaired behaviour.
• Failure to follow safety instructions.
• Damage to property.
• Disruption to the event or other guests.
• Breach of these Terms and Conditions.

Where a guest is refused admission or removed because of their conduct or breach of these terms, no refund will normally be payable, subject to any statutory rights.

Guests may be required to comply with reasonable security checks on entry or during the event.

Alcohol policy

Alcohol is not permitted within the event area unless expressly authorised by the event operator.

We may refuse entry to any person attempting to bring alcohol onto the site or remove alcohol brought onto the site, subject to applicable law and operational procedures.

Guests must not attend or use any ride while under the influence of alcohol or any substance that may impair their ability to participate safely.

Smoking and vaping policy

Smoking and vaping are permitted only in designated areas, where such areas are provided.

Guests must comply with all smoking and vaping signage and staff instructions.

Please dispose of cigarette ends and other waste responsibly using the bins provided.

Weapons and prohibited articles

Weapons and articles capable of causing injury are strictly prohibited.

This includes knives, firearms, explosives, fireworks and any other item that may reasonably be considered dangerous or unsuitable for the event.

Any person found in possession of a prohibited article may be refused admission or removed from the event without a refund, subject to any statutory rights.

We may report suspected unlawful possession or other criminal conduct to the relevant authorities.

Drugs policy

The possession, use or supply of illegal drugs is strictly prohibited.

Any person suspected of possessing, using or supplying illegal drugs may be refused admission or removed from the event without a refund, subject to any statutory rights.

We may report suspected unlawful activity to the relevant authorities.

Signage and communication

Specific rules, restrictions and safety instructions are displayed at the entrance to each ride and attraction.

Guests are responsible for reading and complying with all relevant signage before participating.

Guests must also comply with reasonable instructions given by ride operators, security personnel, event staff and emergency personnel.

CCTV and monitoring

CCTV cameras may be used throughout the event for safety, security, crime prevention, incident investigation and the proper operation of the event.

CCTV may not provide complete coverage of all areas.

Images and related information will be handled in accordance with applicable data-protection law and the organiser’s privacy or CCTV policy.

A copy of the relevant privacy information may be obtained from the event operator or by contacting events@mhandsons.co.uk.

Incident reporting

Guests should report accidents, injuries, lost property, safety concerns, damage, alleged theft, disputes or other incidents to a staff member or the ticket desk as soon as possible.

Where possible, guests should provide:

• The date and approximate time.
• The location, ride or attraction involved.
• A description of the incident or item.
• Details of any witnesses.
• Photographs, receipts or other relevant information.

Reports may be recorded and investigated.

We may ask guests to provide information reasonably required to investigate an incident or identify an item.

No conclusion about responsibility will be made solely on the basis of an initial report.

Staff must not make admissions, accusations or promises of compensation on behalf of the company unless authorised to do so.

Emergency procedures

In an emergency, guests must immediately follow the instructions of event staff, ride operators, security personnel and emergency services.

Guests should report emergencies to the nearest member of staff as soon as it is safe to do so.

We may close areas, suspend rides, evacuate the event or take other steps reasonably required to protect guests, staff and the public.

Parking

Parking may be provided by a third-party landowner, operator or event partner.

Guests must comply with all parking signage and instructions.

To the extent permitted by law, MH & Sons & LCF is not responsible for loss of or damage to vehicles or personal belongings left in vehicles, except where caused by the company’s negligence, breach of contract, fraud or other liability that cannot lawfully be excluded or limited.

Guests park and leave belongings in vehicles at their own risk.

Any separate terms displayed by the relevant parking operator may also apply.

Environmental responsibility

We are committed to maintaining a clean and respectful event environment.

Guests must dispose of waste responsibly and must not damage event equipment, facilities, landscaping or property.

Guests may be required to pay for or otherwise be responsible for damage caused deliberately or negligently, subject to applicable law.

Community involvement

The organisers aim to foster positive relationships with the local community and to operate events responsibly and considerately.

Guests must respect local residents, neighbouring businesses, public areas and the surrounding environment.

Staff training

Staff receive training relevant to their roles, including ride operation, customer service, incident reporting, emergency procedures and safety requirements.

Staff must follow the company’s operational procedures and must refer unusual, serious or disputed incidents to the duty manager.

Admission and removal

We reserve the right to refuse admission or remove any person whose presence or behaviour may reasonably affect the safety, security, proper operation or enjoyment of the event.

We may also refuse admission where a person:

• Does not comply with these Terms and Conditions.
• Does not comply with ride or attraction restrictions.
• Presents a safety or security concern.
• Is intoxicated or appears impaired.
• Possesses a prohibited article.
• Engages in abusive, threatening, discriminatory, disruptive or unlawful behaviour.
• Attempts to misuse, transfer or duplicate a ticket or wristband.

Any decision will be made by authorised staff acting reasonably and in accordance with applicable law.

Liability

Nothing in these Terms and Conditions excludes or limits liability that cannot lawfully be excluded or limited.

This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any rights or protections that apply under applicable consumer law.

Subject to the preceding paragraph, guests are responsible for complying with safety instructions, ride restrictions and staff directions and for taking reasonable care of themselves and their belongings.

Changes to these terms

We may update these Terms and Conditions where reasonably necessary to reflect changes to the event, rides, attractions, operating arrangements, legal requirements or safety procedures.

The version applying to your purchase or entry will normally be the version displayed or made available at the relevant time.

Governing law and jurisdiction

These Terms and Conditions are governed by the law of England and Wales.

Subject to any mandatory consumer rights, the courts of England and Wales will have jurisdiction in relation to disputes arising from these Terms and Conditions.

Monty Hammond & Sons Funfairs is a member of The Showmen’s Guild of Great Britain.

All issues relating to the sale of tickets and the hosting of their associated event(s) are the responsibility of the account holder known herein as the “Event Organiser” using the TryBooking UK Ltd website to manage this event and not that of TryBooking UK Ltd., its subsidiaries, affiliates, officers, agents, other partners and employees known herein as “TryBooking UK”. 1. TryBooking UK is not responsible for the Terms and Conditions or any other instructions or directives imposed by the Event Organiser. 2. TryBooking UK is not liable for any loss or damage arising from the purchase of this ticket. 3. TryBooking UK cannot exchange or refund this ticket. 4.
