The ACA NSW/ACT branch committee is delighted to present Simon Gray and Carina Bogaard from Planned Cover to discuss the D&BP Act and its insurance implications.  Originally held 23 June 2021.

This is the fourth in a tailored series of seminars hosted by the ACA - NSW/ACT on the NSW Design and Building Practitioners Act. The aim of the series is to clarify the many questions practitioners have about the new legislation and what it means for architects.

This event will cover the all-important subject of insurance and how the NSW D&BP Act will impact on requirements for practioners, exclusions and premiums.

Simon Gray (NSW State Manager) and Carina Bogaard (Senior Account Manager) from Planned Cover, will provide clarification on the following topics:

  • The retrospective Duty of Care
  • Design Compliance Declarations
  • Registration & “adequate” insurance
  • Requirements for practitioners to have the requisite skill and experience to be “covered”
  • Insurance market update, including premium trends and the impact the D&BP Act is likely to have on premiums
  • Exclusions to look out for – some insurers are applying D&BP Act exclusions

Speakers

Carina Bogaard, Account Manager - NSW/ACT, Planned Cover

Carina has focussed on Insurance for the construction and design industry for over 15 years. Since 2004 she specialised in Architects Professional Indemnity insurance working on the RIBA (Royal Institute of British Architects) scheme placed in Lloyds of London, the world’s leading insurance marketplace; and has worked for Planned Cover in Sydney since her return in 2007.

Simon Gray, State Manager - NSW/ACT, Planned Cover

Simon holds a BSc LLB degree and is the State Manager NSW at Planned Cover. Prior to joining Planned Cover Simon was a partner for many years at Hunt & Hunt, Lawyers. During his 12 years as a lawyer Simon specialised in insurance litigation and acted for the major insurance companies in defending public liability, CTP and professional indemnity claims.

Since joining Planned Cover in 2006 Simon has been the State Manager and is also responsible for handling the company’s major professional indemnity insurance accounts as a broker.Simon’s unique blend of legal and insurance experience enables him to provide his clients with insurance and risk management advice that goes beyond traditional insurance broking.

Following completion of this Seminar you will have an improved knowledge of the Design and Building Practitioners Act 2020 and corresponding Regulations in the context of insurance implications including:

  • The retrospective Duty of Care
  • Design Compliance Declarations
  • Registration & “adequate” insurance
  • Requirements for practitioners to have the requisite skill and experience to be “covered”
  • Insurance market update, including premium trends and the impact the D&BP Act is likely to have on premiums
  • Exclusions to look out for – some insurers are applying D&BP Act exclusions

Documentation: 6.4, 6.7, 6.8

Once you have made your booking you will receive the recording registration link to view the seminar, along wtih presentation slides and CPD questions. A link will be provided with CPD questions to submit your own responses to questions, view answers and for issue of a certificate of completion. Please keep your receipt, a copy of completed questions and certificate for your records.
