Assessing mental state at time of offence for legal reports

The law recognises that a person's mental state when they commit an offence may render them not responsible for the offence or may be a mitigating factor at sentencing. Experts are asked to provide opinions in such cases in the form of reports and oral evidence.This day will give participants a detailed overview of the relevant legal provisions in Australia, particularly: the defence of mental impairment, automatism, diminished responsibility and sentencing considerations. The training will also cover the practical "craft" of how these laws are applied in practice, the clinical and forensic approach, and how to set out an expert opinion in reports or when giving evidence.
This workshop will be run by Dr Rajan Darjee, an Adjunct Associate Professor and Consultant Forensic Psychiatrist who has extensive experience preparing expert reports and giving evidence for mental state defences and sentencing in Australia and the UK.
