In this webinar recording, we are thrilled to have Isla McRobbie, Partner at Jackson McDonald join share her experience and wisdom regarding modular designing. Whilst the concept of modular construction has been around for a while, it continues to gain traction in the broader construction sector (in March 2025, the Federal Government announced it would be providing a $54 million funding package to accelerate the adoption of prefabricated and modular construction methods as part of its commitment to housing in Australia, by way of example).
This webinar recording builds on the evolution of modular construction in the sector and explores key legal principles and risks in (modular) project procurement. The presentation considers the contractual structuring of such projects and provide some insight into the “pinch points” that can arise, from a contractual perspective, including design (and defect) risk in the modular components, intellectual property rights, interface risks, title and risk, contractual delays and more. Understanding these broader issues can be valuable whether providing design services, contract administration or generally involved in a project involving modular components.
