Criminal Case Management in the Supreme Court - 1 Sept 2025

Criminal Case Management in the Supreme Court - 1 Sept 2025

hero
(CPD Guide: 1 PM). From 1 September 2025, significant changes will take effect in the management of criminal cases in the Supreme Court, as outlined in Practice Direction 1 of 2025. Under the new arrangements, the Associate Judge will assume statewide responsibility for managing all criminal matters until they are ready to proceed to trial before a judge. Legal practitioners are invited to discuss the practical implications of these reforms and how they will impact case progression across Tasmania. This is a free information event.
CPD: 1 point (PM)
Format: Livestreamed and In-person (Hobart)
Recorded: With presenter consent
Time: 4-5pm, Friday 8 August

Outline Summary
This session will provide a brief overview of the Court's criminal listing process and an opportunity for an informal 'Q & A' with the profession. Feedback and suggestions about the system are also very welcome.

Session Outline

  • CCML Overview and New Case Flow: Gain an understanding of how the Associate Judge will manage all criminal cases statewide through the newly established Criminal Case Management List (CCML).
  • Committal and Trial Preparation Changes: Review new timelines and obligations following committal. Learn how indictments, readiness, and resolution are handled before transfer to a judge for trial or sentence.
  • Special Procedures and Vulnerable Witnesses: Examine new procedures for child complainants, bail consent letters, and video-linked regional listings to ensure timely progression and appropriate judicial oversight.

Key Takeaways

  • An understanding of the key changes to the system of criminal listings. The Associate Judge now manages all criminal cases statewide until ready for trial or sentence, streamlining early appearances and trial preparation.
  • Practitioners must be ready to address indictments, resolution prospects, and trial readiness at the first CCML appearance.
  • Sexual offence cases with child complainants are assigned early to a judge to reduce delays in giving evidence.
  • You will have an opportunity to ask Daly AsJ any questions you have about how the system will work, and to provide suggestions or feedback about the system.
  • Presenter

Michael Daly AsJ was appointed as the Associate Judge of the Supreme Court of Tasmania in April 2024.  Between 2007 and the date of his appointment as the Associate Judge, he served variously as a temporary magistrate, magistrate and Deputy Chief Magistrate from 2007.  His Honour has a long interest in criminal case management.
