What makes fights about the farm different?
• Dealing with living things - Humans, stock, horticultural crops; there is elevated sentimentality and the blurring the personal and legal
• Ddealing with matters of principle such as legacy issues and distress - lding to potential destruction of relationships
• Operational considerations - those within control of the parties and beyond control of the parties, such as, seasonality / climate events. The idea that maximising the bucket benefits everyone
• Liquidity - timing issues such as operational considerations and legacy issues ie. tax. Again the ida of maximising the bucket benefits everyone and accommodating different needs across life stages and needs
• Parties and wise advisors are initiating change - separately from the courts; by agreement written into documents such as partnership agreement; by a decision made when circumstances dictate (conisder health and black swan events). Prelitigation; Recognising and utilising other form of ADR - facilitation; conciliation/neutral evaluation; arbitration
