This session is delivered by Simone Herbert-Lowe, Principal, Law & Cyber. Simone considers: where to draw the line between acceptable use of AI and unacceptable risk, how verification should be undertaken in practice, how to supervise junior lawyers’ use of AI, how to protect confidentiality and privilege, and how to ensure the firm’s position remains defensible if scrutinised. While most firms now have, or are developing, AI policies, the greater challenge lies in their practical application. This ultimately turns on judgement and effective supervision, particularly where junior lawyers are using AI under time pressure, which is often where the greatest risk arises.

Presenter
Simone Herbert-Lowe is the founder of Law & Cyber and a leading Australian adviser on cyber, privacy and AI law. With more than 30 years’ legal experience, she works with businesses, professional associations and law firms to navigate the complex risks at the intersection of technology, compliance and professional obligation.

Her practice focuses on Privacy Act compliance and reform, data breach response, and the development of robust privacy frameworks, including for organisations adapting to Australia’s evolving AML/CTF regime. In the AI space, Simone provides strategic guidance on governance, acceptable use, and the professional responsibilities arising under emerging court requirements, including the Federal Court’s GPN-AI and the Supreme Court of New South Wales’ SC Gen 23.

Simone is widely recognised for her ability to translate technical risk into practical legal strategy. She has educated more than 10,000 Australians on cyber risk, delivered training for major professional associations and national sporting organisations, and provided expert written opinions in high-value Supreme Court litigation.
