Evening: Dinner & Presentations.

IMPORTANT CONDITIONS OF ENTRY APPLICATION, PLEASE READ CAREFULLY  

WARNING - Skiing and snowboarding are inherently dangerous sports, by submitting your application you accept that you and any child (any person under 16) you enter into the events, take part completely at your own risk. The University Ski Club (Club) organises the races and bumps and jumps events (the events) but is not insured for and, except for gross negligence (see below), does not accept and excludes any liability for death or personal injury arising out of participation in the events. If you want insurance you will need to obtain your own insurance but you should note that many insurers do not accept liability for or cover, snow sport racing (one of the reasons the Club does not have insurance). This all needs to be set out legally as follows:

To the extent permitted at law:

1. the Club and its officers are not liable to you or any child (see above), if you or your child injure yourself (this includes any injury including permanent disability or death) suffered as a consequence of taking part in any of the events; and
2. you release and indemnify Club and its officers against any liability, loss or damage you or any child (as above) may suffer (this includes loss of amenity, future earnings and pain and suffering) as a consequence of participating in the events or any injury (including permanent disability or death) suffered by you or any child,

even if the club or its officers are negligent in any way or if we breach any statutory obligation or duty we have to you or if we are in breach of any express or implied term of any contract with you.

WARNING: Specifically, your rights to sue the Club and its Officers under the Australian Consumer Law and Fair Trading Act 2012 if you or your child are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out above.

NOTE: The change to your rights, as set out in or on this application, does not apply if your death or injury is due to gross negligence on the Club's or its Officers’ part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.

If you are concerned about your level of expertise or that of your child or the condition of the course (which you need to satisfy yourself that you and any child can complete safely) the Club would rather you did not take part in the event.

Finally, you must wear a protective helmet and you are solely responsible to make sure that your snow equipment and that of any child you enter is in good order and ready for racing.
