About
Hamilton Locke's Workplace Health and Safety team is pleased to present a mock trial examining how a work health and safety prosecution arising from a falling industrial gate unfolds in court. This session will be suitable for anyone in the property ownership and management space, and will be particularly useful for General Counsel, WHS and Compliance Managers, and other property professionals.Industrial gates are a routine feature of commercial and industrial properties across Australia. Between 2017 and 2025, SafeWork NSW reported being aware of at least 17 incidents involving industrial gates, two of which resulted in fatalities. There have been a number of high-profile prosecutions arising from failed industrial gates, resulting in significant penalties.
This interactive training session has been designed to bring the courtroom to life for attendees, offering a practical and immersive understanding of WHS prosecution proceedings that goes beyond what can be achieved through conventional training or presentations. It will set professionals of all levels up for success, with practical insights into discharging their safety duties and promoting safety in their organisation.
Attendees can expect to gain:
• a practical understanding of how WHS prosecutions are conducted in Australia;
• an appreciation of how WHS duties, specifically overlapping duties, operate across multiple parties arising from a single incident;
• an understanding of the factors that influence liability and penalties in WHS matters; and
• practical guidance on the steps organisations should be taking now to manage their exposure in relation to asset ownership.
