[In Person] The Ethical Risks of Undertakings

Presented by George Street Chambers’ members Chris George and Odette Wilson, this seminar examines the ethical risks associated with undertakings, using the recent decision in Legal Services Commissioner v Cavanagh [2025] QCAT 290 — where a breach of an undertaking given to the regulator was found to constitute professional misconduct — as a case study.The presentation will cover what constitutes an undertaking, why undertakings are treated as sacrosanct, when practitioners should refuse to give them, the consequences of breach, and practical risk management strategies for solicitors and barristers alike.
Chris has acted in a wide range of matters, predominantly in commercial litigation, corporations disputes, banking, finance and insurance litigation, and tort, succession and defamation. He is the Joint Title Editor of The Laws of Australia: Civil Procedure, a sessional member of the Queensland Civil and Administrative Tribunal, and a nationally accredited and experienced mediator.
Odette was called to the Bar in May 2025 and has a diverse practice spanning commercial litigation, planning and environment law, native title, succession law, and criminal and regulatory matters.
Before coming to the Bar, she practised as a solicitor in the planning and environment team at Corrs Chambers Westgarth, and served as Associate to the Members of the Land Court of Queensland and to His Honour Judge Jones of the District Court of Queensland.
