The first of a 5-part CPD series on the NSW Design & Building Practitioners Act (DBP Act), the ACA NSW/ACT hosts an information session by special counsel Christopher Larcos of Moray & Agnew Lawyers. The presentation sets out key issues as they apply to architects.

The new Design and Building Practitioners Act 2020 (NSW) has been billed by the NSW Minister for better Regulation and Innovation, Kevin Anderson as “the biggest overhaul of NSW building laws in the State’s history”. That statement is not hyperbole. At the heart of the Act is a new statutory duty by which architects (amongst others) must use reasonable care to avoid economic loss as a result of building defects.

Christopher Larcos will cover the following topics:

  • the problems the Design and Building Practitioners Act 2020 (NSW) aims to remedy
  • how the Act sets about addressing these problems
  • the nature of the new duty of care, including to whom it is owed
  • what work is covered by the Act
  • what obligations and liabilities an architect has under the Act

Our speaker

Christopher Larcos is the Special Counsel for Moray & Agnew Lawyers. He advises contractors, developers, architects and other professionals on various tendering, contracts, security of payment, home warranty, contract administration and claims management issues.

He prepares bespoke contracts and amended forms of Australian Standard contracts, and has extensive PPP, D&C, EPC and EPCM experience. Christopher is registered as both an architect and a solicitor, with over 15 years’ experience as a front-end projects lawyer and over 20 years’ experience as an architect.

Competencies: AACA NSCA - 9 Practice Management - 9.7 Knowledge of legal and regulatory requirements and obligations in regard to architectural practice, practice management and registration as an architect.

Once you have made your booking you will receive the recording registration link to view the seminar, along wtih presentation slides and CPD questions. A link will be provided with CPD questions to submit your own responses to questions, view answers and for issue of a certificate of completion. Please keep your receipt, a copy of completed questions and certificate for your records.
