1. By purchasing or using a ticket for entry into the Matsumura Blues Festival in Mildura (Festival), you agree to be bound by these Terms and Conditions.
2. All tickets are non-refundable, except as required by law.
3. By purchasing and using a ticket for the Festival, you acknowledge that you enter the Festival and Venue at your own risk.
4. The Festival may be cancelled due to an act of God, state of emergency, or any other reason outside of our control, if the event organiser deems the Venue to be unsafe for the Festival to proceed/continue. There will be no right of refund or exchange, nor any obligation on us, to reschedule the Festival (unless otherwise required by law).
5. We may cancel or postpone the Festival for any reason, including due to government direction, or a public health emergency. If the Festival is postponed, we reserve the right to reschedule the Festival and offer a ticket exchange to reschedule the event.
6. We may add, withdraw, reschedule, or substitute artists, and may vary advertised programs, prices, or venues, without notification. No refunds will be given in this case.
7. If you breach or do not fulfil any of your obligations in the Terms and Conditions, we have the right to search bags and possessions, confiscate prohibited items, evict patrons and/or remove wristbands.
8. No refund will be given on any unused portion of tickets if you are required to leave the Festival for any of the reasons set out in these Terms and Conditions, or if you decide for whatever reason, not to attend all or any part of the Festival, or you are refused entry for any of the reasons set out in these Terms and Conditions. Anyone ejected from the Venue will not be re-admitted to the Festival, even if they hold a valid ticket.
9. By purchasing and using this ticket you accept that you are attending a music festival which may be unpredictable at times and to give rise to a risk of injury. You also accept the risk involved in attending an event at which alcohol will be served to patrons at their request and in accordance with all legal requirements. To the fullest extent permitted by law, we do not accept liability of any nature for the acts, omissions, or default, of those providing services in connection with the Festival, or any liability for any injury, damage, loss, delay or additional expenses which are incurred at or in association with the Festival, regardless of the cause (including negligence). For any condition or warranty imposed by legislation which cannot be excluded or modified, our liability will be limited, at our option, to the resupply of the services, the cost of having the services supplied again, or the refund for the face value of the ticket purchased. In no event will we be liable for any indirect, consequential, exemplary, or special damages.
10. You agree that you are not permitted to bring your own (BYO) alcohol or illicit drugs to the Festival. If you are caught with BYO alcohol or illicit drugs, you will be evicted or ejected from the Venue. No refunds will be given in this case. In the case of finding illicit drugs, the matter will be referred to Victoria Police. No BYO soft drinks or other non-alcoholic beverages are permitted into the Festival. Empty reusable bottles may be brought into the Festival for refilling from the water station(s).
11. No hard eskies, glass, metal cutlery, knives, weapons, umbrellas, shade tents, animals (except for service animals such as guide dogs), fire/fireworks, laser pointers, drones, video and audio recording devices (including GoPros, but excluding mobile phones), selfie sticks or any item prohibited by law, are permitted into the Festival. You agree not to bring any of those items into the Festival.
12. Any items or objects considered by the event organiser and the Venue to be dangerous or capable of causing public nuisance and that could be used to distract, obstruct or interfere with any performer or patron is prohibited. You also agree not to engage in or to encourage or support any crowd-surfing or stage-diving.
13. You agree to a search of your person or possessions on entry to the Festival. Prohibited items will be confiscated by the event organiser or its staff, volunteers or contractors such as security personnel. We accept no responsibility for confiscated items. If you refuse consent to a search, we will refuse your entry into the Festival or may evict you, without refund.
14. Youths (younger than 18 years old) must be supervised by a responsible ticket-holding parent or adult guardian at time of entry into and at all times during the Festival.
15. During the Festival, you agree to follow all official directions by Festival staff, volunteers and contractors, such as security personnel.
16. All recordings (photographic, audio or video) of the Festival performers for commercial purposes, are prohibited.
17. You consent to be included in any photography, film and/or sound recordings of the Festival or its surrounds and for these recordings to be used by us for any future Festival marketing and promotional purposes.
18. Trespassers and anyone helping trespassers, will be evicted or ejected from the Venue.
19. You may only smoke or vape in designated outdoor smoking areas. No food or drink is to be consumed in these areas.
20. All patrons must comply with liquor licensing laws that apply in all licensed areas. All licensed areas have their own conditions of entry and rules relating to the responsible service of alcohol. Failure to adhere to those conditions of entry or rules may result in refused service, eviction, or refusal of entry to the licensed area, and/or the Festival. Due to liquor licensing laws, it is an offence to remove alcohol from the licensed areas, or to supply minors with alcohol. Anyone found doing so will be evicted or ejected from the Venue.
21. You must act in an orderly manner when attending the Festival. We may refuse entry to or evict you from the Festival if you are behaving in an anti-social, disorderly, offensive, aggressive or inappropriate manner, or if you breach these Terms and Conditions.
22. Entry to the Festival may be refused if you do not obey all government directions or regulations at the event.
23. If you are injured or fall ill at the Festival, we may, at your cost, arrange medical treatment and/or emergency evacuation as deemed essential for your safety and you provide us with your consent to do so.
24. Neither us, as the Festival organiser/promoter, or the Venue will be responsible for any loss or damage to the property (including personal property such as bags, money, or other personal items) you buy or bring into the Festival.
25. You are liable for, and agree to wholly indemnify us in respect of, any loss or damage you cause to any person or thing whatsoever, at the Festival.
26. You agree to place any litter in the relevant bins provided in and around the Venue. Please respect the town and the Venue's neighbours and do not create excessive noise or drop litter while travelling to and from the Festival venue.
27. The Festival ticket for each date of 8 June 2024, and 9 June 2024, is a single day ticket only and may only be used by one person. They cannot be shared with another person. If you wish to attend two days of the Festival, you will need to purchase a separate ticket for each day. Your ticket is your responsibility and any lost, stolen or damaged tickets will not be replaced or reisssued. It is also your responsibility to ensure your mobile telephone's battery is charged at the time of entry to the Festival, to show your digital ticket. If any fraudulent tickets are presented, the matter will be referred to Victoria Police.
28. You agree to wear the Festival wristband for the duration of the Festival. The wristband will be issued to you in exchange for a valid day ticket upon entry. Wristbands are non-transferable. If a person is found at the Venue without a valid and undamaged wristband, or with a wristband that has been tampered with, they will be evicted from the Festival. Damaged wristbands will not be replaced. Do not share your digital ticket as multiple copies of the same ticket will not be accepted, and you will be refused entry if the ticket has already been used.
28. You agree to show proof of identification and age at the point of entry and during the Festival at all times when requested by us or any of the Festival staff, volunteers or contractors, including security personnel.
29. No concessional tickets prices are being offered for this event because the organisers are already offering tickets at already greatly reduced prices, compared to other commercially-run events.
30. No crowd surfing or throwing of any objects is permitted, and may lead to your removal from the event, or if any damage is caused, may lead to prosecution. Safety of all persons at the event is paramount.
Many of these Terms and Conditions are intended to keep everyone safe.
