Participant Indemnity Form
Please read the following information.
By registering to participate in the 2024 Mercy Dip, you are agreeing that you have read and understand the terms and conditions listed below. If a participant is under 18 years of age, this form is to be read and understood by a parent or guardian.
1. In this agreement:
a. “Claim” means and includes any action, suit, proceeding, claim, demand, damage, cost, or expense however arising including but not limited to negligence but does not include a claim against Mercy Regional College under any right expressly conferred by its constitution or regulation.
b. Activity: means participating in the 2024 Mercy Dip. A Cold-Water Dip held at Lake Bullen Merri on the 13th of September 2024, at 7.00am.
2. Warning. The Activity is inherently dangerous. I acknowledge that I am exposed to risks during this activity, including exposure to cold water, and that accidents may happen which may result in injury, or my property being damaged. Risks associated with cold water swimming include, but are not limited to:
a. Cold water shock is a danger for anyone below 15 degrees.
b. Swimmers with long term health issues or pregnant, should carefully consider participating in this activity.
c. All water activities involve the risk of drowning. Whilst Mercy Regional College will have lifeguards onsite, those who have limited swimming ability should carefully consider participating in the activity or reduce the level of water immersion to waist level.
3. I have read and understood these warning and voluntarily accept and assume the inherent risks in participating in the sporting activities.
4. I, to the extent permitted by law hereby:
a. Release Mercy Regional College from all claims that I may have or may have had but for this release arising from or in connection with my or my child’s (if under 18 years of age) participation in the activity; and
b. Indemnify and will keep indemnified Mercy Regional College in respect of any claim by any person arising as a result of or in connection with my participation in any sporting activities.
5. Right to Use Imagery: I acknowledge and consent to photographs and electronic images being taken of me during my participation of the sporting activities. I acknowledge and agree that such photographs and electronic images are owned by Mercy Regional College, and they may use the photographs for promotional or other purposes without my further consent being necessary. I acknowledge that this includes the use of photographs and electronic images on social media. If you wish to opt out of the imagery, use, please indicate this in the comments section of the try booking form.
