TERMS and CONDITIONS (for all school holiday junior cricket clinics and coaching programs organised by HKHDCCA)
Release of Liability and Indemnity
I, the undersigned, as a condition of acceptance of my child’s entry into this Coaches’ Association (HKHDCCA) / Northern District Cricket Club (“the organisers”) Cricket Clinic or related coaching program, hereby waive all and any claim, right or course of action that I might otherwise have in respect of all dangers and risks, including but not limited to any injury, permanent disability, death or loss of any description whatsoever as a result of my child’s participation in these clinics, regardless of whether those dangers and risks were known or unknown at the time of this electronic registration. I accept full responsibility for, and agree to forever release and hold harmless the organisers of these clinics and any related bodies. This waiver, release and discharge shall operate separately in favour of the Northern District Cricket Club; Hornsby Ku-ring-gai & Hills District Cricket Association Inc.; HKHDCCA Inc. (Coaches’ Association); Hornsby Shire Council; Ku-ring-gai Municipal Council; Hills Shire Council; Parramatta City Council; all sponsors, persons, corporations and bodies involved or otherwise engaged in promoting or staging these cricket clinics, and the coaches, volunteers, servants, agents, representatives and officers of any of them. No responsibility will be taken for any loss of personal belongings or equipment.
Medical Treatment – I hereby authorise the organisers and coaching staff at these clinics to act on my child’s behalf in the case of any accident or emergency, including arranging any medical, ambulance or hospital care they deem necessary at the time. I note that the organisers will have a trained First Aid Officer and appropriate first aid kit on hand at each clinic. I agree to pay for all costs or expenses for any medical, ambulance or hospital care of my child during or after my child’s participation in these clinics or related coaching programs. I note that the Coaches’ Association has an approved COVID-19 Safety Plan.
Insurance – I note that the Coaches’ Association (HKHDCCA Inc.) has its own Public and Products Liability Insurance ($20M), which includes limited Personal Injury Insurance provisions. The policy number with ATC Insurance Solutions Pty Ltd is 169770, and the period of insurance is 17 August 2023 to 17 August 2024. The policy was organised through Cricket Australia’s insurance broker, Marsh Advantage Insurance Pty Ltd, trading as Marsh Sport, Australia. The Coaches’ Association is also formally affiliated with the Hornsby Ku-ring-gai & Hills District Cricket Association (HK&HDCA) Inc. Participants at the HKHDCCA / NDCC cricket clinics and other coaching programs are encouraged to have private health insurance in place.
Child Protection legislation – I note that the Coaches’ Association has a designated Child Protection Officer on its Committee and fully complies with the Child Protection (Working with Children) Act 2012.
Media Content Consent – I acknowledge that photographs, sound and video recordings (“media content”) may be taken of my child, individually or in a group setting, during my child’s participation in these clinics or other coaching programs. I hereby authorise the organisers to use any media content taken of my child for the purpose of coaching, promoting or marketing, including uploading media content on the organisers’ website, social media platforms and Annual Report. I acknowledge that the organisers own all rights, title
and interest in such media content.
Wet weather policy – I acknowledge that cricket is an outdoor sport so the organisers and participants will be dealing with nature’s elements. The organisers have a sensible wet weather policy that may result in a clinic, or part thereof, being moved indoors, postponed, cancelled or switched to another venue, depending on the circumstances. Parents will be notified in advance, as far as practicable. The organisers may process a partial reimbursement of registrations fees in certain circumstances, or hold credit for the child’s future
attendance at a similar clinic. The clinics will proceed in sunny, cloudy conditions or light intermittent rain, however they will obviously not proceed outdoors in heavy rain, hail or thunderstorms.
Privacy Policy – all personal information collected on the Coaches’ Association’s online registration form will be used by the organisers, supervisors, coaches and volunteers for the general administration and conduct of these clinics. In every instance, disclosure of personal information will only be undertaken in strict accordance with the Privacy Act 1988. All personal information is stored on a secure database and will not be provided to any third parties for any purpose other than those outlined above.
Acknowledgement and Confirmation – I am authorised to sign this online registration (as parent or legal guardian), have read and understood these Terms and Conditions, and have agreed to conform with them.
