Terms and Conditions  −  SPRING HOLIDAY DANCE WORKSHOP 2025

BY ATTENDING LAUNCH PERFORMING ARTS CENTRE YOU AGREE AND CONSENT TO BE BOUND BY ALL TERMS PRESENTED IN THIS WAIVER AND RELEASE.

In these Terms & Conditions, the following definitions apply:
(a) “ LAUNCH Performing Arts Centre” means the entity which enters into contracts with students.
(b) “Premises” means 20-22 Surfers Avenue, Mermaid Beach QLD 4218.
(C) Customer means any person who is completing the enrolment process for their child into a holiday workshop program at LAUNCH Performing Arts Centre.

LAUNCH PERFORMING ARTS CENTRE requires that all participants follow safety rules and instructions that are designed to protect everyone’s safety. However, you acknowledge that there is an inherent risk of injury when choosing to participate in fitness activities.

SUPERVISION
LAUNCH Performing Arts Centre students are under full supervision whilst in the dance studio only. No responsibility will be taken for students who have left the studio. Students may wait quietly in the foyer for pick-up. Please ensure that all drops off are only 10-15 minutes prior to their start time and pick-ups are prompt.

PARENT/GUARDIAN VIEWING POLICY
For students to gain the most out of their classes we need a focused environment free from distractions so parents unfortunately aren't allowed into the studio to view classes. We do however, upload class videos, photos and updates in our private Facebook groups regularly.

PARKING GUIDELINES - Drop & Go Policy
Our safety plan includes a drop and go policy for all parents and students to reduce traffic through our reception area.
DROP OFF - Parents will be met by our driveway staff in the carpark as you drive through. Please enter through the far left driveway. After students exit the car, they will be escorted into reception to wait with their teacher and peers for their class to begin.
PICK UP - Students will be escorted out to the front gate by driveway staff when their parent/guardian arrives to pick them up.
Please adhere to these directions.

CLASS ETIQUETTE
Proper dance attire, shoes and neat hair that is secured off the face are required in all classes. All students are encouraged not to leave the room once class has begun. Please allow for appropriate restroom use prior to class. Students are encouraged to bring a water bottle. LAUNCH Performing Arts Centre maintains the right to dismiss any student who causes disruptions to any class of a severe nature. This severity is at the judgement of the dance teacher.

REFUND POLICY
We do not offer refunds for change of mind or under any other circumstance. If sickness or injury occurs for an attendee, the ticket purchaser provides notice in writing prior to the start time of their ticket and suitable medical evidence provided, we can request a credit pending management approval.

EVENT CANCELLATION
In the event that the workshop needs to be cancelled a full refund will apply.

PERSONAL INJURY
Please inform the teacher of any special health consideration or existing injury prior to class. LAUNCH Performing Arts Centre is not liable for personal injury sustained whilst on the premises. A first aid kit with basic materials (pain relievers excluded) will be made available.

DUTY OF CARE, SAFETY AND CONDUCT
LAUNCH Performing Arts Centre will take reasonable duty of care in every situation and aim to provide a safe learning environment to reduce the risk of injury. Students are responsible for their own conduct, behaviour and personal safety whilst on the premises. LAUNCH Performing Arts Centre does not accept responsibility for student’s safety outside the premises. Students and their parents/guardians consent to partake in dance classes at their own risk and participate within their own limitations and capabilities. Students and their parents/guardians agree to not place themselves or others in any perilous or dangerous situation(s). Students and their parents/guardians acknowledge dance and performance related activities are a high risk activity and may involve elements of danger. Social media slander of any kind will not be tolerated. This includes Facebook, Twitter and any other internet or social based outlets.

ANTI-BULLYING POLICY
At LAUNCH Performing Arts Centre we offer all families a safe and inviting dance area. The studio has a very strict anti-bullying policy which extends outside of the dance space as well. We want our dancers to bond and create great friendships. All students have the right to feel safe and happy in the studio and we do not tolerate anything less. Dancing is a team sport and all students learn how to dance as part of a team atmosphere and be accepting of all other dancers. Students and parents/guardians at LAUNCH Performing Arts Centre are responsible for their own behaviour. Bullying of any form will not be tolerated.

ANTI-DISCRIMINATION
LAUNCH Performing Arts Centre aims to provide an environment where students and others in the dance school are treated fairly, treated with respect and are free from unlawful discrimination, harassment and vilification. If any student or family member of an enrolled student is found in breach of any of the above, disciplinary measures will be taken on an individual basis as per management's discretion; including reporting to law authorities if necessary.

DRUGS & ALCOHOL
LAUNCH Performing Arts Centre does not tolerate the use, sale or possession of any controlled substance, drug or alcohol. The following is prohibited for any student or student’s family members on LAUNCH Performing Arts Centre’s premises or whilst representing the LAUNCH Performing Arts Centre at any events/concerts:
*Having possession of any unlawful substances
*Having any unlawful substances present in their system
*Being under the influence of any unlawful substances
*Using, transferring, selling or attempting to sell any unlawful substances
If any student or family member of an enrolled student is found in breach of any of the above, disciplinary measures will be taken on an individual basis as per management's discretion; including reporting to law authorities if necessary.

SEXUAL HARASSMENT
It is the responsibility of the teachers, staff and students to create an environment free of sexual coercion and unwanted conduct. In the event a student feels that they have been the victim of discrimination, bullying, student’s are requested to report this matter directly to management. In the event of a complaint being found to be valid or a violation of LAUNCH Performing Arts Centre policy found to have occurred, management will take action. If any student or family member of an enrolled student is found in breach of any of the above, disciplinary measures will be taken on an individual basis as per management's discretion; including reporting to law authorities if necessary.

PROPERTY
LAUNCH Performing Arts Centre is not liable for the damage or loss of any personal property left on the premises prior to, during or after dance classes. Please label all shoes and dance attire with the student’s name. The student and their parent/guardian release LAUNCH Performing Arts Centre dance staff, instructors, agents and directors from any responsibility in any way for loss or damage of its personal belongings or property. Any property found at the completion of class will be stored in the lost property basket. The student and their parent/guardian shall make no claim adversely impacting, causing hardship or undue stress on LAUNCH Performing Arts Centre, except to the extent that such claim arises from any negligence, misrepresentation, fraud, or breach or non-performance of these Terms & Conditions by LAUNCH Performing Arts Centre. Nothing contained in these Terms & Conditions will deny either party the right to seek urgent interlocutory relief (including for an injunction) from an appropriate court of competent jurisdiction.

PHYSICAL CONTACT
Physical contact between students and teachers may be necessary at times to correct alignment and technique. Costume fittings are a necessity and may involve contact between students and costume makers to make necessary adjustments.

TOILET PROCEDURE
In response to the needs of children who are toileting and need assistance, staff will:
*Ensure accidents will be treated with sensitivity and the child supported while maintaining the child’s dignity during the changing process.
*Children will be encouraged to wipe their own bottoms with the help of a staff member wearing gloves.
*Children will be guided to follow the process of wiping front to back, flushing the toilet, washing and drying hands.
*Toilet area and toilet seats will be monitored routinely to maintain hygiene and cleanliness.
*Toilet area will be monitored constantly to ensure supervision is maintained at all times.

COMPLAINTS AND APPEALS
All complaints and appeals must be put in writing to the Studio Director, Michelle Hopper Doyle, via email to michelle@launchpac.com. If necessary, a meeting will be scheduled to discuss the situation with the involved parties. Under no circumstances are teachers to be contacted directly either in person or via online and phone communications including, phone calls, text messages, Facebook messenger or any other social media platforms.

CUSTOMER COMMUNICATION
LAUNCH Performing Arts Centre communicates information via email and as part of this service you must have a valid email account. Under no circumstances are teachers to be contacted directly either in person or via online and phone communications including, phone calls, text messages, facebook messenger.

HEALTH INFORMATION
Participation in dance is physically challenging and potentially dangerous and there is an inherent risk of injury involved. Dance training requires sustained, repetitive, vigorous physical activity, which may place extreme demands on the human body. The potential risks, dangers and hazards associated with participation in activities conducted by LAUNCH Performing Arts Centre include, but are not limited to: overstimulation due to bright and/or flashing lights and loud sounds and/or music; overexertion; sprains/strains; scrapes, cuts and/or abrasions; bruises; fractures; dislocations; joint and ligament injuries; muscle and/or ligament tears; soft tissue damage; slips and falls arising from slippery surfaces, spilled liquids, collisions, tripping hazards, missteps, and other mishaps; collisions with other participants and objects; head and/or spinal injuries; concussions; paralysis and/or death.

While LAUNCH Performing Arts Centre has in place policies and procedures, and takes all reasonable measures to mitigate these risks, it is not possible for all risks, dangers and hazards to be completely eliminated. As such, students and/or their parents/guardians (where the student is under the age of 18) are responsible for using their own judgement and are best placed to assess their own limitations and capabilities to determine whether it is safe for the student to participate in a particular activity conducted by LAUNCH Performing Arts Centre. Where a student does not wish to participate in an activity, there is no requirement by LAUNCH Performing Arts Centre for them to do so. By participating in any activity or event at, or conducted by, LAUNCH Performing Arts Centre, the student acknowledges and accepts that they are aware of the risks associated with their participation and that they accept these risks. When the student is under the age of 18, their parent/guardian acknowledges that they are aware of the risk associated with their child’s participation in the activities/events, and have discussed these with their child as needed, and that they accept these risks.

CODE OF CONDUCT
To ensure the smooth, safe running of the LAUNCH Performing Arts Centre and an enjoyable experience by all, below you will find our code of conduct. As always we are open to feedback, therefore, if any of the requirements outlined below are unclear or concerning, please contact LAUNCH via email to admin@launchpac.com to discuss your concerns further. Following a formal meeting, we reserve the right to dismiss or take disciplinary action on any students or parents who breach our studio’s code of conduct.

No classes (including private lessons) or teachers are to be disturbed unless it is an emergency. Parents are not to approach teachers or students during class and if messages or food/drink/medication needs to be passed on to a student, it must be done through a LAUNCH Performing Arts Centre administration staff member. All parents must wait in the car park until classes have been dismissed.

We are unable to take responsibility for our students before or after their scheduled classes and it is the responsibility of the parent/guardian to ensure their child is picked up and dropped off on time. In the case of an emergency or unavoidable delay, please contact the studio immediately to inform us of the situation so we can keep your child calm and safe until they can be collected.

Any questions or complaints must go through reception – parents and students are not permitted to contact LAUNCH Performing Arts Centre’s teachers via phone, in person, or via email / social networking with studio issues. Personal meetings with the Studio Director can happily be arranged via reception.

In the rare case of a parent or student showing disrespect or defamation to any parent, staff member or student, a meeting will be called immediately and dismissal may be considered at the discretion of the Director. Physical, mental, emotional or cyber bullying by parents, staff or students will not be tolerated and may result in dismissal from the studio.

LAUNCH Performing Arts Centre takes no responsibility for any stolen or misplaced property on the studio premises and we encourage our families to avoid bringing valuable items into the studio where possible.

LAUNCH Performing Arts Centre Management reserves the right to change teachers or timetabling when necessary at any time throughout the year. Choreography, costuming and studio policies remain the intellectual property of LAUNCH Performing Arts Centre and may not be reproduced or sold by any students, parents or staff without permission of the studio Director.

SAFETY
With the safety of our families a number one priority, LAUNCH Performing Arts Centre is very serious about upholding Child Protection laws and policies within the studio as well as at public performances and in the online arena (website and social media). As part of your registration, you will have read and signed a media waiver allowing us to proudly use images and video footage of your student for advertising and promotional purposes. Should you have any concerns whatsoever with signing this declaration, please see our reception staff who will happily assist you.

All teachers and staff members of LAUNCH Performing Arts Centre have undergone official government background checks allowing them to work with children. The directors and staff at LAUNCH Performing Arts Centre are educated on the negative impact of inappropriate music and costume selection when it comes to performing dance routines and are wholeheartedly committed to ensuring children in all of our dance routines are not subjected to any inappropriate songs or costuming. We recognise that songs with explicit, sexist, violent, racist, homophobic or criminal content may influence our dancers and/or audience and will strive to avoid using such music. We are committed to restricting costumes that project sexuality, contain explicit graphic or textual content.

There will always be a staff member trained in first aid on site. We enforce a nut-free policy at the studio to ensure the safety of any students or parents with allergies to nuts or nut products.

PRIVACY
When you purchase or hire a product or service with the LAUNCH Performing Arts Centre, the personal information we may collect from you includes your name, address, telephone numbers, email addresses, medical information and perhaps credit card or bank details. It may also include details of the products and services we provide to you as well as the status of your enrolment. We only collect information directly from our students or their parents/guardians primarily for the purpose of providing services and products to you and to administer and manage invoicing and debt collection.

We may occasionally use your information to promote and market to you information which we consider may be of interest to you unless you contact us via email to admin@launchpac.com and request us not to do so.

We will never sell or pass on any of your information to third parties unless required by government authorities or in the event of debt recovery. Any information passed on will be done so with appropriate privacy and confidentiality protection. Information is stored securely in paper or electronic form and is accessible only by authorised personnel.

PHOTOGRAPHY/VIDEO
Students participating in LAUNCH Performing Arts Centre's Dance Workshops, may be photographed or filmed for archive or the LAUNCH Performing Arts Centre website, social media profiles or YouTube channel (including social media profiles of Launch Performing Arts Centre’s faculty members). This usage may include (but is not exclusive to) displaying publicly, distributing, or publishing, photographs, and/or video of my child for use in materials that include, but may not be limited to printed materials (eg - brochures and newsletters), online and offline advertising and promotional videos and digital images such for use on Social Media. These images may be used by Launch Performing Arts Centre for a variety of purposes and that these images may be used without further notification. Surname and location will not be used in conjunction with any video or digital images.

WAIVER AND RELEASE
In participating in, or where the student is under the age of 18, allowing the student to participate in activities or events at and/or conducted by LAUNCH Performing Arts Centre, or which form part of the LAUNCH Performing Arts Centre programs, the student, or their parent/guardian (where the student is under the age of 18) agrees as follows:
(a) I acknowledge and agree that I have been sufficiently advised of the potential risks, dangers and hazards associated with my or my child’s participation in activities at LAUNCH Performing Arts Centre;
(b) (where the student is under the age of 18) where appropriate, I have discussed the potential risks, dangers and hazards with my child and to the extent possible confirm that they have understood and agreed to accept such risks, dangers and hazards;
(c) I assume and accept all liability for the materialisation of any risks, dangers and hazards associated with my, or my child’s attendance at or participation in activities or events at or conducted by LAUNCH Performing Arts Centre;
(d) I acknowledge, agree and understand that warning of risks above constitutes a formal ‘risk warning’ for the purpose of relevant legislation including sections 13 to 19 of the Civil Liability Act 2003 (Qld);
(e) I indemnify and release LAUNCH Performing Arts Centre and its employees, volunteers and agents of any and all liability which may arise as a result of my or my child’s participation in activities at LAUNCH Performing Arts Centre;
(f) I understand and agree that LAUNCH Performing Arts Centre is not liable for any personal injury suffered by me, or my child, whilst on the Premises;
(g) I understand the importance of following the instructions and rules set by instructor/s to ensure the safety of participants in the activities and agree to follow the instructions and rules set by instructors;
(h) In the event of an emergency, I authorise staff of LAUNCH Performing Arts Centre to obtain, and where appropriate administer, all necessary medical assistance and treatment for me or my child and agree that I am responsible for the payment or reimbursement of any medical costs incurred in rendering any first aid or medical treatment to me or my child, and that I am responsible for arranging and paying for any personal medical insurance I or my child might require to cover all or part of those costs;
(i) I acknowledge and agree that LAUNCH Performing Arts Centre does not accept responsibility for student’s safety outside the Premises; and
(j) I acknowledge that it is my responsibility to inform LAUNCH Performing Arts Centre of any condition, illness, impairment, past or present injury, or predilection to injury that may affect my, or my child’s ability to participate in activities at or conducted by LAUNCH Performing Arts Centre, or which may reoccur, or be aggravated or exacerbated by my, or my child’s, participation in activities at LAUNCH Performing Arts Centre.

Parent/Guardian Waiver (for students under 18)
The parent/guardian:
(a) represents that they are acting in their capacity as the student’s parent/guardian;
(b) consents to their child’s attendance at and participation in, activities and events at or conducted by LAUNCH Performing Arts Centre;
(c) agrees individually, and on behalf of their child, to the terms of the Waiver and Release set out above; and agrees to indemnify and release LAUNCH Performing Arts Centre, and its employees, volunteers and agents, from any liability, loss or damage arising from their acceptance of the terms of this Waiver and Release, and any liability, loss or damage arising from their child’s participation in activities and events at, or conducted by, the LAUNCH Performing Arts Centre.

WAIVER AND GENERAL RELEASE OF ALL CLAIMS AND ASSUMPTION OF RISK
You recognise and acknowledge that there are inherent risks of physical injury to participants in any fitness activities, including when taking a Launch Performing Arts Centre online class, and you voluntarily agree to assume the full risk of any and all injuries, damages or loss, regardless of severity, that you may sustain as a result of participation in Launch Performing Arts Centre’s online classes. As a material inducement for Launch Performing Arts Centre’s to permit you to participate in Launch Performing Arts Centre’s online classes, you hereby, on behalf of yourself, your heirs, executors and assigns, fully, forever and irrevocably waive, release and hold Launch Performing Arts Centre, its directors, agents, representatives, employees, consultants, affiliated companies, partners, and successors harmless from any and all claims (including, to the extent permitted by applicable law, claims alleging negligence on behalf of any Launch Performing Arts Centre’s Party), injuries, damages or loss (including legal fees), present or future, foreseen or unforeseen, anticipated or unanticipated (collectively “Claims”), that you may have (or that accrue to you) against any Party, and generally release and discharge the Launch Performing Arts Centre’s Parties from any and all Claims, including but not limited to those involving: (i) participating in any supervised or unsupervised dance/fitness activities including online classes, (ii) use of any dance/fitness equipment, (iii) accidental injuries, such as “slip and fall” injuries on or outside of Launch Performing Arts Centre’s premises, and you hereby promise never to assert or assist any other party in asserting, any claims or causes of action against any Launch Performing Arts Centre Party in any matter that in any way relates to any Claims.
