Terms & Conditions/Liability Waiver

1. The participant acknowledges that Pickleball activities involves physical exertion and physical risk and could result in the Participant’s (or another party’s) death, physical injury, mental injury or other impairment.

2. The Participant voluntarily agrees to take part in the Pickleball Activities at the Participant’s own risk.

3. The Participant acknowledges and agrees that Trafalgar Park Bowls Club Inc. (ABN 18 023 327 803), its employees, agents or contractors will not be responsible for (and each Participant) forever releases Trafalgar Park Bowls Club Inc. from, holds them harmless and waives all rights in respect of any loss or damage caused to the Participant or any other party in connection with the Pickleball Activities in the nature of:

a) death or physical or mental injury;

b) the contraction, aggravation or acceleration of a disease; or

c) the coming into existence, aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs that may be harmful to the Participant or the community or may result in harm or disadvantage to the Participant or the community.

4. The Participant indemnifies Trafalgar Park Bowls Club Inc. and agrees to keep them indemnified in respect of any loss or damage suffered or incurred by Trafalgar Park Bowls Club Inc. as a result of the Participant taking part in the Pickleball Activities.

5. PHOTOGRAPHIC RELEASE: I grant permission to {Club} to use photographs, video recordings, or other media of me for promotional purposes.

6. By proceeding with the booking, the participant understands and hereby release to hold harmless Trafalgar Park Bowls Club Inc., its Committee members & instructors from all claims, actions, or losses related thereto. Trafalgar Park Bowls Club Inc. assumes no liability for injury or damage arising from the results of participation in Pickleball activities offered by Trafalgar Park Bowls Club Inc.
