KINDER SURPRISE X PAW PATROL HQ EVENT TERMS AND CONDITIONS
GENERAL
1. In these Event Terms and Conditions:
a. a reference to the “Event” is a reference to the Kinder Surprise x PAW Patrol HQ event, taking place at Alexandria NSW Fire Station on 02/10/2025, which you are a ticket holder or prospective ticket holder of (subject to the booking of a ticket to that event); and
b. a reference to the “Event Organiser”, “we”, “us”, “our” or “Ferrero” is a reference to Ferrero Australia Pty Ltd (ABN 29 001 249 261), of Level 36, 100 Miller Street, North Sydney, NSW 2060.
2. These Event Terms and Conditions, as well as any other terms, conditions, policies, notices, and/or disclaimers provided to you or otherwise displayed or published in connection with the Event (collectively, the “Event Terms and Conditions”) apply to the booking of any tickets to the Event, as well as the conduct of individuals who attend the Event. By booking a ticket and/or attending the Event, you and your companion(s) agree to be bound by these Event Terms and Conditions. Please read these Event Terms and Conditions carefully before booking an Event ticket or attending the Event and ensure your companions do the same.
3. These Event Terms and Conditions apply in conjunction with our Privacy Policy (which can be found at https://www.kinder.com/au/en/privacy-policy) which should be read together with these Event Terms and Conditions. To the extent of any inconsistency between these Event Terms and Conditions and our Privacy Policy, these Event Terms and Conditions shall prevail to the extent of the inconsistency.
BOOKING TICKETS
4. Ticket bookings are only open to adults aged 18 years and over who are attending the event with at least one child. For every two (2) child attendees, there must be one (1) adult attendee.
5. The Event Organiser reserves the right to cancel or invalidate any tickets booked by individuals who are not attending the Event with a child.
6. To book a ticket to the Event, you must access the ticket booking website, follow the prompts, input all requested details and fully complete the booking. If you make a successful booking of tickets, you will receive a booking confirmation email.
7. One ticket must be booked for each individual attending. If you are attending with two children, you must book three (3) tickets. A limit of three (3) tickets per person applies.
8. Each ticket will be timed for an hourly timeslot. You must arrive promptly during the timeslot allocated to your ticket(s).
9. Event tickets are free of charge, however, all Event attendees must hold a ticket for entry.
10. Event tickets are allocated on a first-come, first-served basis. If tickets that have been booked prior are cancelled, those tickets may be re-offered via the booking website, as determined by the Event Organiser in its sole and absolute discretion.
11. You are not required to print your booking confirmation email – you can present the electronic PDF version of the ticket to be scanned directly from your mobile or tablet device. If you have not received your tickets within 48 hours of the Event, please contact us at kinder@idcollective.com.au.
TICKET TRANSFERS AND CANCELLATION
12. Tickets are not transferrable, unless otherwise specified by the Event Organiser in writing.
13. If you or your companion(s) are unable to attend the Event and you wish to cancel your tickets, please contact us at kinder@idcollective.com.au.
14. Subject to any statutory consumer rights (including, without limitation, the provisions of the Australian Consumer Law):
a. the Event Organiser is not required to provide any compensation if you or your companion(s):
i. are denied entry into the Event for reasons which were disclosed to you in the Event’s terms and conditions at the time of booking or are ejected from the Event for any inappropriate behaviour. For example, these reasons may include (but are not limited to) unwillingness to provide personal contact information when requested, failing to follow directions of Event staff or intoxication; or
ii. attend the Event and subsequently leave part way through due to feeling unwell or any other reason; and
b. if the Event takes place, then generally there is no right to any compensation for cancellation, including where you or your companion(s) cannot attend because of adverse weather conditions.
CANCELLATION OF EVENT
15. We reserve the right to cancel the Event for any reason.
16. If the Event is cancelled, your order and Event tickets will be cancelled.
17. The Event Organiser will not be liable for any delay or failure in relation to the Event in the event of war, terrorism, state of emergency, government lockdown, pandemic, or any other kind of disaster or unforeseeable event beyond the Event Organiser’s reasonable control (“Force Majeure”). If a Force Majeure Event occurs, the Event Organiser reserves the right to cancel the Event, or modify any element included as part of the Event ticket as appropriate.
CONDITIONS OF ENTRY
18. Entry is restricted to individuals aged 18 years and over who are attending the event with at least one child.
19. Each adult ticket holder is responsible for the supervision and safety of any child that they are accompanying to the Event.
20. The recommended minimum age for attendance at the Event is three (3) years of age.
21. It is your responsibility (and that of your companion(s)) as a ticket holder to not share your ticket as multiple copies of the same ticket will not be accepted, and you or your companion(s) may be refused entry if the ticket has already been used.
22. All attendees must have a valid ticket to enter the Event.
23. Your tickets must be kept on your person at all times for the duration of the Event.
24. The right of admission is reserved and is subject to the Event Organiser’s sole and absolute discretion.
25. No alcoholic beverages can be taken into or out of the Event and any alcoholic beverages found will be confiscated and not returned.
26. No violence will be tolerated and attendees will be removed from the Event in the Event Organiser’s sole discretion.
27. There are no pass outs.
28. The Event Organiser and/or Event staff reserve the right to inspect and search all persons. All bags and containers are subject to a full search at entry points to ensure the safety of patrons. Refusal to consent to a search WILL prevent entry to the Event, without any other compensation.
29. Persons entering the Event may be monitored and recorded by Closed Circuit Television (CCTV).
30. Unless expressly advised otherwise by the Event Organiser or Event staff, smoking is not permitted during the Event. Where smoking is permitted, smoking is only permitted in designated smoking areas.
31. Prohibited items (which are noted in a list below) may be confiscated, at the Event staff’s and/or Event Organiser’s absolute discretion and may not be returned. Illegal substances will be handed over to police. The specific details as to what constitutes a prohibited item may vary and it is your responsibility to ensure that you have not taken any prohibited items with you into the Event space.
32. In the case of an emergency evacuation or situation, please follow all official directives.
33. You or your companion(s) may be filmed at this Event – see the final section of these Event Terms and Conditions for further information in this regard.
34. The Event Organiser accept no responsibility for property that is lost, stolen or damaged at the Event.
35. It is your responsibility to familiarise yourself with first aid locations and exit points.
PROHIBITED/BANNED ITEMS
36. This list of prohibited/banned items is non-exhaustive and is subject to the Event space’s policies on prohibited/banned items:
• Alcoholic beverages.
• Illicit drugs.
• Ice chests or eskies.
• Flares, fireworks, or explosives.
• Laser pointers.
• Knives, guns or other dangerous weapons including potential missiles.
• Skateboards, scooters, rollerblades or bicycles.
• Glass or breakable containers.
• Horns, whistles and megaphones or other musical instruments that may cause a nuisance.
• Cans or metal containers.
• Chairs (folding, portable, camping).
• Video and audio recording devices including GoPros (other than mobile phones).
• Professional still cameras (small still cameras are allowed).
• Selfie sticks.
• Any political, religious or race-related materials.
• Animals (with the exception of service or assistance animals, such as guide dogs).
• Any other item(s) the Event Organiser or Event staff consider may be used in an illegal, offensive or dangerous manner.
LICENCE AND EJECTION
37. The Event Organiser and Event staff reserves the right, to refuse admission to, or eject, any person whose conduct the Event Organiser or Event staff, or their agents, employees or contractors deems to be disorderly, intoxicated, who uses vulgar or abusive language or engages in any inappropriate, violent, harassing, antisocial or otherwise unacceptable behaviour, who damages any property, who has brought a prohibited item into the Event space or who otherwise fails to comply with these Event Terms and Conditions. A ticket is a revocable licence and any breach of these Event Terms and Conditions or any other applicable terms and conditions will terminate your licence to attend the Event without compensation.
38. Entry is at your own risk. The Event Organiser makes no representation as to the safety, conditions or other issues that may exist at the Event location.
39. The Event Organiser reserves the right to deny admission to the Event to any person holding a ticket that appears to have been tampered with, counterfeited, or duplicated, or is damaged or defaced in any way or has not been booked through the authorised booking website. Anyone found on site without a valid ticket will be deemed as trespassing and may face prosecution from NSW police.
RISK AND SAFETY
40. Risk of injury or illness: Although reasonable measures will be taken to protect Event attendees, injury and illness can occur as a result of your attendance at an Event. Upon entry to the Event space/attendance at the Event, you and your companion(s) acknowledge and accept the risk of an injury and/or illness occurring.
41. Safety Protocols: You and your companion(s) must also follow all lawful and reasonable directions of the Event Organiser and Event staff which are designed to create a safe environment for other Event attendees. If you or your companion(s) are injured or distressed or need assistance in dealing with an issue or emergency, immediately ask a member of the Event staff for assistance or directions to contact an emergency service.
LIABILITY, RELEASE AND INDEMNITY
42. Liability for other losses
a. Unless required by applicable law, the Event Organiser shall not be responsible or liable to you or your companion(s):
i. for personal arrangements and expenditure, including travel and other costs which have been arranged by you are at your own risk, as well as any wasted or unrecoverable costs or expenditure in relation to such personal arrangements, even if caused as a result of the cancellation or alteration of the Event;
ii. for any loss of enjoyment or amenity, including where the Event has been cancelled or altered;
iii. if admission to the Event is refused or revoked at any time as a result of your breach of these Event Terms and Conditions or any other applicable terms and conditions (and you will not be entitled to any refund); and
iv. any damage or loss of any personal property taken into the Event.
43. Liability Release
a. Nothing in these Event Terms and Conditions, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). All warranties, representations and implied terms and (except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees), any liability which may arise in relation to your booking of tickets or attendance at the Event by you and/or your companion(s) is expressly excluded to the maximum extent permitted by law.
44. You and your companion(s) agree to indemnify, save and hold harmless the Event Organiser, its suppliers, and the Event staff (and the respective owners, officers, directors, shareholders, principals, agents, representatives and employees of each), from any loss, liability, damage, costs, claim, proceedings, action, demand or expense (including, without limitation, legal costs and expenses) that may be claimed due to your booking of a ticket to the Event or attendance at the Event by you or your companion(s), including but not limited to as a result of your negligence (or that of your companion(s)), any failure by you or your companion(s) to follow a reasonable directive or instruction by the Event Organiser or their appointed representatives, or any breach by you or your companion(s) of, or non-compliance with, these Event Terms and Conditions.
RECORDING AND PHOTOGRAPHING OF THE EVENT BY EVENT ORGANISER OR EVENT STAFF
45. You and your companion(s) consent to be included in any audio recordings, audio-visual recordings and photographs of the Event created by, at the direction of, or with the authority of the Event Organiser (‘Materials”). In the event that you or your companion(s) hold any rights in the Materials, without any fee or compensation payable to you or your companion(s), you and/or your companion(s) licence and grant the Event Organiser (including their affiliates and sub-licensees) a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display the Materials (including any portion of the Materials owned, controlled or created by you and/or your companion(s)) any context and for any purpose, including but not limited to advertising, marketing, promotional or publicity purposes (whether in respect of the Event Organiser or third parties), in any and all media now known or later devised absolutely, in perpetuity, throughout the world without compensation, restriction on use, attribution or liability and free from any claims whatsoever from you. You and your companion(s) consent to any use of the Materials (including any portion of the Materials owned, controlled or created by you or your companion(s)) which may otherwise infringe your moral rights (or those of your companion(s)) pursuant to the Copyright Act 1968 (Cth) or other similar rights in respect of your or your companion(s)’ performance or participation in the Materials you or your companion(s) may be entitled to under the laws of any jurisdiction throughout the world in perpetuity and warrant that you and/or your companion(s) have the full authority to grant these rights.

All issues relating to the sale of tickets and the hosting of their associated event(s) are the responsibility of the “Event Organiser” and not that of TryBooking Pty Ltd (Australian Business Number 71126987915).
