Your child’s completed Registration Form and these Terms and Conditions of Participation are and comprise the terms and conditions upon, in accordance with and pursuant to which you agree to allow your child to participate in Aish Football Academy for Holiday Skills sessions

1. Protection
The proprietors and operators of the Program are committed to promoting and protecting the health, safety and wellbeing of all and any children and young people who participate in the Program.

2. Application to Participate
(a) You must, in respect of each child that you enrol in the Program:
(i) complete, date and sign the Registration Form;
(ii) pay the prescribed fee by means of direct debit, electronic funds transfer or cash; and
(iii) agree, acknowledge and warrant that your child understands and will at all times comply with the Player Code of Behaviour that is set out in paragraph 7 of these Terms and Conditions.
(b) By completing, dating and signing the Registration Form you certify and warrant that each child you register in the Program does not have any known or pre-existing medical or other conditions which will (or even might) make it unsafe for that child to participate in the Program.

3. Limitation of Liability and Release
By completing, dating and signing the Registration Form you also certify and warrant in respect of each child that you register in the Program that you:
(a) understand that there are certain risks that are inherently associated with participation in the Program which may result in either temporary or permanent personal injury to your child and you fully accept the possible consequences attendant with those and all risks;
(b) agree to not bring any claim or proceeding against any of the proprietors and operators of and contractors to the Program for or in respect of any damage, loss or injury whatsoever that you or the child enrolled by you may suffer from or as a result of their participation in the Program;
(c) formally waive all and any claims, rights or causes of action against any of the proprietors and operators of and contractors to the Program and forever and irrevocably release and discharge all and any persons, corporations, bodies or entities who or which are or may in any way, shape or form be involved or otherwise associated with the Program from and in respect of the loss of any life or any injury, damage or loss of any description that is suffered or sustained in the course of, consequent upon or incidental to their participation in the Program; and
(d) unquestionably and irrevocably agree and consent to these Terms and Conditions - and, in particular, the waiver and exclusion given in this paragraph 3 - being tendered to any Court of competent jurisdiction as unquestionable evidence of your present and future intentions to, in every possible way, exclude and hold harmless the proprietors and operators of and contractors to the Program who are in any way, shape or form associated with the Program from each and every of the aforementioned possible losses or injuries which may or might be suffered or incurred during, throughout and incidental to the participation in the Program of each child that you register.

4. Refunds and Cancellations:
(a) Once you have registered a child in and paid for their participation in the Program, a partial refund will only be provided in respect of a child who has a medical condition (NB: a valid Australian doctor’s certificate will be required in this regard) which prevents him or her from any further participation in the Program - however no refund will be given if the participant has attended more than 50% of scheduled sessions in the Program.
(b) The proprietors and operators of the Program are not liable to you for any consequential loss or damage that you suffer as a result of the Program (or any part or component of the Program) being cancelled, postponed or changed for any reason.
(c) The proprietors and operators of the Program are not liable to replace your or your child’s personal possessions, clothing and/or training equipment if it or any part of it is lost, stolen or damaged.
(d) The proprietors and operators of the Program may change a Program (or any part or component of a Program) including dates, session times, durations and locations.

5. Severe Weather Conditions
Depending on the severity of the weather from time to time the Program will, as a general rule, proceed. However, in the event of extreme weather, workshop sessions may be conducted indoors on any day.

6. Photographs
You consent to the proprietors and operators of the Program using your child’s name or image in any form for general marketing and promotional activities related to the Program. If you do not wish to consent to your child’s name and image being used please notify one of the proprietors and operators of the Program upon registration of your child.

7. Players Code of Behaviour
By registering a child in the Program you agree, acknowledge and warrant that your child understands and will at all times adhere to and comply with the following, non-negotiable code of behaviour:
(a) your child will at all times participate in the Program within the spirit of the rules of the AFL and the Program;
(b) your child will never bully or take unfair advantage of another participant in the Program; and
(c) your child will at all times show respect and be courteous to all other participants in and to all of the proprietors and operators of and contractors to the Program.
