Refunds:
If your digital images are damaged or lost prior to viewing your gallery for any reason by Grace Harrington Photography, only then will you be refunded in full. No refunds are given due to dissatisfaction with your images. There are no refunds or exchanges on any digital images. No refunds will be given due to lack of subject cooperation, weather conditions, lighting conditions, lateness of client, and missed session time.
Grace Harrington Photography is not responsible for compromised coverage as a result of causes beyond her control: lateness of the client, emotions and client behaviour, weather conditions, existing backgrounds, and lighting conditions that have a negative impact on or restrict photographic coverage.
Safety:
Grace Harrington Photography reserves the right to terminate coverage and leave the location of the event without warning if any party of Grace Harrington Photography experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the event; or in the event that the safety of any party from Grace Harrington Photography is in question.
Limitation of Liability:
If Grace Harrington Photography is unable to perform this agreement due to illness, emergency, fire, casualty, strike or causes beyond the control of Grace Harrington Photography, Grace Harrington Photography shall make every attempt to reschedule the session. If the reschedule is unable to be agreed upon, Grace Harrington Photography shall refund the client in full and shall have no further liability. Further, if Grace Harrington Photography is unable to deliver photographic materials due to technological malfunctions, including but not limited to camera and processing, or otherwise damaged or lost without fault of Grace Harrington Photography, liability shall be limited. Grace Harrington Photography reserves the right to cancel this contract for any reason, including conflict of interest. In the event of Grace Harrington Photography arrives late, or session time is running late, all time lost will be credited to the session.
Copyright and Reproduction:
Grace Harrington Photography shall own the copyright in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio entries, sample products, editorial submissions and use, or for display within or on Grace Harrington Photography website, blog, social media pages, and or studio. It is understood that any duplication or alteration of original images is strictly prohibited without the written permission of Grace Harrington Photography. Grace Harrington Photography grants the Client permission to share the images on social media, family and friends, vendor websites, as long as the images remain unaltered and textual credit is explicitly given to Grace Harrington Photography. In no way will the client sell the photographs or share to a blog.
Clients Usage:
The client's images are for personal use only and shall not be submitted to contests, reproduced for commercial use or authorise any reproductions by parties other than Grace Harrington Photography. The client shall only use the images and digital files in accordance with the permissions within the Terms and Conditions here.
Capture, Post Production, Editing and Delivery:
Grace Harrington Photography is not liable to deliver every image taken at the event. All clients will receive 3 images, the determination of images delivered to the client is left to the discretion of Grace Harrington Photography. The final post production and editing styles, effects, and overall look of the images are left to the discretion of Grace Harrington Photography. Images will be delivered within 72 hours of the event, any changes to this timeframe will be directly communicated to client.
Weather Policy:
In the event of bad weather conditions it will be at Grace Harrington Photography discretion to cancel the scheduled event. Grace Harrington will contact the client if necessary and the session will be rescheduled for another date.
Negligence:
If negligence on the client's part, the part of any above named models, or the part of any individuals that accompany the client to the photo session causes any equipment, props, or any of Grace Harrington photography property to malfunction or become damaged, that the client will be liable for the cost to repair or replace said items.
Cancellation:
If the client requests to reschedule or cancel their session 7 days or more prior to the client's session, the session time will be rescheduled to a mutually agreed upon time and date that is available within the event timeframe. Cancellation within 48 hours or less of the scheduled session or failure to show up at a scheduled session will result in the session fee being forfeited.
Protection of Personal Information:
The client is aware that your email information will be saved for future contact purposes and not limited to receiving emails and updates from Grace Harrington Photography. Any personal information received by Grace Harrington photography will be kept on file and never released to a third party.
Any photograph or film containing images or footage shared on a social media platform by Grace Harrington Photography that the client is not comfortable with will be taken down. If the client feels this way about any image post delivery, they should contact Grace Harrington Photography in writing.
