Compliance Statement – Australian Poker Nights / The Emerson
This event is conducted in accordance with Section 1.3A of the Gambling Regulation Act 2003 (Vic), which allows social poker where all buy-in funds are redistributed to participants and no rake, commission, or profit is retained by the organiser.
*The $400 buy-in is collected and held by APN Holdings Pty Ltd for the sole purpose of redistribution to players as prize money. No portion of this amount is retained by the organiser, venue, or any related entity. Funds are processed through a separate account and fully documented for transparency.
**The $100 venue hospitality fee is a distinct, non-gaming transaction charged by The Emerson Pty Ltd to cover entry, entertainment, and beverage service. This fee is unrelated to the conduct of poker and is treated as a standard venue service charge under the Liquor Control Reform Act 1998 (Vic).
Poker operations, hospitality services, and venue hire are handled by independent entities (APN Holdings, APN Event Services, and The Emerson) under separate ABNs, merchant accounts, and accounting ledgers. No cross-subsidisation or commingling of gaming and non-gaming funds occurs.
This structure ensures full compliance with Victorian gaming law, the social-poker exemption, and Visa/Mastercard merchant-category requirements. The transaction for the buy-in should therefore not be classified as a “cash-advance” but as a tournament entry payment, comparable to a sporting-event entry fee.
