CUSTOMER TERMS AND CONDITIONS OF SALE

1. Who You Are Buying From
* The Merchant for sales is A Super Progressive Movie Pty Ltd (“Merchant”, “We”, “Us”, “Our”).
* We are the organiser and presenter of A Super Progressive Movie (“Event”).
* Tickets are sold directly by Us via our authorised sales platforms, including TryBooking, or by Our authorised agents.
* By purchasing a ticket, you (“You”, “Your”, “Customer”, or “Ticket Holder”) agree to be bound by these Terms and Conditions of Sale.
* These Terms operate in addition to:
* The Venue’s Terms of Entry and Conditions of Sale,
* Any platform-specific terms (e.g. TryBooking), and
* Any applicable laws of the Commonwealth of Australia.
2. Conditions of Sale
* All prices are quoted in Australian Dollars (AUD) and include GST where applicable.
* All sales are final. There are no refunds, exchanges, or cancellations, except as required by Australian Consumer Law.
* Tickets are non-transferable and must not be resold for profit.
* Tickets found to be resold or transferred for profit may be cancelled without notice or refund.
* Tickets may not be used for competitions, giveaways, promotions, or advertising without written consent from the Merchant.
* The Merchant reserves the right to refuse sale or entry to any individual or entity at its discretion.
3. Event Changes and Cancellations
* The Merchant reserves the right to add, withdraw, substitute, or vary program content, guests, prices, venues, dates, and audience capacity at any time without notice.
* If the Event is rescheduled, your ticket will remain valid for the new date and venue.
* If the Event is cancelled entirely, refunds will be issued to the original payment method for the ticket face value only. Booking, service, or transaction fees are non-refundable unless required by law.
* If a performance is interrupted, delayed, or shortened due to technical, health, or operational reasons, no refund will be issued.
4. Attendance Requirements
* Admission is subject to venue capacity, safety, and security procedures.
* Patrons may be required to present photo ID matching the ticket name for entry.
* The Merchant reserves the right to refuse entry or remove any person engaging in disorderly, aggressive, or unsafe behaviour.
* Latecomers may not be admitted until a suitable break in the screening or Q&A session.
* All attendees consent to being filmed, recorded, or photographed as part of the Event audience.
5. VIP and Bundled Sales
* VIP tickets and packages (including merchandise or “meet & greet” experiences) are non-transferable and non-refundable unless the entire event is cancelled.
* All inclusions (e.g. merch packs, signed posters, photo opportunities) are subject to availability and may change without notice.
* If any VIP component cannot be fulfilled, the Merchant may offer an equivalent substitution or partial refund at its sole discretion.
6. Delivery and Fulfilment
* Tickets will be delivered electronically to the email address provided at checkout.
* The Merchant is not responsible for undelivered emails due to spam filters, incorrect email addresses, or user error.
* If physical merchandise is included, standard delivery terms apply, and delivery times may vary by location.
7. Refunds and Replacements
* No refunds will be issued for:
* Change of mind, scheduling conflicts, or travel disruptions,
* Event delays or program substitutions,
* Patron removal due to misconduct or intoxication,
* Lost, stolen, damaged, or destroyed tickets.
* If a refund is approved, it will be made only to the original payment method used for purchase.
* The Merchant does not offer compensation for ancillary expenses (e.g., accommodation, transport, meals).
8. Health Conditions
* Attendees agree to comply with all public health orders in place at the time of the Event.
* Entry may be subject to vaccination, health screening, or contact tracing requirements.
* Refunds will not be provided for failure to comply with health or venue entry requirements.
9. Liability and Risk
* Entry and participation are at your own risk.
* The Merchant, its agents, employees, and affiliates are not liable for any personal injury, illness, property loss, or damage sustained during attendance, except where required by law.
* The Merchant is not responsible for indirect, consequential, or incidental losses, including travel costs, accommodation, or loss of enjoyment.
10. Intellectual Property
* All logos, artwork, footage, and promotional materials related to A Super Progressive Movie are the property of A Super Progressive Movie Pty Ltd or its licensors.
* Unauthorised reproduction, distribution, or commercial use of Event materials is strictly prohibited.
11. Data Security
* Personal information collected during ticket purchase will be handled per our Privacy Policy.
* By purchasing a ticket, you consent to receiving relevant event updates via email or SMS.
* Credit card data is encrypted and processed via secure third-party systems (e.g. TryBooking).
12. Force Majeure
* The Merchant is not liable for failure to perform obligations where such failure is due to events beyond its reasonable control, including but not limited to:
* Acts of God, fire, flood, earthquake, storm;
* Government restrictions or pandemics;
* Strikes, lockouts, or industrial disputes;
* Power failure, venue damage, or transportation delays.
13. Choice of Law
* These Terms and Conditions are governed by the laws of Queensland, Australia.
* Any disputes arising from the sale or attendance of this Event shall be subject to the exclusive jurisdiction of the courts of Queensland.
15. Consumer Rights
* Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).
* You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
TryBooking is an online system for organisations and community groups that has been designed to look after the entire event ticketing and registration needs.
All issues relating to the sale of tickets and the hosting of their associated event(s) are the responsibility of the “Event Organiser” and not that of TryBooking Pty Ltd (Australian Business Number 71126987915).
