(the Activity Provider)
In consideration of being permitted to participate in the activity describe below, the parties agree as follows:
1. RELEASE OF LIABILITY
The Participant, being of lawful age, hereby releases and forever discharges the Activity Provider, along with its owners, employees, representatives, heirs, and assigns, from all actions, claims, damages, or demands relating to any loss, injury, or damage (including death) that may occur as a result of participating in the activity described below, and not withstanding that such damage, loss or injury may have been caused solely or partly by the negligence of the Activity Provider.
The Participant understands that signing this Agreement is required in order to participate.
2. ACTIVITY DETAILS
The Participant will take part in the following activity:
2 Day off-road Side-by-Side (SXS) and/or All-Terrain Vehicle (ATV) ride over varied terrain departing from The Milabena Equestrian Centre, 900 Myalla Road, Milabena, Tasmania, 7325 on Friday, 17th April 2026 and Saturday, 18th April 2026.
3. ACKNOWLEDGEMENT OF RISKS
The Participant hereby understands and acknowledges that this activity may involve rough tracks, obstacles, steep inclines, mud, water crossings, and unpredictable environmental conditions, and that participation involves inherent risks, including but not limited to:
• Rough, uneven, slippery, steep, or unstable terrain
• Sudden movements, bumps, rolls, or collisions
• Mechanical failures or accidents
• Weather-related hazards (rain, wind, heat, reduced visibility)
• Risks of physical injury such as bruises, fractures, sprains, cuts, burns, or worse
• Exposure to dust, noise, debris, and moving vehicles
• Risks associated with riding as a passenger or driver
The Participant acknowledges that these risks cannot be completely eliminated, even with safety measures in place, and that you voluntarily choose to participate.
4. HEALTH AND FITNESS
The Participant declares that they are:
• physically and mentally capable of participating in this activity.
• have no medical conditions that could be aggravated by this event.
• am not under the influence of drugs or alcohol.
• will notify organisers of any relevant medical conditions or concerns.
5. SAFETY OBLIGATIONS
The Participant agrees to:
• Always follow instructions given by event organisers, volunteers, and drivers.
• Wear all required safety equipment (helmet, seatbelt, protective gear).
• Remain seated and secured while the vehicle is in motion.
• Not behave recklessly, dangerously, or in a way that endangers others.
• Use my own SXS/ATV responsibly and ensure it is registered, safe and compliant.
The organisers reserve the right to refuse participation to any person for safety reasons.
6. RELEASE & WAIVER OF LIABILITY
To the fullest extent permitted by law, I release and hold harmless:
• Event organisers and volunteers
• Rocky Cape SXS/ATV Charity Ride Committee
• Landowners and property managers
• Partners, sponsors, and affiliated organisations
from all liability for injury, loss, damage, or death arising from my participation in this event.
7. INDEMNITY
I agree to indemnify the organisers against any claims, costs, damages, or liabilities that may arise as a result of:
• My actions or negligence
• Damage I cause to property, vehicles, or equipment
• Injury to another participant due to my behaviour
8. PERSONAL PROPERTY
I understand that any personal belongings, vehicles, or equipment I bring are my responsibility and are not covered by the organisers.
9. PHOTOGRAPHY & MEDIA CONSENT
I consent to the use of photos or video taken during the event for promotional, social media, advertising, or fundraising purposes, unless I provide written notice opting out.
10. MINORS (UNDER 18)
Participants under 18 must have this waiver signed by a parent or legal guardian. A parent/guardian must also be present during the event unless otherwise approved.
11. AGREEMENT
By signing this form, I confirm that:
• I have read and understand this waiver.
• I accept all risks related to participating in this event.
• I agree to comply with all safety instructions.
• I sign voluntarily and without pressure.
12. GOVERNING LAW
This Agreement is governed by the laws of the State of Tasmania.
