1. Applicants agree to pay the following fees (wherever applicable) to the Springvale Asian BusinessAssociation (SABA) for the 2026 Springvale Lunar New Year Festival (the festival):
$880.00 (inc. GST) for a Merchandise Stall
$1,210.00 (inc. GST) for a Food Stall. For sugar cane drinks stall ($1,320 Inc GST)
$2,200.00 (inc. GST) for a Corporate Promotional Stall
Applications close Monday 12 January, 2026 (or sooner if capacity is filled). Payment also must be made by this day. Any extra power or test and tagging on the day are additional and will need to be paid or by the Stallholder.

3. There will be no refunds if the festival is cancelled due to any reasons, including but not limited to weather, force of nature or unforeseen Government restrictions.
4. To observe all Greater Dandenong Council (‘the Council’), Melbourne Fire Service, Food Act 1984, FoodSafety program, Workplace Standards Licencing Commission requirements and other relevant
5. Commonwealth, State and Local regulations relating to the preparation and sale of food and beverages.
6. To not permit any person under the age of sixteen (16) years to be solely responsible for the conduct of any stall site. Do not allow any person under 15 years of age to be in the stall at any operational time.
7. To take out and keep current during the term of this agreement:
a) A Public Liability and Productions Liability insurance policy in a form approved by the Council, noting the Council as a Principal, insuring for a sum of not less than ten (10) million dollars the Council and the Stallholder against all actions, costs, claims, charges, expenses and damages whatsoever which may be brought or made or claimed against SABA, the Council or Stallholder, or both arising out of or in relation to this agreement. The policy must also confirm that the insurance cover includes across liability clause
extending the policy so that the words the insured shall be considered as applying to each party comprising the insured, as though a separate policy has been issued to each of the parties in the same manner as if that party were the only party name as the insured. Proof of this policy must be by way of a Certificate of Currency;
b) Such other policies the Council may reasonably require. It is highly recommended that this includes a policy to cover damage to the contents of the site including all fixtures and fittings against loss or damage by fire, storm and tempest, explosion, earthquake, riots, strikes, malicious damage, impact by vehicles including aircraft and other aerial devices, extraneous water including flood, burglary, and damage by burglary and accidental damage for their full reinstatement and replacement value.
8. To behave in a polite and professional manner to all participants, workers, event staff, volunteers and other stallholders involved in the festival.
9. To ensure that the stall observes all site trading times. Stalls MUST not commence operation until a checklist is complete and they are signed off to do so by the Site Manager. ALL trading must cease before the close of the festival. No meals or beverages are to be served thirty (30) minutes prior to closing.
10. To attend all meetings, safety briefings and environmental health presentations as required by SABA and the Council. A record of attendance will be taken and failure to attend may result in an application being rejected.
11. To respect SABA's security arrangements and comply with the measures put in place to ensure a safe and secure Festival for both the public, event staff, workers, volunteers and Stallholders.
12. To take all reasonable care, including respecting the rights of other Stallholders in the use of communal storage areas, including refrigerated space.
13. To not infringe on public space or another Stallholder’s space.
14. All food preparation (cooking and food handling activities) must be prepared inside the allocated stall.
15. A maximum of four people working within a 3m x 3m stall.
16. All gas bottles must be in a milk crate and placed outside of a marquee or tent. Large bottles require a secured frame and must also be outside of marquee. Barbecue’s must have appropriate backing and heat panels, and be positioned with ventilation. Please refer to Energy Safe Victoria www.esv.vic.gov.au and the Code of Practice for the Safe Use of Gas at Public Events in Victoria for full requirements.
17. To keep the interior and rear of the stall site clean, tidy and free of rubbish at all times, and as instructed by the SABA, Site / Safety Managers and/or Council. To comply with the “Waste Management Procedures and use of bins” as outlined in the information provided at the Stallholders Information Session.
18. To consent to the SABA, Festival’s Site/Safety Managers and/or Council taking photographs of the stall site. Stallholders and staff, and to authorise the SABA, Festival’s Site/Safety Managers and Council to public and use those photographs, in whole or in part, for advertising or marketing purposes for this and any subsequent events, and as part of SABA and/or Council’s current and future general marketing and communication activities.
19. SABA, the Council and the Festival’s safety management contractor hold the right to disclose and share stallholder information with one another (including past stallholder performance / history) at their discretion.
20. To comply with decisions made by management of the festival, including any decisions relation to the stall site.
21. To comply with all related sections of the Fair-Trading Act 1990 in the conduct of the stall site.
22. Promotional activity whether political, religious or activity that offends any nationality or government or community organisation, carried out at the stall or on the festival ground, including the display of flags will not be permitted unless written consent has been granted by SABA in advance. No refund will be rendered.
23. The Stallholder agrees to indemnify and keep indemnified and to hold harmless SABA and Council its servants and agents from and against all actions, costs, charges, expenses and damages whatsoever which may be brought or claimed against them, arising out of or in relation to this agreement, provided that this indemnity shall not apply where such actions, costs, charges, expenses and demands have arisen due to the negligence of SABA and Council its servants and agents.
24. To not alter the ‘goods that will be sold/promoted’, ‘promotional activities undertaken’ and ‘food and drinks that will be sold’ as described on this application without prior knowledge and approval from SABA. Please Note: The food types specified on the Application for Temporary Food Act Registration must not change without prior approval from Council’s Health Unit.
25. Once an application is approved, items as specified in the application cannot be changed. SABA reserves the right to reject applications or stop stalls from trading any items or engaging in any promotional activities not complying with the approved application, consumer protection guidelines, or being offensive to the public. This includes gambling activities, the selling of alcoholic drinks, items deemed to be dangerous and offensive.
26. Selling alcohol, offensive materials or illegal goods is strictly prohibited.
27. SABA and/or Council reserves the right to, after notice (30. Warning System) and opportunity to rectify, close any stall that does not comply with the terms and conditions of this agreement.
28. That SABA and Council may, at the organiser’s discretion and for any reason including, but not limited to, public safety, resolve to temporarily close part of, or the entire Festival site during the scheduled period of The Festival’s scheduled set up and operation. You hereby acknowledge the SABA and Council’s right to take this action and hereby agree that in the event that the SABA or Council does so then you will not seek to claim any compensation nor otherwise seek to impose any liability on the SABA or Council of any nature whatsoever.
29. That this document is the entire agreement between you, SABA, and Council and that this document supersedes any prior discussions between you, SABA and the Council. You acknowledge that in entering this agreement you have not relied on any representations made by SABA, Council or prior discussions with the Council or SABA.
30. To comply with the Warning System. This includes an initial verbal warning, if the issue is not resolved within the communicated time limit, then a written warning in the form of a yellow card will be presented to the ‘responsible’ stallholder. Once a yellow card is given an infringement notice may be issued.
If a stallholder fails to adhere to any conditions after receiving a yellow card, a second written warning in the form of a red card will be given. Once a red card is given to a stallholder they are required to shut down (infringement notices may also be issued) their stall and will only be permitted to re-open at SABA’s and Council’s discretion. Council’s Health Officers will inspect the festival stalls
Where there are serious non-compliance issues identified under the Food Act Council’s Health Officers may seize all foods and or close the stall outside of the warning system. Failure to comply with any of these terms and conditions will result in the Stall Application being rejected at any time from submitting the Application to the conclusion of the festival.
31. SABA holds the right to reject an application at its own discretion.
