FIND YOUR SPARK FITNESS WAIVER AND RELEASE

1. I agree to abide by the rules of Find Your Spark Pty Ltd.
2. I understand that when participating or allowing my child/dependent to participate in any exercise or exercise program, there is the possibility of physical injury. I agree that to do so at my own risk, and I am voluntarily participating in these activities, and assuming all risk of injury including without limitation, personal, bodily or mental injury and economic loss.
3. I consent to Find Your Spark Pty Ltd, its agents, employees, representatives and coaches, administering or arranging for appropriate medical treatment in circumstances where it is necessary and in the event of emergency, I authority Find Your Spark to exercise its judgment in the treatment by a medical authority.
4. I hereby waive and release, indemnify, hold harmless and forever discharge Find Your Spark Pty Ltd, and its agents, employees, officers, directors, affiliates, successors and assigns, coaches, teachers from any and all claims, demands, debts, contracts, expenses, cause of action, lawsuits, damages, and liabilities, of every kind of nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my participation in any of the events or activities conducted by, on the premises, of, or for the benefit of, Find Your Spark Pty Ltd, provided that this waive of liability does not apply to any acts of gross negligence, or intentional, wilful or wanton misconduct.
5. I acknowledge, agree and represent that I understand the nature of Find Your Spark Pty Ltd, I am in good health and in proper physical condition to participate in such activities. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the activity.
6. This waiver and release supersedes any prior written or oral agreements between the parties concerning the subject matter of this waiver and release. The provisions of this waiver and release may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties.
7. The laws of Queensland govern this document.
8. The provision of this waiver and release will continue in full force and effect even after the termination of the activities conducted by, on the premises of, or for the benefit of Find Your Spark Pty Ltd, whether by agreement, by operation of law, or otherwise.
9. Where applicable this waiver is signed on behalf of the child/dependent registered for our services.
10. I have read, understood and fully agree to the terms of this waiver and release as it applies to me and/or my child/dependent.
By competing this registration and attending to payment you hereby acknowledge and agree to the terms and conditions of this waiver.
