By registering for a workshop, purchasing a resource, or otherwise engaging with The Talented Dancer (online or in person), you agree to be bound by these Terms & Conditions.

1. Definitions
“The Talented Dancer”, “we”, “us” means Bayside Dance Pty Ltd trading as The Talented Dancer.
“Client” means the person responsible for registration and payment.
“Participant” means the person attending a workshop or using the Services.
“Services” means workshops, programs, digital resources, templates, courses, mentoring sessions and related offerings provided by The Talented Dancer.
“Event” means any workshop, seminar, course, program or in-person session.
“Website” means our official website and booking platform.

2. Registration and Participation
2.1 Registration
Registration is confirmed once payment (or deposit where applicable) has been received.
2.2 Changes to registration
Requests to transfer, cancel or change an Event booking must be submitted in writing.
2.3 Refusal or termination
The Talented Dancer may refuse or cancel participation on reasonable grounds including safety concerns, inappropriate behaviour, or non-payment.
2.4 Account responsibility
One Client must be nominated as the account holder responsible for communication and payment. Accounts cannot be split between households.

3. Fees and Payment
3.1 Fees
Fees for Events and resources are published on the Website and/or invoice.
3.2 Payment terms
Fees must be paid by the due date stated. Places in Events are not guaranteed until payment is received.
3.3 Deposits
Where a deposit is required, it secures a place in the Event and is applied toward the total fee.
3.4 Refunds and cancellations
Unless otherwise stated:
• Deposits are non-refundable.
• Event fees are non-refundable within 7 days of the Event date.
• No refunds are provided for non-attendance.
• Transfers may be offered at our discretion.
3.5 Consumer law
Nothing in these Terms limits your rights under the Australian Consumer Law.

4. Workshops, Courses and Events
4.1 Optional participation
Participation in Events is voluntary and may involve additional fees.
4.2 Event changes
We may vary Event format, venue, timing or delivery method where reasonably necessary and will notify participants of material changes.
4.3 Online delivery
Where in-person delivery is not possible, Events may be provided online as a reasonable alternative.

5. Digital Resources and Intellectual Property
5.1 Permitted use
Resources, templates and course materials are for personal use only by the Participant.
5.2 No distribution
Materials may not be copied, shared, distributed, uploaded, sold, or reproduced without written permission.
5.3 Studio use
Studios or teachers wishing to use materials for group teaching must obtain written permission.

6. Behaviour and Conduct
6.1 Expected conduct
Participants and Clients must behave respectfully toward staff and other attendees.
6.2 Removal from Event
We may remove a Participant from an Event for serious or repeated disruptive behaviour. No refund will be provided.
6.3 Complaints
Concerns should be raised promptly so they can be addressed appropriately.

7. Health, Safety and Medical
7.1 Medical disclosure
Clients must disclose relevant medical conditions that may affect participation.
7.2 Fitness to participate
Participants should not attend while unwell, injured or contagious.
7.3 Physical activity
Workshops may include light physical activity such as conditioning or movement exercises.
7.4 Physical contact
Participants acknowledge that reasonable physical contact may occur for teaching, correction, safety or first aid.
You may notify us in writing of any limitations.
7.5 Supervision
The Talented Dancer is not a childcare provider. Parents remain responsible for supervision outside scheduled session times.

8. Photography and Media
8.1 Promotional use
We may photograph or record Events for promotional purposes unless you opt out in writing prior to the Event.
8.2 Third-party use
External photography or recording requires prior approval.

9. Consumer Guarantees
Nothing in these Terms excludes or limits guarantees under the Australian Consumer Law.

10. Limitation of Liability
To the extent permitted by law, The Talented Dancer is not liable for indirect or consequential loss. Liability is limited to resupplying the Services or refunding fees paid.

11. Assumption of Risk
Participation in dance-related activities involves inherent risk. Participation is voluntary.

12. Force Majeure
We are not liable for failure to provide Services due to events beyond our reasonable control.

13. Privacy
Personal information is handled in accordance with our Privacy Policy.

14. Changes to Terms
Material changes to these Terms will be communicated in advance.

15. Governing Law
These Terms are governed by the laws of Queensland, Australia.
