WAIVER AND RELEASE
1. Acknowledgment of Risks
1.1 Risks
I acknowledge that Brazilian Jiu-Jitsu (BJJ) and other activities offered at the camp involve physical exertion and carry inherent risks, including but not limited to sprains, fractures, cuts, bruises, and concussion.
1.2 Voluntary participation
I understand and accept that my child’s participation in the camp activities is entirely voluntary and at their own risk.
2. Waiver of liability and release
(a) In consideration of my child being permitted to participate in the camp, I, on behalf of myself, my child, and our heirs, executors, and administrators, release, Australian Jiu Jitsu Futures Program Pty Ltd (AJJFP), its owners, directors, instructors, employees, agents, contractors, and volunteers (collectively, "Released Parties") from any and all claims, actions, demands, liabilities, or causes of action arising from or related to any injury, illness, disability, death, or property damage sustained by my child while participating in camp activities, whether arising from the inherent risks of BJJ or other activities or from the ordinary negligence of the Released Parties.
(b) I acknowledge and agree that this release:
(i) applies to all claims, known or unknown, foreseen or unforeseen, arising from my child’s participation in the camp, except for claims arising from gross negligence, reckless conduct, or intentional misconduct by the Released Parties; and
(ii) forms part of the agreement between myself and AJJFP, whereby AJJFP agrees to permit my child’s participation in camp activities, including all supervised and organised activities, in exchange for this assumption of risk and release of liability.
3. Indemnity
(a) I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, actions, demands, liabilities, costs, or expenses (including legal fees and court costs on an indemnity basis) arising from or related to:
(i) my child’s participation in the camp activities, including injuries or damages caused to others;
(ii) any breach of this waiver or failure to comply with the camp’s rules or instructions by my child or myself; and
(iii) any claims made by third parties against the Released Parties as a result of my child’s actions during the camp.
(b) This indemnity applies regardless of whether the injury, loss, or damage is caused in part by the negligence of the Released Parties, provided that it does not apply to gross negligence, reckless conduct, or intentional misconduct by the Released Parties.
(c) I agree that if the Released Parties are required to incur legal fees or other costs to enforce this indemnity, I will reimburse them for such fees and costs.
4. Authority
(a) I represent and warrant that I am the legal parent or guardian of the child named below and have full legal authority to enter into this waiver on their behalf.
(b) I further represent and warrant that I have the authority to act on behalf of any other parent or guardian of the child to agree to the terms of this waiver, release, and indemnity.
(c) I agree to indemnify the Released Parties against any claims or liabilities arising from any dispute regarding my authority to sign this waiver.
5. Emergency medical consent
(a) In the event of an emergency, I consent to AJJFP arranging for medical treatment for my child if I cannot be contacted promptly.
(b) I understand that any medical costs incurred will be my responsibility.
(c) I acknowledge that the camp carries public liability insurance, but this may not cover all medical costs associated with injuries sustained during camp activities.
6. Camp rules
(a) I acknowledge that my child must adhere to the camp’s rules, including but not limited to:
(b) respecting instructors, peers, and property;
(c) following hygiene protocols (e.g., trimming nails, covering wounds, removing jewellery); and
(d) wearing appropriate attire.
(e) I understand that failure to follow the rules may result in my child’s exclusion from the camp without a refund.
7. Photo and media consent
(a) I grant permission for AJJFP to use photographs or videos of my child participating in camp activities for promotional or educational purposes, including on social media or the camp website.
(b) I understand I may withdraw this consent at any time by providing written notice to the camp administration. Contact details for this purpose will be provided upon request.
8. General
8.1 Further assurances
Each party must promptly execute all documents and do all things necessary or desirable to give full effect to the arrangements contained in this agreement.
8.2 Governing law and jurisdiction
(a) This agreement is governed by the laws of Victoria.
(b) Each party irrevocably submits to the non-exclusive jurisdiction of the courts of Victoria.
8.3 Severance
If any clause is in any way unenforceable, invalid or illegal, it is to be read down so as to be enforceable, valid and legal. If this is not possible, the clause (or where possible, the offending part) is to be severed from this agreement without affecting the enforceability, validity or legality of the remaining clauses which will continue in full force and effect.
