Fees Policy
1. Term fees must be paid in full in the first 2 weeks of term for all new and existing members. Failure to do so will result in additional account keeping fees and your child will not be able to attend gymnastics until all outstanding fees are paid. Valley Gymnastics encourages all parents to pay term fees in full before the term commences.
2. Once your child is enrolled for the term, their term fees are not refundable.
3. In the event that term fees are not paid, and the debt is handed over to an external debt collection agency, all costs incurred by Valley Gymnastics in doing so will be passed on in the form of additional fees.
4. Gymnast re-enrolling must pay for a full term i.e. if it is a ten-week term, they must pay for 10 weeks even if they will be away the first, or last week for example. Gymnasts are entitled to make-ups for the missed week once fees are paid in full.
5. Once a gymnast attends the first lesson of a term, (excluding trial lessons for new members) they have enrolled for the full term and acknowledge that full term fees are therefore due. Even if gymnasts have not paid and quit gymnastics in week 2, they will still be liable for a full term’s fees. If not paid, the debt will be handed over to an external debt collection agency, and the costs incurred by Valley Gymnastics in doing this will be passed on in the form of additional fees. In addition, registration transfer to any other gymnastics club in Australia will be refused until all fees are paid in full.
6. In the event you are unable to pay for term fees in the first 2 weeks, you must see administration and you may be eligible for a payment plan. (Only available to gymnasts who train 2 days per week or more.) Payment plan applications are available from admin. To be eligible, you must apply before term starts – not in week 2 when you are unable to pay full term fees)
7. Gymnasts who still have term fees outstanding from the previous term will not be permitted to re-enrol, and will lose their position in the class.
8. If using an active or creative kids voucher to pay for fees, voucher must be email to valleygymfun@gmail.com within the first 2 weeks of term.
MAKEUP LESSONS
1. Makeup lessons are available only to those gymnasts whose term fees are paid for in full. Parents/gymnasts must contact Valley Gymnastics prior to classes missed if they are unable to attend gym in order to qualify for a makeup lesson. Makeup lessons may be refused depending on gymnast numbers on a particular day.
• Makeup lessons are used to cover absences of 2 weeks or less (refunds or credit are used for absences greater than 2 weeks as the result of injury or illness only) Medical certificates are not required unless the absence has been the result of an injury in which case a clearance certificate is required by a doctor (this ensures the gymnast is fit to train again)
• Makeup lessons can be used for any class within the club to the same value.
• Makeup lessons can only be used within the current term and are not transferable to next term or holiday training or programs.
REFUNDS/CREDIT
• Credit or refunds are not given for unexplained absences or if gymnasts decide they no longer want to do gymnastics. If full term fees are not paid at the time of quitting, parents will still be charged for full term fees.
• Credit or refunds are not given as a result of gymnasts attending club events or competitions when their usual classes are on. Coaches are present at these events and as such are considered part of their regular gymnastics activities.
ASSUMPTION OF RISK
1. Pursuant to section 5M of the Civil Liability Act 2002 (NSW) (“CLA”) ValleyGymnastics warn me and I acknowledge that I have been warned that My/ My child’s use of the Valley Gymnastics Gym and participation in Valley Gymnastics Activities is a “recreational activity” as defined in section 5K of the CLA. These are also “dangerous recreational activities” as defined in that section, because the use of the Valley Gymnastics Gym and participation in Valley Gymnastics Activities each involve significant risks of physical harm. I acknowledge that there are inherent risks of injury when participating in any physical exercise and training, sport, wellness or recreational activity. These risks include but are not limited to: muscle and ligament sprains and damage, spinal injury including damage to discs and vertebrae, broken or fractured bones, heart conditions including heart attack, stroke, loss of consciousness, head injury, joint damage, injuries to hands, feet, fingers and toes, heat stroke, dehydration and other complications. If I/ My child sustain such injury I/ My child may also suffer loss and damage including financial loss. There is also a risk of death, or that any injury I/ My child suffer from may be permanent. Such injury, loss, damage or death may occur while I/ My child am engaging in physical exercise and/or using Valley Gymnastics’s equipment as part of participation in Valley Gymnastics Activities, including group activities or classes. This can occur as a result of any action by Me/ My child including, but not limited to, walking, jumping, running, skipping, hopping, lifting, gymnastics, rope climbs, strenuous bodyweight exercises and other high exertion activities, rowing, operating equipment, using weights, rings, resistance bands and other exercise equipment, sit ups, push ups and any other weight bearing exercises, bending, squatting, lunging, slipping and falling. I/ My child may also suffer such injury loss or damage or death as a result of my partner or another person’s use of the Valley Gymnastics Gym or participation in Valley Gymnastics Activities, for example where another person may drop or strike me with a piece of gym equipment such as weights, or where such a person may push pull or hit me/ my child, or by interfering with My person/ My child’s person or My/ My child’s use of the Valley Gymnastics Gym in some other way. Lastly, I/ My child may also suffer loss because of My/My child’s personal property on the premises being stolen, lost, damaged or destroyed.
2. I warrant that My/ My child’s use of the Valley Gymnastics gym and participation in the Valley Gymnastics Activities is in all respects voluntary. I acknowledge the risks set out in clause 2.1 above and assume all those risks.
3. I warrant that I/ My child am physically and medically fit and I am not aware of any medical or physical condition that would prevent Me/ My child from participating in the Valley Gymnastics Activities or from using equipment or facilities, which pose a serious health risk to Me/ My child.
4. I acknowledge that Valley Gymnastics and its officers, agents and employees and related entities (collectively ‘the Valley Gymnastics Released Entities’) will not be held responsible by Me for any injury, damage or loss suffered by Me/ My child by reason of any omission or negligence of any Valley Gymnastics Released Party or any third party, or by any other reason whatsoever at the Valley Gymnastics Gym or any location in which Valley Gymnastics Activities are held.
5. I, as a parent and/or guardian of a minor hereby agree to be fully responsible for any and all actions, damages, injuries, or loss to property or person, performed by the minor with or without My supervision in the Valley Gymnastics Activities or use of Valley Gymnastics Gym, in consideration of Valley Gymnastics allowing the minor to use Valley Gymnastics Gym and participate in the Valley Gymnastics Activities.
MEDICAL INFORMATION
1. Parents are responsible for ensuring that all relevant medical details and contact information is kept up to date in our database.
If your child has a serious allergy or medical condition requiring medication to be present whilst participating at Valley please notify coaches upon arrival.
2. If urgent medical and/or other attention is required and neither parents nor emergency contact can be reached, I give consent for my child to be treated by a medical practitioner as arranged by Valley Gymnastics.
3. Valley Gymnastics will call an ambulance for all major injuries. All fees and charges associated with seeking medical attention on behalf of your child are the responsibility of the parent / guardian of the child concerned.
RELEASE OF LIABILITY
1. I, release and discharge Valley Gymnastics Released Parties, from all liability, claims, demands, costs and causes of action of any kind (including any negligence) relating to my/ my child’s death or personal injury, or loss, theft or damage to my personal property that I have now or may in the future have against the Valley Gymnastics Released Parties arising from, or in any way connected with, My/My child’s participation in Valley Gymnastics Activities and use of Valley Gymnastics Gym, facilities, premises or equipment. This release does not apply to significant personal injury or death caused by Valley Gymnastics Released Parties ‘reckless conduct’ as defined in the Competition and Consumer Act 2010 (Cth).
2. I indemnify the Valley Gymnastics Released Parties against all liability, claims, demands, costs and causes of action of any kind (including in negligence) relating to my personal injury or death, or loss, theft or damage to my personal property that I have now or may in the future have against the Valley Gymnastics Released Parties arising from, or in any way connected with, My/My child’s participation in Valley Gymnastics Activities and use of facilities, premises or equipment (including costs and solicitor fees and disbursements), made by Me or on the part of Me or any person or entity claiming under or by virtue of Me.
PHOTOGRAPY CONSENT
I grant permission for Valley Gymnastics to take photographs or videos of my child during class for promotional and marketing purposes. I understand that no personal identifying information will be shared unless explicitly agreed upon.
