Participant Declaration– Black Rock Yacht Club 2026 Winter Solstice Swim- Terms and Conditions

Introduction

This declaration must be agreed to by each swimmer before completing their entry in the Black Rock Yacht Club 2026 Winter Solstice Swim (the Swim).

References to “the BRYC” are references to the Black Rock Yacht Club, its officers, and its volunteers including swim sherpas and kayakers.

This declaration confirms you understand that swimming in the night in cold water is inherently dangerous, you are responsible for this risk and you release and indemnify the BRYC from all responsibility for any loss suffered in connection with the Swim.

If you do not agree with this you should not proceed with your registration and you should not participate in the Swim.

Particular points of agreement

1. The Swim is a cold open water night swim and is inherently dangerous with a risk of injury and, in an extreme case, death.
2. You should not swim unless you:
a. are a competent open water swimmer and can swim in cold water at night in possibly rough conditions
b. can complete the selected distance comfortably without assistance from volunteers
c. can recognise the symptoms of hypothermia and can self-treat for this condition including exiting the water and accessing heat and warm clothes.
3. You are solely responsible for your own health and safety before, during and after the Swim.
4. You indemnify and release the BRYC from all liability for any action or omission, before during and after the Swim.
5. You must disclose in writing any pre-existing medical condition, mental health condition or other condition including food allergies and drug allergies that may affect your swim at the time you enter the Swim.
6. You agree the BRYC may administer such medical assistance as they consider appropriate if you are not able to make such a decision yourself.
7. You agree the BRYC may cancel the Swim at any time due to poor weather or other reason and no refunds will be paid.
8. You agree the BRYC can use photographs and videos from the Swim for marketing purposes unless you have previously instructed them to not do so in writing.
9. You agree to observe all BRYC instructions during the Swim.
