Retreat Participant Agreement
Terms of agreement
By booking and attending a retreat with Malibu Mind, you are agreeing to comply with and be bound by the following terms and conditions.
1 - CHANGES OR CANCELLATION
(1) Changes. Company reserves the right to make changes to any aspects of the Retreat/Experience due to conditions beyond its control.
(2) Cancellations and Rescheduling.
a) By Company. Company may reschedule the Retreat or Experience for reasons including natural disasters or unforeseen circumstances. In such cases, your payment may be transferred to another Retreat or Experience within 24 months.
b) By You. All cancellations must be submitted in writing. If cancellation falls within 14 days of the retreat date there will be NO REFUND. If cancellation occurs earlier than 14 days prior to retreat date but not more than 21 days you will be entitled to a 50% refund. Any cancellation earlier than 21 days prior to the retreat date will see entitlement of the full refunded amount.
c) Effect of Changes or Cancellation. In the event of any change or cancellation, you acknowledge that no refunds (except as outlined) or compensation will be provided.
2 - PHOTOS, VIDEO, OTHER MEDIA RELEASE
By and in consideration for being permitted to participate in the Retreat/Experience, you irrevocably grant Malibu Mind and its agents and representatives all rights to use, reproduce, display, exhibit, publish, distribute, and/or produce derivative works based on your image, likeness, and voice as recorded by any camera and/or on any video, audio, and/or other media (collectively, “Likeness”) worldwide, in perpetuity, without compensation, payment, or other additional consideration of any kind, for any lawful purpose, including without limitation for marketing and trade purposes. You agree that your Likeness may be used, reproduced, displayed, exhibited, published, edited, or distributed by Malibu Mind at its sole discretion. You understand that your Likeness may be used in various publications, promotional or marketing materials, and/or social media, unrestricted by time or geographic area and consent to such uses. You further understand and grant permission to Malibu Mind and its agents and representatives to electronically display any Likeness of you on the Internet or in other public settings. You hereby waive the right to inspect or approve any and all materials in which your Likeness may appear. You further waive any right to royalties or other compensation arising or related to the use of your Likeness. This release applies to all photographic, audio, and/or video recordings collected as part of, in connection with, and/or during the Retreat/Experience (by Malibu Mind or any third party). There is no time limit on the validity of this release nor is there any geographic limitation on where materials including your Likeness may be used, reproduced, displayed, exhibited, published, and/or distributed by or on behalf of Malibu Mind.
3 - VOLUNTARY PARTICIPATION IN ACTIVITIES
You acknowledge that you are voluntarily participating in the Retreat/Experience with Malibu Mind, which may include strenuous physical activity including without limitation walking, retreat classes such as Qigong and various other exercises, physical activity (“Physical Activity”) and breathwork. You acknowledge that you are fully aware of the risks and hazards connected with participation in the Retreat/Experience and/or engaging in Physical Activity and/or breathwork which may include the risk of serious injury (e.g. muscle strains, pulls, tears, heart dysfunction, cardiovascular failure) or death, and you hereby elect to voluntarily participate in such Physical Activities and breathwork, or choose to remove yourself from that particular element of the experience, particularly in the case of previous heart/breathing conditions or previous and/or existing injuries.
4 - HEALTH AND FITNESS ELIGIBILITY
You represent that you are at a level appropriate to participate in, and are fully capable of participating in the elements of the Retreat/Experience that you plan to. You further represent that you do not suffer from any medical conditions or disabilities that may restrict, limit, prevent, or preclude your participation in such elements of the retreat, including any Physical Activities and breathwork. You have consulted with your physician and your physician has authorised you to participate in the Retreat, including any Physical Activities and breathwork if so required. You will discuss and address any questions or concerns you may have about your physical or mental health with the appropriate health care professional prior to the retreat date if so required.

All issues relating to the sale of tickets and the hosting of their associated event(s) are the responsibility of the “Event Organiser” and not that of TryBooking Pty Ltd (Australian Business Number 71126987915).
