Waiver and Release
Important:
Please read this Waiver carefully before submitting this form. By selecting “I Agree”, you confirm that you understand and accept the terms below.
You understand and agree that you are providing this waiver and release on your own behalf (‘I’, ‘Me’ or ‘My’) and if applicable on behalf of any minor/s of whom you are a parent/guardian (Child).
1. Risk Warning
Recreational and venue-based activities, including light physical activity, involve a risk of physical harm or personal injury.
Injuries may occur as a result of My own actions, the actions of others, the Child’s actions or from being present within operational club facilities.
The Club Tour is organised by West Coast Eagles Football Club, a division of Indian Pacific Limited (ABN 31 009 178 894) (“West Coast Eagles”).
2. Acknowledgement of Risk
By participating in a West Coast Eagles Club Tour (“Tour”), I acknowledge and agree that:
• this is a legal document that affects My rights (or the rights of the Child if under 18);
• the Tour involves visiting operational club facilities and may include limited, informal activity (such as kicking a football);
• such activities involve inherent, unforeseen and unavoidable risks of injury, damage or loss;
• the above risk warning constitutes a risk warning under the Civil Liability Act 2002 (WA);
• I willingly assume the risk of participating in the Tour. I warrant that I have provided the West Coast Eagles with all relevant and necessary information that relates to My and/or the Childs physical health and capacity to participate in any activity. I understand that if I do not provide the West Coast Eagles with all relevant and necessary information about My health and capacity (or the health and capacity of the Child) the West Coast Eagles would not be able to fully appreciate the risk of harm or injury to me in providing instruction and in allowing participation in this activity;
• to the maximum extent permitted by law, West Coast Eagles is not liable for any loss, injury or damage arising from participation in the Tour, except where liability cannot be excluded by law.
3. Participant Conduct and Behaviour
I agree that I, and if applicable the Child, must:
• not take any photos or videos in non-public areas without the express consent of the West Coast Eagles;
• comply at all times with all reasonable instructions given by West Coast Eagles staff, contractors or agents;
• remain within designated areas and follow all safety, behavioural and venue rules as directed;
• not approach, obstruct, touch or attempt to engage with any player, coach or club official, unless expressly invited or directed by West Coast Eagles staff;
I understand that any failure to comply with the above requirements may result in immediate removal from the Tour at the absolute discretion of the West Coast Eagles.
4. Damage to Property
I acknowledge and agree that:
• I am responsible for any damage to the facilities, property or equipment caused by Me, or the Child, whether intentionally or unintentionally; and
• I will pay in full the cost of repair or replacement as assessed by the West Coast Eagles.
5. Release, Waiver and Indemnity
To the maximum extent permitted by law, I:
• waive, release and discharge West Coast Eagles and its directors, officers, employees, contractors and agents (“Released Persons”) from any claim, liability or demand arising from My, or the Child’s attendance at or participation in the Tour; and
• indemnify the Released Persons against any claim or loss arising from My, or the Child’s acts or omissions during the Tour.
6. Photography, Filming and Image Use
I acknowledge and agree that:
• the Tour may be photographed, filmed or recorded;
• I consent to My, and if applicable the Child’s, image, likeness, voice and biographical material being used by West Coast Eagles in any media, including websites, social media and promotional materials, without compensation;
• if images are published online, West Coast Eagles has no control over subsequent use or distribution;
• all intellectual property created or captured in connection with the Tour remains the sole property of West Coast Eagles.
7. Parent / Guardian Consent (Participants under 18)
If the Child is under 18 years of age, I confirm that:
• I am the Child’s parent or legal guardian;
• I consent to the Child participating in the Tour under these terms; and
• I accept responsibility for ensuring the Child complies with all conditions and directions.
8. Declaration and Acceptance
By selecting “I Agree” and submitting this form, I confirm that:
• I have read and understood this Waiver and Release;
• I voluntarily accept all terms and conditions outlined above;
• I am authorised to provide consent on behalf of the Child(if under 18).
