SCHOOL RULES & CONDITIONS OF PARTICIPATION
1. ACCEPTANCE OF TERMS & CONDITIONS
By enrolling a Student, purchasing tickets, submitting this form, selecting the acceptance checkbox, or permitting a Student to participate in classes, rehearsals, performances, showcases, events, or any related activities conducted by KLD Performing Arts PTY LTD, the Parent/Guardian acknowledges and agrees that they have read, understood, and accepted these Terms and Conditions.
These Terms and Conditions apply to all Students participating in KLD Performing Arts PTY LTD activities, including but not limited to weekly classes, rehearsals, performances, showcases, workshops, and events.
This agreement must be accepted by a parent or legal guardian of the Student. Students aged 18 years or older may accept these Terms and Conditions on their own behalf.
If you do not agree to these Terms and Conditions, the Student will not be permitted to participate in KLD Performing Arts PTY LTD activities.
2. FEES, PAYMENTS & FINANCIAL RESPONSIBILITY
The Parent/Guardian acknowledges and agrees that:
They are responsible for payment of all fees associated with the Student’s participation, including but not limited to tuition fees, performance fees, costume fees, ticket costs, and any other applicable charges.
All fees are payable by the due dates specified by KLD Performing Arts PTY LTD.
Fees may not be refunded, transferred, or credited unless otherwise approved by KLD Performing Arts PTY LTD.
Once costumes, tickets, resources, or other items have been ordered or purchased, the Parent/Guardian remains responsible for payment regardless of attendance, withdrawal, illness, or inability to participate.
Any costumes, accessories, props, or equipment provided by KLD Performing Arts PTY LTD remain the responsibility of the Student and Parent/Guardian while in their possession.
Any lost, damaged, stained, or incorrectly altered items will be charged at the full replacement cost.
By accepting these Terms and Conditions, the Parent/Guardian confirms responsibility for all fees and acknowledges receipt of the “School Rules and Conditions.”
3. PERFORMANCE TICKETS
For Annual Performance Showcases and ticketed events:
All audience members must purchase a valid ticket prior to entry.
One ticket is required per person attending, regardless of age.
Performing Students do not require tickets as they remain backstage under supervision.
Tickets are limited and allocated on a first come, first served basis.
KLD Performing Arts PTY LTD cannot guarantee ticket availability once capacity has been reached.
4. AUDIENCE, BACKSTAGE & EVENT ACCESS
To ensure safety, supervision, and the smooth operation of performances:
Audience members are not permitted to photograph, film, record, or livestream performances, classes, rehearsals, or events unless expressly authorised by KLD Performing Arts PTY LTD.
Parents, Guardians, family members, and friends are not permitted backstage, in change rooms, or restricted performance areas unless they have been approved as an authorised volunteer.
Before dropping off a Student, the Parent/Guardian must ensure the Student has all required food, water, medication, clothing, and personal items needed for the duration of the event.
Once checked into backstage supervision, Students will remain backstage until the conclusion of the performance unless otherwise approved by [KLD Performing Arts PTY LTD.
5. COSTUMES & PERFORMANCE ATTIRE
The Parent/Guardian acknowledges and agrees that:
Students participating in performances must wear the approved costume and required attire selected by KLD Performing Arts PTY LTD.
Costume selections, styles, colours, and sizing are determined by KLD Performing Arts PTY LTD based on performance requirements and class requirements.
Costume sizing may vary between manufacturers and may not fit exactly as expected.
Some costumes may be provided as “Free Size” and may require adjustments or alterations.
Any alterations, modifications, or adjustments required are the responsibility of the Parent/Guardian.
Students may not be permitted to perform if costume requirements are not met.
6. MUSIC, CHOREOGRAPHY & PERFORMANCE CONTENT
The Parent/Guardian provides permission for the Student to perform choreography to music selected, edited, and approved by KLD Performing Arts PTY LTD.
KLD Performing Arts PTY LTD reserves the right to determine:
Music selections;
Choreography;
Staging;
Performance order; and
Other artistic or production requirements.
7. PERFORMANCE PARTICIPATION & REHEARSALS
The Parent/Guardian acknowledges that:
Attendance at classes and rehearsals is important for the Student’s preparation and ability to participate in performances.
KLD Performing Arts PTY LTD may limit, modify, or withdraw a Student’s participation in a performance where attendance, preparation, behaviour, safety, or other requirements have not been met.
Performance placement, roles, routines, and choreography are determined by [KLD Performing Arts PTY LTD and are not guaranteed.
8. BACKSTAGE SUPERVISION & STUDENT COLLECTION
For health, safety, and duty of care purposes:
Performers must remain backstage for the duration of the showcase unless otherwise approved by KLD Performing Arts PTY LTD.
Students must remain under the supervision of authorised staff until formally released.
If a Student needs to leave before the conclusion of a performance, written notice must be provided at least 48 hours prior to the event.
Students will not be released from backstage/change rooms until their Parent/Guardian or authorised collector has arrived at the designated collection area.
Students will only be released to authorised persons.
9. MEDICAL INFORMATION & EMERGENCY AUTHORISATION
The Parent/Guardian agrees to:
Provide accurate and current medical information, emergency contacts, allergies, injuries, and relevant health information.
Notify KLD Performing Arts PTY LTD of any changes to medical or emergency information.
Ensure the Student arrives with any required medication, medical equipment, food, water, or personal items.
In the event of an emergency, the Parent/Guardian authorises KLD Performing Arts PTY LTD and its authorised representatives to seek appropriate medical assistance where reasonably required.
10. BEHAVIOUR & CONDUCT EXPECTATIONS
Students and families are expected to behave respectfully towards:
Teachers;
Staff;
Volunteers;
Other Students;
Families;
Venues; and
Members of the public.
KLD Performing Arts PTY LTD reserves the right to take appropriate action, including restricting participation or removing a Student from activities, where behaviour is unsafe, inappropriate, disruptive, disrespectful, or inconsistent with the expectations of the School.
11. DROP-OFF, PICK-UP & SUPERVISION
Unless otherwise advised:
Supervision begins when the Student is received by authorised staff.
Supervision ends when the Student is collected by an authorised Parent/Guardian or nominated person.
Parents/Guardians remain responsible for timely drop-off and collection.
[KLD Performing Arts PTY LTD may implement additional procedures or fees for late collection where applicable.
12. PERSONAL BELONGINGS & LOST PROPERTY
KLD Performing Arts PTY LTD accepts no responsibility for lost, stolen, or damaged personal belongings brought to classes, rehearsals, performances, or events.
Parents/Guardians are encouraged to clearly label all personal items.
13. PHOTOGRAPHY, VIDEO & MEDIA CONSENT
The Parent/Guardian provides permission for KLD Performing Arts PTY LTD and its authorised representatives to photograph, record, and capture video footage of the Student during:
Classes;
Rehearsals;
Backstage activities;
Performances;
Showcases; and
School-related events.
The Parent/Guardian irrevocably authorises and agrees to the Photograph Release contained within the applicable enrolment form.
Images and footage may be used for promotional, educational, archival, website, social media, advertising, and marketing purposes.
14. PRIVACY & COMMUNICATION
The Parent/Guardian acknowledges that personal information collected by KLD Performing Arts PTY LTD may be used for:
Enrolment administration;
Student safety;
Emergency management;
Event organisation;
Communication; and
Delivery of services.
The Parent/Guardian agrees to keep contact details current and consents to receiving communications relating to classes, events, performances, fees, and important updates.
15. CHANGES, CANCELLATIONS & EVENTS OUTSIDE CONTROL
KLD Performing Arts PTY LTD reserves the right to make reasonable changes to:
Class schedules;
Teachers;
Venues;
Performance arrangements;
Music;
Choreography;
Costumes; and
Event details.
The School will not be responsible for delays, cancellations, interruptions, or changes caused by circumstances outside its reasonable control, including emergencies, venue issues, illness, weather events, government requirements, or other unforeseen circumstances.
16. LIABILITY, RISK & INDEMNITY
The Parent/Guardian acknowledges and accepts that participation in dance and related activities involves inherent risks.
The Parent/Guardian accepts responsibility for:
Any injury sustained by the Student as a consequence of participating in and/or attending KLD Performing Arts PTY LTD and any related activity or function involving KLD Performing Arts PTY LTD, including the Mini Mid-Year Showcase, Annual Performance Showcase, classes, rehearsals, and events.
Any damage of any kind (including to any person or property) directly or indirectly caused by the Student’s act or omission, including negligently.
The Parent/Guardian agrees to indemnify and hold harmless KLD Performing Arts PTY LTD, its Principal, employees, contractors, representatives, and volunteers against claims, losses, damages, liabilities, costs, or expenses arising from the Student’s participation, conduct, acts, omissions, or breach of these Terms and Conditions, except where prohibited by law.
17. LIMITATION OF LIABILITY
To the maximum extent permitted by law, the aggregate liability of the Principal to the Parent/Guardian and/or Student under or in connection with this agreement, or the provision of relevant goods and/or services by KLD Performing Arts PTY LTD, whether arising in contract, tort (including negligence), statute, or any other cause of action, is limited to an amount equal to the fees payable by the Parent/Guardian to [KLD Performing Arts PTY LTD during the term in which the alleged liability arises.
Nothing in these Terms and Conditions excludes, restricts, or modifies any rights or remedies that cannot legally be excluded.
18. SET-OFF RIGHTS
The Principal may set off any amounts claimed to be owing by the Parent/Guardian under any indemnity or obligation contained within these Terms and Conditions against any amounts otherwise payable by the Principal.
19. FINAL ACCEPTANCE
By selecting the checkbox on trybooking.com, you confirm that:
☐ You have read, understood, and agree to the School Rules and Conditions, Event Terms and Conditions, and Customer Terms and Conditions.
☐ You accept responsibility for payment of all fees and charges associated with the Student’s participation.
☐ You confirm that you authorise to provide consent for the Student.
☐ You acknowledge that this electronic acceptance is legally binding and agree to be bound by these Terms and Conditions.
You confirm your acceptance of these Terms and Conditions electronically.
