# Cane Fire Experience Tour – Terms & Conditions and Participant Acknowledgement
By purchasing a ticket and participating in the Cane Fire Experience Tour, you acknowledge that you have read, understood and agree to the following Terms & Conditions.
# 1. Booking
* Your ticket secures a place on the registration list and does not guarantee a specific tour date.
* Tour dates are allocated in booking order as they become available.
* If you are unavailable for an offered date, you will remain on the registration list and be offered the next available tour.
# 2. Weather and Operational Conditions
* Tours are subject to suitable weather, harvest schedules, operational requirements and safety considerations.
* Cane fires may be postponed or cancelled due to weather conditions, fire restrictions, wind direction, harvest changes or any circumstance considered unsafe by the organisers.
* If a tour is cancelled by the organisers, participants may choose to transfer to another available tour or receive a full refund.
# 3. Risks of the Activity.
The tour is a recreational activity within the meaning of section 5K of the Civil Liability Act 2002 (NSW). I acknowledge that the tour involves a significant risk of physical harm and is therefore a dangerous recreational activity under that Act. The operator takes all reasonable precautions to manage those risks, including conducting viewing from designated safe distances, providing safety briefings before each tour, and maintaining appropriate supervision throughout. The operator relies on section 5L of the Civil Liability Act 2002 (NSW) in respect of any harm arising from the materialisation of an obvious risk of the activity. I acknowledge that the following are obvious risks of the activity within the meaning of section 5F of that Act:
• smoke, ash, embers and heat from controlled burns
• unpredictable wind changes affecting smoke and ember movement
• uneven terrain, slippery grass and farm tracks
• proximity to large agricultural machinery
• dust, pollen and agricultural chemicals in the surrounding environment
• extreme heat and sun exposure
• insects and native wildlife
• limited access to medical facilities in rural areas
# 4. Participant Responsibilities
I agree to:
• follow all safety directions given by the operator and tour guides
• remain within designated viewing areas at all times
• not approach or interfere with machinery, equipment or burning material
• wear appropriate clothing and footwear for outdoor agricultural environments
• immediately advise the guide of any injury or unsafe condition
• not participate while under the influence of alcohol or drugs
# 5. Health
Participants are responsible for determining whether this experience is suitable for their own health and physical condition.
Anyone with respiratory conditions, severe allergies or other medical concerns should carefully consider the potential effects of smoke and outdoor conditions before participating.
# 6. Alcohol
1x alcoholic beverage will only be served to participants aged 18 years or over. Valid identification may be requested. Non-alcoholic alternatives are available.
# 7. Photography
Photographs and video may be taken during the event and used by Clarence Harvest Celebration for promotional and marketing purposes unless participants advise otherwise prior to the tour.
#8. RELEASE
In consideration of being permitted to participate in the tour, and to the maximum extent permitted by law, I release the operator, its directors, officers, employees, contractors and guides from all claims arising from personal injury, death or property loss suffered by me during the tour, whether caused by the negligence of the operator or otherwise, except to the extent caused by the operator's gross negligence or wilful misconduct.
#9. INDEMNITY
I agree to indemnify the operator against all claims, costs and expenses arising from my failure to follow safety directions, my negligence, or any act or omission by me that causes loss or injury to another person during the tour.
#10. CONSUMER GUARANTEES
Nothing in this agreement excludes any right or guarantee under the Australian Consumer Law that cannot lawfully be excluded. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.
#11. DECLARATION
I declare that I have read and understood this agreement, that I am 18 years of age or older (or a parent or guardian has signed below on my behalf), that I am agreeing freely and voluntarily, and that I am physically fit and capable of participating in the tour.
Please note: A waiver will be presented to read and sign on arrival at the tour.
