0. Acceptance of Terms
By ticking the checkbox at booking and/or completing payment, the client confirms they have read, understood and
agree to be bound by these Terms and Conditions in full. If the client does not agree, they must not proceed with the
booking.
1. Payment
The client must pay the full amount owing within the first hour of the event unless otherwise agreed to in writing prior to
the event.
If payment has not been received as agreed, Jitterbug Discos reserves the right to pause services until payment has been
made in full.
2. Cancellation and Rescheduling
Cancellations by the client:
• Cancellations made more than 14 days before the event: deposit/booking fee [is / is not] refundable — [insert
your policy].
• Cancellations made within 14 days of the event: full booking fee remains payable.
Cancellations by Jitterbug Discos:
• If Jitterbug Discos is unable to fulfil a booking due to illness, injury or circumstances beyond reasonable
control, the client will be offered a full refund or an alternative date where possible.
3. Damages
The client agrees to be responsible for any damage, loss, or costs associated with repairs to Jitterbug Discos equipment
caused by the client or any of the client's guests before, during, or after the event.
If equipment is damaged beyond repair, the client agrees to cover the reasonable replacement cost of the damaged
equipment, based on fair market value at the time of damage.
4. Working Conditions
The client must provide safe working conditions for all approved Jitterbug Discos personnel.
This includes ensuring that Jitterbug Discos staff are not subjected to harassment, abuse, threatening behaviour, unsafe
conditions, or inappropriate conduct.
If a Jitterbug Discos DJ or staff member feels unsafe or threatened at any time during the event, Jitterbug Discos reserves
the right to stop providing services immediately.
The client remains responsible for payment of the agreed booking fee and will not be entitled to a refund where services
are stopped due to unsafe or inappropriate behaviour.
5. Illegal Conduct

If illegal conduct occurs before, during, or after the event (including during setup or pack-down), Jitterbug Discos
reserves the right to cease services immediately and, where required, notify the appropriate authorities.
This includes, but is not limited to, the use of illegal substances or underage alcohol consumption.
The client remains responsible for payment of the agreed booking fee and will not be entitled to a refund where services
are stopped due to illegal conduct.
6. Child Safety and Supervision
Jitterbug Discos provides entertainment services and performance experiences. Jitterbug Discos staff are not a childcare
service and are not responsible for the supervision, care or individual needs of children attending the event.
The client, event organiser, venue, school, kindergarten or supervising adults are responsible for ensuring appropriate
supervision of children at all times.
Where practical, Jitterbug Discos recommends a minimum supervision ratio of one responsible adult for every 20
children. The required level of supervision remains the responsibility of the event organiser and may vary depending on
the type of event, venue requirements and the needs of children attending.
Jitterbug Discos staff will take reasonable steps to support a safe and enjoyable environment while performing their
entertainment role, including identifying general safety concerns and notifying responsible adults or the event organiser.
Jitterbug Discos staff are not responsible for meeting individual children's personal, medical or care needs, including but
not limited to:
• toileting assistance;
• changing clothing;
• administering medication;
• managing medical conditions;
• tying shoes or assisting with personal items;
• replacing lost or damaged personal belongings; or
• providing one-on-one supervision or behaviour management.
Parents, carers, teachers, educators and supervising adults remain responsible for the care, supervision and individual
needs of children throughout the event.
Jitterbug Discos maintains a separate Child Safety and Wellbeing Policy, developed in line with Victoria's Child Safe
Standards, which governs how our own staff and engaged subcontractors conduct themselves around children. A copy is
available on request.
7. Photography and Video
Jitterbug Discos may capture photographs and video footage during events for the purpose of documenting activities and
promoting Jitterbug Discos services, including social media, websites and promotional materials.
By booking Jitterbug Discos, the client acknowledges that photography and video recording may occur during the event,
and agrees to inform attending families of this in advance where the client is the event organiser (e.g. school,
kindergarten or party host).
Where a parent or carer does not wish their child to be photographed or filmed, they should advise Jitterbug Discos
directly before or at the start of the event, and reasonable steps will be taken to exclude that child from promotional
imagery.
Jitterbug Discos will take reasonable steps to ensure photography and video are conducted in a respectful manner and
with consideration for child safety, privacy and dignity.
Where an event is held at a school, kindergarten, venue or organisation with specific photography, privacy or child
safety requirements, Jitterbug Discos will take reasonable steps to comply with relevant requirements communicated by
the host organisation.
Parents or legal guardians may contact Jitterbug Discos at any time regarding concerns relating to images or videos
featuring their child, and such requests will be actioned promptly.

8. Working With Host Organisation Requirements
Jitterbug Discos recognises that schools, kindergartens, venues and organisations may have specific requirements
relating to mobile devices, photography, privacy and child safety.
Jitterbug Discos will take reasonable steps to comply with relevant requirements communicated by the host organisation,
and will not use a mobile phone to capture photographs or videos where this is not permitted.
Jitterbug Discos may still require access to a mobile device for operational purposes, such as providing internet
connectivity required for event equipment. Where this occurs, reasonable steps will be taken to ensure the device is used
only for the required purpose, kept secure and managed in a manner that supports the organisation's child safety and
privacy expectations.
9. Interactive Activities and Games
Jitterbug Discos provides interactive games and activities as part of our entertainment service, designed to be fun,
engaging and age-appropriate while considering the safety and wellbeing of children participating.
Where activities involve additional safety considerations, Jitterbug Discos will provide reasonable instructions and
expectations to encourage safe participation.
For activities such as piñatas or similar games, Jitterbug Discos will take reasonable steps to manage the activity safely,
including providing instructions, managing participation and maintaining an appropriate environment. Jitterbug Discos
does not use blindfolds during piñata activities due to safety considerations.
Parents, carers, teachers, educators and supervising adults remain responsible for supervising children and ensuring
individual children participate safely based on their abilities, needs and circumstances.
Jitterbug Discos staff are responsible for delivering the entertainment activity and are not responsible for providing
individual care, medical assistance or one-on-one supervision of children.
10. Prizes, Giveaways and Food Items
Jitterbug Discos may provide small prizes, giveaways and items as part of our entertainment service, which may include
fidget toys, glow sticks, stickers, lollipops and other novelty items.
The client and/or event organiser is responsible for advising Jitterbug Discos prior to the event of any restrictions,
allergies, dietary requirements, cultural considerations, medical considerations or other concerns relating to prizes,
giveaways or activities.
If the client, venue or organisation requires alternative items, restrictions or changes to standard prizes or activities, this
must be communicated to Jitterbug Discos before the event.
Parents, carers, teachers, educators and supervising adults remain responsible for supervising children and ensuring
prizes and giveaway items are suitable for individual children.
11. Refunds
Refunds will only be provided where Jitterbug Discos is unable to fulfil the agreed service due to unforeseen
circumstances or equipment failure.
If a Jitterbug Discos DJ has not commenced the agreed service time due to circumstances within Jitterbug Discos'
control, the client may be entitled to a partial refund or extension of service time. This does not include setup time,
except where unforeseen circumstances significantly delay the commencement of the event.
Refunds will not be provided due to dissatisfaction with music selection, sound preferences, lighting effects or
equipment features. A playlist may be provided upon request prior to the event.
Nothing in this clause limits any right the client has under the Australian Consumer Law that cannot be excluded,
restricted or modified.
12. Medical Conditions

The client is responsible for informing guests of any relevant medical conditions that may be affected by sound, lighting,
lasers, haze or other event effects.
Jitterbug Discos is not responsible for illness, injury or adverse reactions resulting from a guest's medical condition or
failure to follow appropriate precautions, except to the extent caused by Jitterbug Discos' own negligence.
13. Insurance and Liability
Jitterbug Discos holds current public liability insurance of $30,000,000 per occurrence, arranged through Duck for
Cover Entertainers Group Inc and underwritten by Allianz Australia Insurance Limited, covering MC, DJ and Children's
Party Host/Entertainer activities. A current Certificate of Currency is available on request, including for venues requiring
confirmation before a booking is finalised.
To the maximum extent permitted by law, Jitterbug Discos' total liability arising out of or in connection with these
Terms or the provision of services — whether in contract, tort (including negligence) or otherwise — is limited, at
Jitterbug Discos' option, to the resupply of the services or the amount paid by the client for the booking.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian
Consumer Law (or any other law) that cannot lawfully be excluded, restricted or modified. This clause does not limit
Jitterbug Discos' liability for death or personal injury caused by its negligence.
Jitterbug Discos is not liable for any indirect, consequential or special loss (including loss of enjoyment) arising from the
event, to the extent permitted by law.
14. Injuries
Subject to Clause 13, Jitterbug Discos is not responsible or liable for injuries caused by the negligent, reckless or unsafe
behaviour of the client or guests, or due to venue conditions outside of Jitterbug Discos' control.
15. Venue Requirements
The client must provide a suitable performance area for Jitterbug Discos. This includes:
• a stable table and/or suitable space of no less than 1.8 metres in length;
• access to a suitable power supply;
• protection from weather and environmental conditions where required; and
• safe access for setup and pack-down.
The client is responsible for ensuring the venue permits the use of required equipment and services.
16. Privacy and Personal Information
Jitterbug Discos collects personal information (such as client name, contact details and event details) solely for the
purpose of managing bookings, communicating about the event, and providing services.
Personal information is not sold or shared with third parties other than as required to deliver the booked service (e.g.
venue coordination) or as required by law.
Photographs or video that may identify a child are handled in accordance with Clause 7 above. Requests relating to
personal information can be directed to Jitterbug Discos using the contact details below.
17. Governing Law and Disputes
These Terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the
courts of Victoria.
If a dispute arises, the client agrees to first raise the matter directly with Jitterbug Discos to allow an opportunity to
resolve it before pursuing any other remedy.

18. General
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force
and effect.
These Terms, together with any written booking confirmation, constitute the entire agreement between the client and
Jitterbug Discos in relation to the event, and supersede any prior discussions or representations.
19. Client Responsibility
The client is responsible for ensuring guests behave appropriately and that the event environment allows Jitterbug Discos
to safely provide the agreed service.
By booking Jitterbug Discos, the client agrees to these Terms and Conditions.
