By purchasing a Ticket or registering to attend, you (you or the Attendee) agree to be bound by these Terms. If you register on behalf of another person, you warrant that you are authorised to bind that person and will ensure they comply with these Terms.

1. Definitions and interpretation

1.1 In these Terms:

(a) Attendee means each person registered to attend the Event, including any approved substitute;

(d) Site Visit means any Day Two or Day Three off-site activity, tour or facility visit forming part of the program;

(e) Ticket means a registration purchased for the Event;

(f) ACL means the Australian Consumer Law in Schedule 2 to the Competition and Consumer Act 2010 (Cth); and

(g) PPE means personal protective equipment.

2. Registration and Tickets

2.1 Registration is confirmed only on receipt of payment in full of the applicable Ticket fee.

2.2 Each Attendee must register using their full legal name and provide accurate registration details.

2.3 A Ticket is personal to the Attendee and is not transferable except under clause 4.3. 2.4 The Organiser may decline or cancel any registration where information provided is inaccurate or incomplete, or where payment is not received.

3. Fees, payment and GST

3.1 Ticket fees are stated in Australian dollars and, unless expressed otherwise, are inclusive of GST.

3.2 The Event Organiser will issue a tax invoice on request.

4. Cancellation, refunds and substitution by the Attendee

4.1 Cancellations must be made in writing to the Organiser.

4.2 Subject to clause 11 (Australian Consumer Law):

(a) for cancellations received 30 or more days before the first day of the Event, the Event Organiser will refund the Ticket fee less an administration fee of (20%); and

(b) no refund is payable for cancellations received within 30 days before the first day of the Event.

4.3 An Attendee who is unable to attend may nominate a substitute delegate, subject to the Event Organiser's prior written approval (not to be unreasonably withheld) and the substitute agreeing to these Terms.

5. Changes, postponement or cancellation by the Event Organiser

5.1 The Event Organiser may amend the program, speakers, venues, timings or format of the Event where reasonably necessary. Minor changes do not entitle the Attendee to a refund. Where a change materially alters the essential character of the Event, the Attendee may, as their sole remedy and subject to clause 11, elect a refund of the Ticket fee or a credit toward a future event, provided the election is made within 7 days of notice of the change.

5.2 If the Event Organiser cancels the Event (other than for a Force Majeure Event under clause 13), the Attendee's sole remedy is, at the Organiser's election, a refund of the Ticket fee, a credit toward a future event, or transfer to a rescheduled event.

6. Identification, entry and venue security

6.1 Attendees may be required to present current photographic identification at registration and on entry for security and access requirements.

6.2 The Event Organiser may refuse or revoke entry to any person who fails to comply with clause 6.1, or who presents a security or safety risk, without refund.

7. Site Visits and health and safety

7.1 Participation in Site Visits is voluntary, and the Attendee acknowledges and accepts the obvious and inherent risks of visiting operational and industrial premises.

7.2 Attendees must at all times:

(a) comply with all safety directions, site inductions, signage and instructions given by the Event Organiser or host-site personnel;

(b) wear any PPE and enclosed footwear or attire specified for a Site Visit; and

(c) not enter restricted or hazardous areas except as directed.

7.3 The Event Organiser may exclude any Attendee from a Site Visit who fails to comply with clause 7.2, without refund.

7.4 Nothing in these Terms excludes or limits any duty owed to the Attendee under the Work Health and Safety Act 2011 (Qld) or any Non-excludable Right under the ACL.

8. Transport

8.1 Where the Event Organiser provides transport, Attendees must follow the Event Organiser’s instructions and observe designated departure times.

8.2 Subject to clause 11, the Event Organiser is not responsible for any consequence of an Attendee's failure to be present at a designated departure time, including a missed departure.

9. Code of conduct

9.1 Attendees must conduct themselves professionally, lawfully and respectfully toward other Attendees, speakers, staff and venue personnel.

10. Photography, recording and use of image

10.1 The Event Organiser and its authorised representatives may photograph, film and record the Event.

10.2 By attending, the Attendee consents to the Event Organiser using the Attendee's image, likeness and voice, without compensation, for the promotion, marketing, reporting and archival purposes of the Event and its partners and sponsors, in any media, and acknowledges this consent survives the conclusion of the Event.

10.3 An Attendee who does not wish to be identifiable in promotional material should notify the Event Organiser in writing before the Event; the Event Organiser will take reasonable steps to accommodate the request but cannot guarantee exclusion from incidental or crowd imagery.

11. Australian Consumer Law

11.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the ACL or any other law that cannot lawfully be excluded (Non-excludable Rights).

11.2 Where the ACL permits a supplier to limit its liability for a breach of a guarantee in respect of services not of a kind ordinarily acquired for personal, domestic or household use, the Event Organiser's liability is limited, at the Event Organiser's option, to supplying the services again or paying the cost of having them supplied again.

12. Limitation of liability and assumption of risk

12.1 To the fullest extent permitted by law, and subject to clause 11, the Event Organiser is not liable for any personal injury, death, loss, damage, cost or expense (including indirect or consequential loss) suffered or incurred by an Attendee arising from or in connection with the Event, attendance, or participation in any Site Visit or transport.

12.2 To the fullest extent permitted by law, and subject to clause 11, the Attendee releases and indemnifies the Event Organiser against any claim, liability, loss or expense arising from the Attendee's breach of these Terms, negligent or wrongful act or omission, or failure to comply with a safety or venue direction, except to the extent caused by the Event Organiser’s own negligence.

12.3 The Attendee is strongly recommended to hold appropriate personal travel, health and property insurance for the duration of the Event.

12.4 Attendees are responsible for their own personal belongings at all times, and subject to clause 11 the Event Organiser is not liable for loss, theft of, or damage to an Attendee's personal property.

13. Force Majeure

13.1 A Force Majeure Event means an event beyond the Event Organiser’s reasonable control, including natural disaster, fire, flood, epidemic or pandemic, public-health emergency, government restriction or direction, act of terrorism, war, civil unrest, industrial action, or failure of essential services or venues.

13.2 The Event Organiser is not liable for any delay, interruption, postponement or cancellation of the Event caused by a Force Majeure Event.

13.3 If the Event is cancelled or materially curtailed due to a Force Majeure Event, the Event Organiser will, subject to clause 11 and to the extent reasonably practicable, offer the Attendee a refund of the unspent portion of the Ticket fee, a credit, or transfer to a rescheduled event; the Organiser is not liable for travel, accommodation or other costs incurred by the Attendee.

14. Privacy and cross-border disclosure

14.1 The Event Organiser collects personal information from Attendees to administer registration, entry, security, communications and the Event program, and handles it in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

14.2 The Event Organiser may disclose personal information to venues, service providers, security and government authorities and to Event partners and sponsors, for the purposes in clause 14.1.

14.3 The Attendee may contact the Event Organiser to access or correct their personal information, or to make a privacy complaint, using the details in clause 15.

15. Notices and contact

15.1 Enquiries and notices to the Event Organiser must be directed to [ACSITP SECRETARY/ secretary.acsitp@gmail.com/ +61494684493].

15.2 A notice is effective when received.

16. General

16.1 Governing law and jurisdiction. These Terms are governed by the laws of Queensland, and the parties submit to the non-exclusive jurisdiction of the courts of Queensland.

16.2 Variation. The Event Organiser may amend these Terms before the Event, prospectively and on reasonable notice, where necessary to comply with law or for another legitimate reason. The version in force at the date of purchase applies to your Ticket. If an amendment made after your purchase would cause you material detriment, you may cancel and obtain a refund of the Ticket fee within [7] days of notice.

16.3 Assignment. The Attendee may not assign these Terms except under clause 4.3. The Organiser may assign or novate its rights and obligations to a related entity or successor.

16.4 Severability. If any provision is void or unenforceable, it is severed and the remaining provisions continue in force.

16.5 Waiver. A failure or delay by the Event Organiser to exercise a right is not a waiver of it.
