1. This Agreement is made between: The Parish of Saint Joachim (Parish) and St Fiacre's Catholic Primary School (SCS).
2. The Parish agrees to allow the Hirer use of the Assisi Centre from 8:00AM-3:00PM inclusive on Friday 4th September, 2026.
3. The Hirer agrees to pay the Parish the sum of $650 excluding GST for use of the Hall for the Hire Period.
4. The Parish in not liable to the Hirer for any loss suffered by the Hirer arising out of the Hirer’s use of the Assisi Centre. The Hirer releases the Parish from any claims, demands, actions, costs and expenses arising out of, in connection with or caused by the Hirer’s use of the Assisi Centre.
5. The Hirer indemnifies the Parish from and against all claims, demands, actions, costs and expenses arising out of, in connection with or caused by the Hirer’s use of the Hall.
6. The Hirer agrees to effect public liability insurance for an amount of not less than $10 million per occurrence and to provide a Certificate of Currency to the Parish prior to commencement of the Hire Period. The Hirer agrees to keep the policy in force for the duration of the Hire Period.
7. The Hirer agrees to reimburse the Parish for the full cost of repairing any damage caused to the Assisi Centre or facilities during the Hire Period.
8. The Hirer agrees to notify the Parish promptly of all injuries or damage arising out of the Hirer’s use of the Assisi Centre.
9. The Hirer agrees to abide by the conditions set out in the attached Conditions for Hire of the Assisi Centre which form part of this Assisi Centre Hire Agreement.
CONDITIONS FOR HIRE OF THE ASSISI CENTRE
1. Applications for use of the Assisi Centre must be made in writing on the form supplied.
2. Use of the Assisi Centre may only be for the purpose permitted by the Parish (Permitted Purpose) and must not use the Assisi Centre for any other purpose without the consent of the Parish.
3. A bond must be deposited with the booking officer prior to the function will be refunded in full provided that no damage is done to the Assisi Centre and facilities, and the surrounding property is left clean and tidy. Loss of keys may entail replacement of locks and this will be at the discretion of the booking officer and is at the liability of the Hirer. Should any damage occur, the booking officer’s assessment of cost of rectifying damage shall be final.
4. Charges for the use of facilities must be paid at the time of making the booking, or, in the case of ongoing use, by arrangement with the booking officer. A $50 cancellation fee applies to cancelled bookings. Notice of a cancellation must be provided via email at least 72 hours before the confirmed hiring date.
5. Nothing is to be attached in any manner to the walls, floors, curtains or any part of the buildings, nor shall signs, scenery or any other structures be erected without the permission of the booking officer.
6. The Hirer must not knowingly use the Assisi Centre or any part of the Assisi Centrefor any purpose which is inconsistent with the teachings of the Catholic Church. This Assisi Centre Hire Agreement will be terminated if the Hirer is using or has used the Assisi Centre or any part of the Assisi Centre for any purpose which is inconsistent with Catholic teachings.
7. The right is reserved to refuse to let the Hall or terminate this Assisi Centre Hire Agreement at the discretion of the Parish, in which case all monies paid by the Hirer will be refunded.
8. The Parish makes no warranty or representation to the Hirer about the condition of the Assisi Centre or facilities or their suitability for the Permitted Purpose. Further, the Hirer acknowledges that they have inspected the facilities and warrants that the facilities are suitable for the Permitted Purpose.
9. It is the responsibility of the Hirer to obtain any necessary permits from the relevant authorities as required for the Permitted Purpose and the planned activities during the Hire Period. If entertainment is to be provided, it must be in keeping with the values and standards of the Parish. All programs must be submitted for approval to the Parish prior to the Hire Period.
10. The Hirer must comply with the reasonable rules and directions of representatives of the Parish.
11. The Parish will not be responsible for the acts or omissions of contractors engaged by the Hirer. It is recommended that Hirers ensure all contractors (for example, caterers) have public liability insurance.
12. If the Hirer intends to provide services in the Assisi Centre for which the Hirer requires a valid Working with Children Check (WWCC) under the Child Protection (Working with Children) Act 2012 (NSW) and Child Protection (Working with Children) Act Regulation 2012 (NSW), the Hirer undertakes that the Hirer and/or any employees, volunteers or contractors engaged by the Hirer have obtained a valid WWCC. The Hirer otherwise agrees to comply with all relevant child protection obligations under relevant legislation, including, but not limited to, the Child Protection (Working with Children) Act 2012 (NSW), the Child Protection (Working with Children) Regulation 2013 (NSW), the Children and Young Persons (Care and Protection) Act 1998 (NSW), the Children and Young Persons (Care and Protection) Regulation 2012 (NSW), the Children’s Guardian Act 2019 (NSW) and any regulations, to the extent that they are relevant.
13. The Hirer will at all times comply with work, health and safety laws. The Hirer is the person with management and control of the Assisi Centre during the hire period and has control of the Assisi Centre and over all aspects of the Hirer’s activities and health and safety issues at the Assisi Centre. The Hirer is familiar with and has the capability and resources to comply with all work, health and safety laws applicable or relevant to its use and control of the Assisi Centre. The Parish has provided the Hirer with sufficient information of risks associated with the Assisi Centre to enable the Hirer to properly assess and control those risks and the Hirer has undertaken an assessment of risks associated with the Assisi Centre and has identified and implemented appropriate measures to control risks.
14. The Hirer will promptly notify the Parish of any accident, injury, property or environmental damage which is notifiable to a regulatory authority and will act in accordance with the directions of representatives of the Parish to provide details of the incident.
15. If kitchen facilities are to be used, all appliances must be left in a clean and tidy condition. No food or drink may be left in the cool room and all bottles and rubbish must be removed from the Assisi Centre and placed in the appropriate bins during use of the Assisi Centre. Please stack chairs in groups of 10-12 in order of colour and shape and return to the storeroom. Toilets must be cleaned and swept. All external doors must be locked. Do not turn off the cool room. At all times the Hirer must keep the Assisi Centre clean and tidy and at the end of the Hire Period, the Hall must be left clean and any rubbish and personal effects removed.
16. The Parish will provide 2 general waste bins (red lid) and 2 recycling waste bins (yellow lid) for the use of the Hirer. Bins must not be overfilled. Any additional waste must be removed by the Hirer. The Hirer is responsible for placing waste in the correct bins.
17. Parish representative shall at all times be entitled to free access to all parts of the building.
18. No sales of any kind are permitted without prior approval.
19. This Assisi Centre Hire Agreement may not be assigned to another party. Sub-letting of the Assisi Centre or any facilities is not permitted.
20. In case of any disputes arising, the decision of the Parish Priest shall be final.
21. Noise (such as music) must be contained within the requirements of the City Council. Additionally, music must cease at 11:00pm on Fridays and Saturdays, and 10.00pm on all other days.
22. The Hirer of the Assisi Centre and guests are confined to the Assisi Centre and its accompanying facilities and this does not extend to the Church or other buildings or parts of the Parish.
23. The Hirer is aware that the Assisi Centre is in a residential area and that all persons attending the Assisi Centre must refrain from any behaviour which could be reasonably construed as disturbing the neighbours or infringing on a person’s property and/ or rights.
24. Under no circumstances shall liquor be sold until approval from the Parish been obtained and the necessary liquor permit is sighted at the time of obtaining the Assisi Centre key and payment of the bond.
25. Normal liquor regulations apply. Alcohol is not to be served to guests under 18 years of age.
26. Approval for the consumption of alcohol may be withheld at the discretion of the Parish.
27. The consumption of alcohol, where approval has not been withheld by the parish, is strictly confined to the Assisi Centre. Alcohol is not to be consumed in the parish carpark or surrounding parish property.
28. Please note that Parish grounds are generally secured and access is only available at agreed times. Assisi Centre patrons are requested to park in the Church car park or in the street, but not on the lawn or nature strip in front of the Church property.
29. Smoking is not permitted in the Assisi Centre.
30. The Parish accepts no responsibility for private property left in the Assisi Centre.
31. This Assisi Centre Hire Agreement constitutes the entire agreement between the parties and can be modified only in writing agreed by the parties and is subject to the laws of New South Wales.
