By booking an HPSA Academy clinic or allowing a child to participate, the person making the booking confirms that they have read, understood and accepted these Terms and Conditions.

HPSA Academy clinics involve physical activity, including running, sprinting, jumping, changing direction and other sporting movements. Participation may involve inherent risks, including falls, collisions, muscle soreness and physical injury.
Parents and guardians are responsible for deciding whether their child is physically and medically able to participate.
HPSA Academy coaches and staff are not medical professionals and cannot provide medical advice, diagnosis or treatment. Any fitness, movement or performance feedback provided is for general informational purposes only.
HPSA Academy does not guarantee any particular sporting, fitness, selection or performance outcome from attending a clinic.
To the maximum extent permitted by law, participants and their parents or guardians acknowledge and voluntarily accept the inherent risks associated with participating in sporting and physical activities.
Nothing in these Terms and Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

The parent or guardian must disclose all relevant information before participation, including:
β’ Current or previous injuries;
β’ Medical conditions;
β’ Allergies;
β’ Medication requirements;
β’ Physical limitations;
β’ Disabilities or additional support needs; and
β’ Behavioural considerations that may affect the participantβs safety or the safety of others.
Parents and guardians must notify HPSA Academy if any information supplied during booking changes before the clinic.
Participants must not attend if they are unwell, infectious, medically unable to participate or have been advised not to participate in physical activity.
Failure to disclose relevant information may result in the participant being modified out of certain activities or removed from the clinic for safety reasons. A refund or credit may not be provided where removal results from undisclosed information, unsafe behaviour or failure to follow reasonable instructions.
HPSA Academy may refuse, restrict or discontinue a participantβs involvement where HPSA Academy reasonably considers that continued participation may create a safety risk to the participant or another person.

The parent or guardian authorises HPSA Academy staff to provide basic first aid and, where reasonably necessary, contact emergency services or arrange urgent medical assistance for the participant.
HPSA Academy will make reasonable attempts to contact the participantβs parent, guardian or nominated emergency contact.
The parent or guardian is responsible for reasonable medical, ambulance or emergency-service expenses incurred on behalf of the participant, except to the extent that responsibility cannot lawfully be imposed.
Any medication required during the clinic must be clearly labelled and disclosed to HPSA Academy before participation. HPSA Academy staff are not responsible for administering medication unless arrangements have been agreed to in writing before the clinic.

When booking for another parent or guardian, the person making the booking confirms that:
β’ They have permission to register the child;
β’ The childβs parent or legal guardian has been given access to these Terms and Conditions;
β’ All relevant medical, behavioural and emergency-contact information has been obtained and accurately provided; and
β’ They are authorised to accept these Terms and Conditions on the parent or guardianβs behalf.
The person making the booking is responsible for the accuracy and completeness of the information supplied.

Parents and guardians are responsible for participants before they are checked in and immediately after the scheduled clinic finishing time.
Participants must be collected promptly by a parent, guardian or authorised adult.
A current emergency contact must remain available by telephone throughout the clinic.
HPSA Academy is not responsible for supervising participants outside the advertised clinic times unless HPSA Academy has expressly agreed otherwise.

Unless the parent or guardian opts out in writing before the clinic, they consent to HPSA Academy photographing or recording the participant during the clinic and using that content for legitimate promotional, marketing or educational purposes, including:
β’ HPSA Academy social-media accounts;
β’ The HPSA Academy website;
β’ Digital advertising;
β’ Emails;
β’ Printed promotional materials; and
β’ Internal coach education and training.
HPSA Academy will not intentionally publish a participantβs full name alongside an image without additional permission.
Parents and guardians may withdraw consent for future use by contacting HPSA Academy in writing. Withdrawal will not necessarily require HPSA Academy to recall or remove material that was lawfully created, published or distributed before consent was withdrawn, where removal is not reasonably practicable.
Parents, guardians and spectators must not photograph, record or publish identifiable images of other children without permission from their parent or guardian.

Cancellation requests must be submitted to HPSA Academy in writing through info@hpsaacademy.com
The notice period is calculated from the scheduled starting time of the clinic.
Cancellations with at least 48 hoursβ notice
Customers who cancel at least 48 hours before the scheduled clinic starting time are eligible for a full refund.
Refunds will ordinarily be returned to the original payment method.
Cancellations with less than 48 hoursβ notice
Cancellations received less than 48 hours before the scheduled clinic starting time are not eligible for a refund.
The participant may be eligible for a credit toward a future HPSA Academy clinic, at HPSA Academyβs reasonable discretion and subject to availability.
A credit is not automatically guaranteed merely because notice has been provided.
Illness
Where a child is unable to attend because of illness, HPSA Academy may offer a credit toward a future clinic.
The parent or guardian must notify HPSA Academy as soon as reasonably possible. Supporting documentation, such as a medical certificate, may be requested.
Illness does not automatically entitle the customer to a cash refund where less than 48 hoursβ notice is provided.
No-shows
Failure to attend without notifying HPSA Academy before the clinic is considered a no-show.
No-shows are not eligible for a refund or credit except where otherwise required by law.

Any credit issued by HPSA Academy is subject to the following conditions:
β’ The credit is valid for 12 months from the date of the original clinic for which the booking was made.
β’ The credit expires automatically at the end of that 12-month period.
β’ The customer is responsible for contacting HPSA Academy to request use of the credit.
β’ HPSA Academy will not automatically contact the customer, send expiry reminders, reserve a place or book the participant into another clinic.
β’ The customer must contact HPSA Academy before the credit expires.
β’ Credits are subject to a suitable future clinic being scheduled and having an available place.
β’ Credits may only be used for an age-appropriate HPSA Academy clinic in the relevant town or surrounding area unless HPSA Academy agrees otherwise.
β’ A place is not secured until HPSA Academy confirms the credited booking in writing.
β’ Credits cannot be exchanged for cash except where required by law.
β’ A booking made using a credit remains subject to these cancellation and attendance conditions.
β’ An expired or unused credit will not ordinarily be reinstated.
Where HPSA Academy has not scheduled any suitable clinic in the relevant area during the credit period, the customer should contact HPSA Academy before the expiry date to discuss whether a reasonable alternative location or arrangement is available.

HPSA Academy may cancel, postpone, combine or reschedule a clinic due to circumstances including:
β’ Severe or unsafe weather;
β’ Venue unavailability;
β’ Coach illness or unavailability;
β’ Insufficient participant numbers;
β’ Government or authority directions;
β’ Safety concerns; or
β’ Circumstances outside HPSA Academyβs reasonable control.
HPSA Academy may also substitute a coach or move a clinic to a reasonably nearby venue where this does not materially change the service being provided.
Where HPSA Academy cancels a clinic and cannot provide a suitable replacement session, customers may choose between:
β’ A full refund for the affected clinic; or
β’ A credit toward a future HPSA Academy clinic.
Where HPSA Academy makes a material change to the clinicβs time, date, location or nature and the participant cannot reasonably attend, the customer may request a refund or future credit.
Minor changes that do not materially affect the service, including a coach substitution or movement to a reasonably nearby venue at the same or substantially similar time, will not automatically entitle the customer to a refund.

Clinics may proceed in light rain or other manageable weather conditions.
Where severe weather, excessive heat, venue conditions or another safety issue arises, HPSA Academy may:
β’ Delay the session;
β’ Modify the activities;
β’ Move the clinic to a nearby indoor or alternative venue;
β’ Change the clinic time;
β’ Reschedule the clinic; or
β’ Cancel the clinic.
Indoor or modified sessions will be designed to provide a comparable standard of coaching where reasonably practicable.
Updates will be sent to the email address provided during booking and may also be posted on the HPSA Academy Facebook page.
Parents and guardians are responsible for supplying accurate contact information and checking communications before travelling to the clinic.
If a material time or date change prevents the participant from attending, the customer may request a full refund or future credit.

Participants must:
β’ Treat coaches, staff, venue personnel and other participants respectfully;
β’ Follow reasonable coaching and safety instructions;
β’ Avoid bullying, harassment, threatening conduct and inappropriate language;
β’ Use equipment appropriately; and
β’ Avoid conduct that may endanger themselves or another person.
HPSA Academy may provide a warning, modify participation or remove a participant for disruptive, abusive or unsafe conduct.
Where removal results from serious or repeated behavioural issues or a failure to follow reasonable safety instructions, no refund or credit will ordinarily be provided.

Participants must:
β’ Wear appropriate sporting or training clothing;
β’ Wear enclosed athletic shoes;
β’ Bring sufficient drinking water;
β’ Bring any required personal medication; and
β’ Follow any clinic-specific equipment instructions.
HPSA Academy is not responsible for personal belongings that are lost, stolen, left behind or damaged, except where liability cannot lawfully be excluded.

HPSA Academy may collect and use personal information supplied during booking for purposes including:
β’ Processing and managing the booking;
β’ Communicating clinic information;
β’ Participant safety;
β’ Responding to medical or emergency situations;
β’ Maintaining attendance and business records; and
β’ Marketing where the customer has provided the required consent.
Parents and guardians are responsible for ensuring that the contact, emergency and participant information supplied is accurate and current.

The Terms and Conditions in effect when a booking is made will apply to that booking.
HPSA Academy may update its Terms and Conditions for future bookings. HPSA Academy will not rely on a material change to unfairly remove rights relating to an existing booking.

These Terms and Conditions are governed by the laws applying in the Australian state or territory in which the clinic takes place.
Nothing in these Terms and Conditions excludes, restricts or modifies the application of the Australian Consumer Law or any other rights that cannot legally be excluded.

By completing a booking, the parent or guardian confirms that:
β’ They have read and understood these Terms and Conditions;
β’ They are authorised to accept them;
β’ The information provided is complete and accurate; and
β’ They consent to the participant attending subject to these conditions.
