You acknowledge and agree that participating in high-intensity interval training is a strenuous physical activity and may not be suitable for all persons. You acknowledge and agree that: (1) give us all relevant personal health information both before and during the course of any exercise program or other activity; (2) complete our Pre-Exercise Questionnaire and acknowledge that pre-exercise or other screening is no substitute for medical advice and does not guarantee against injury or death; (3) it is your responsibility to disclose any pre-existing medical condition, medical condition, or medication. Including any medical symptoms or issues arising during any class; (4) we may require you to provide written physician approval before you use any of our equipment and/or participate in any class; and (5) you may discontinue participation in class at any time.

By signing this Agreement, you acknowledge and voluntarily accept these risks and responsibilities, which include the risk of injury to your person or property resulting from participation in any class or services provided by us or another F45 studio, and agree to be responsible and liable for participation by another individual who may gain access to class through you including, without limitation, injury or damage to such individual’s person or property. You hereby waive all claims, assume all liability, and release, hold harmless, indemnify, and agree to defend us, F45 Training Incorporated, as well as its parents, subsidiaries, and affiliates (the “Franchisor”), and any other F45 studio, and any owner of any other F45 studio you may visit, and any of our or their respective affiliates, successors, assigns, agents, representatives, and employees, from liability for any injury, claim, cause of action, suit, demand, and any damages arising from or related to: (1) your failure to disclose any pre-existing conditions, limitations, or sensitivities; (2) your participation or presence on or near the premises of any F45 studio; (3) your participation in any F45 class (whether in provided in the studio, outdoors, online or otherwise) or use of any equipment at any F45 studio; and/or (4) any negligence on our part (including our staff/employees) or the part of any employee at any other F45 studio. You acknowledge and agree that this risk, release, liability waiver, and indemnification assumption is intended to be as broad and inclusive as the law permits. (5) I acknowledge and agree that should i utilise the unsupervised children's area or have my children in the gymnasium, i accept full responsibility of my child and F45 Moorebank or its staff have no responsibility to supervise and can not be held liable for any injuries/incidents to my child/children.

The remaining portions of this Assumption of Risk, Release, Waiver of Liability, and Indemnification provision shall remain valid and continue in full legal force and effect, notwithstanding any invalid portion of these provisions.

By providing your email and phone number and signing this Agreement, you consent to and authorize the Studio and/or their agents to contact you or send you text messages regarding class reminders, waitlists, account management appointments, transactions, and/or promotions. You are not required to authorize emails, calls, or text messages to purchase or participate in F45 classes or sessions, and you may opt-out at any time.

Use of Personal Information, Image, Likeness, and/or Voice:
You understand, acknowledge, and agree that you may be photographed, recorded on audio or video, or otherwise recorded in classes or participation in any F45 class (whether in the studio, outdoors, online, or otherwise), and hereby agree and consent for all purposes to the use in any manner of any such photograph, audio, video, or other recording or depiction of your likeness and/or voice whatsoever by us, and any nominee or designee of them or us, including without limitation any agency, in all forms of media, whether now or hereafter devised, throughout the world and in perpetuity, and all manners, including without limitation advertising, trade, display, editorial, art, and exhibition. You further understand and agree that any such photograph, audio, video, or other recording or depiction of your likeness and/or voice may be modified, altered, cropped, and combined with other content such as images, video, audio, text, and graphics, and hereby waive any right to inspect or approve (defined above) any finalized curated content of any kind. As part of this Agreement, you agree to hold harmless and indemnify the Studio against all liability, damage, loss, and/or claims of any kind and nature, including, but not limited to, claims and demands for libel, invasion of privacy, and violation of publicity rights. You are not required to authorize F45 to use personal information, image likeness, and/or voice to purchase or participate in F45 classes or sessions, and you may opt-out at any time.

I have read and understand and agree to the terms and conditions of this Agreement. I hereby waive all claims, assume all liability, and release, hold harmless, indemnify, and agree to defend the Studio, F45 Training Incorporated, as well as its parent(s), subsidiaries and affiliates, and any other F45 studio, and any owner of any other F45 studio you may visit, and any of our or their respective affiliates, successors, assigns, agents, representatives, and employees, from liability for any injury, claim, cause of action, suit, demand, and any damages as a result of my voluntary participation, to the maximum extent permitted by law.

I confirm i have had sufficient time to read the entire Agreement.
