**Athlete Waiver and Participant Agreement**
By registering for and participating in The Hustle Games 2026 (“Event”), I acknowledge that I have read, understood and agree to the following terms and conditions.
1. Assumption of Risk
I acknowledge that participation in The Hustle Games involves strenuous physical exercise and competitive fitness activities. I understand that participation carries inherent risks, including, but not limited to, muscle strains, sprains, fractures, dislocations, falls, collisions, illness, cardiovascular events and other serious injury, disability or, in rare circumstances, death.
I voluntarily choose to participate in the Event and knowingly accept the risks associated with participation, including risks arising from the nature of the activities, the Event environment, the actions of other participants and any risks that may not be reasonably foreseeable.
2. Fitness and Medical Condition
I confirm that I am physically capable of participating in the activities associated with The Hustle Games and have undertaken appropriate training for the level of physical exertion required.
I understand that it is my responsibility to determine whether I am fit and well enough to participate. I will not participate if I am experiencing an illness, injury or other condition that may make participation unsafe.
I agree to immediately notify an Event official if I become unwell, injured or unable to safely continue participating.
3. Compliance with Event Rules
I agree to follow all Event rules, instructions and safety requirements provided by The Hustle Games organisers, Event officials, judges and other authorised personnel.
If I observe an unsafe condition or significant hazard, I will stop participating where appropriate and immediately notify an Event official.
I understand that organisers and Event officials may stop or withdraw my participation if they reasonably believe that I am unable to safely continue or that my participation presents a risk to myself or others.
4. Release and Liability
To the extent permitted by law, I release and hold harmless The Hustle Games, CrossFit Hustle & Harvest, the Event organisers, venue operators, sponsors, volunteers, officials, contractors and other persons involved in conducting the Event (collectively, the “Released Parties”) from claims arising from my participation in the Event, except to the extent that such liability cannot lawfully be excluded, restricted or modified.
I acknowledge that this waiver does not exclude or limit any rights or liability that cannot legally be excluded under Australian or WA law.
5. Personal Property
I acknowledge that I am responsible for my own personal belongings brought to the Event. The organisers are not responsible for loss, theft or damage to personal property, except where liability cannot legally be excluded.
6. Photography, Video and Media
I understand that photography, videography and other forms of recording may take place during The Hustle Games.
By participating in the Event, I grant the organisers and their authorised representatives permission to photograph, film and record me during the Event and to use my image, likeness and recorded material for legitimate promotional, marketing and communications purposes relating to The Hustle Games, CrossFit Hustle & Harvest and future events.
I understand that such material may be published on websites, social media, advertising, promotional materials and other media.
7. Emergency Medical Treatment
In the event that I require medical assistance during the Event, I authorise Event organisers and/or emergency personnel to arrange or provide reasonable first aid or emergency medical assistance where necessary.
I understand that I am responsible for any medical, ambulance, hospital or other treatment costs incurred by me, to the extent permitted by law and not otherwise covered by another party.
8. Age and Consent
I confirm that I am **18 years of age or older** at the time of registration.
If an athlete is under 18 years of age, participation is only permitted where the organisers have received the required written consent from a parent or legal guardian and any additional requirements specified by the organisers have been satisfied.
9. Acknowledgement
By completing my registration and accepting this agreement, I confirm that:
* I have read and understood this Athlete Waiver and Participant Agreement.
* I understand the physical risks associated with participating in The Hustle Games.
* I voluntarily choose to participate in the Event.
* I agree to follow all Event rules and safety instructions.
* The information I have provided during registration is accurate and complete.
* I understand that I should seek appropriate medical advice if I have any concerns about my ability to participate safely.
**By ticking the acceptance box during registration, I confirm that I have read, understood and agree to this Athlete Waiver and Participant Agreement.**
