EVENT BOOKING TERMS & CONDITIONS

These Terms and Conditions apply to events, retreats, prayer meetings, conferences, workshops, formation programs and other activities organised by Holy Spirit Missionaries Inc (“HSM”, “we”, “us” or “the Organiser”).

By registering, purchasing a ticket, making a booking or attending an event, you acknowledge that you have read and agree to these Terms and Conditions. If you make a booking for another person, including a child, you are responsible for bringing these Terms to their attention and, where applicable, obtaining the necessary consent of their parent or legal guardian.

1. BOOKINGS AND REGISTRATION
Registration is subject to availability and is not confirmed until the booking process has been completed.
You must provide accurate information when registering.
You must promptly notify HSM if relevant information supplied during registration changes.
HSM may impose reasonable conditions of entry or participation for safety, safeguarding, operational, legal or venue requirements.
A ticket or registration may not be resold for profit or used for unauthorised commercial purposes.
2. CANCELLATIONS BY PARTICIPANTS AND REFUNDS

Unless otherwise stated for a particular event:

bookings and registration payments are non-refundable for change of mind, inability to attend, late arrival, early departure or personal circumstances;
booking or transaction fees charged by TryBooking or another third-party provider may be non-refundable;
HSM may, at its discretion, permit a registration to be transferred to another eligible person before the event; and
nothing in these Terms excludes any refund, remedy or other right that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
3. CHANGES TO AN EVENT

HSM may make reasonable changes to an event where necessary, including changes to:

speakers, ministers or facilitators;
program content or sequence;
session times;
catering;
rooms or accommodation arrangements;
event format;
venue; or
other operational arrangements.

HSM will endeavour to communicate material changes where reasonably practicable.

A reasonable change to an event does not automatically entitle a participant to a refund. However, nothing in this clause limits rights or remedies that cannot lawfully be excluded.

4. CANCELLATION, POSTPONEMENT OR INTERRUPTION BY HSM

HSM may cancel, postpone, relocate, shorten, suspend or interrupt an event where reasonably necessary because of circumstances including:

insufficient registrations;
illness or unavailability of key personnel;
venue unavailability;
severe weather or natural disaster;
fire, flood or other emergency;
public health concerns;
safety or safeguarding concerns;
government or emergency-service directions;
transport disruption;
utility or infrastructure failure; or
circumstances beyond HSM's reasonable control.

If HSM cancels an event and does not provide a substantially equivalent replacement or rescheduled event, HSM will provide any refund required by law and may otherwise refund amounts paid directly to HSM for the cancelled event.

Except to the extent required by law, HSM is not responsible for consequential or external expenses incurred by participants, including travel, accommodation, meals, lost wages, childcare or other personal expenses.

Participants should therefore consider whether travel or other bookings should be refundable or insured.

5. VOLUNTARY PARTICIPATION AND PERSONAL RESPONSIBILITY

Attendance and participation are voluntary.

Participants are responsible for making reasonable decisions concerning their own ability to participate in an event or activity.

Participants must:

comply with reasonable safety instructions;
exercise reasonable care for themselves and others;
advise an event leader of an immediate safety concern;
not participate in an activity they reasonably believe they cannot undertake safely; and
seek appropriate professional advice where they are uncertain about their fitness to participate.
6. PERSONAL ACCIDENTS, INJURY AND PERSONAL INSURANCE

Accidents, illness and injury can occur despite reasonable precautions.

Participants remain responsible for their own personal health and safety and are encouraged to maintain appropriate health, ambulance, travel and personal accident insurance.

To the maximum extent permitted by law, HSM is not responsible for loss arising solely from risks ordinarily associated with voluntary attendance or participation where the loss was not caused by a breach of a legal duty owed by HSM.

Nothing in these Terms excludes, restricts or modifies any statutory guarantee, duty, right or remedy that cannot lawfully be excluded, restricted or modified.

7. MEDICAL CONDITIONS AND MEDICATION

Participants are responsible for:

determining whether they are medically fit to attend;
bringing and managing their own medication;
carrying necessary medical devices;
informing an appropriate event leader of information that may reasonably be required to respond to a foreseeable medical emergency; and
obtaining medical advice before attending where appropriate.

HSM staff and volunteers do not provide medical diagnosis or treatment unless a person is appropriately qualified and specifically authorised to do so.

Participation in prayer ministry is not a substitute for medical, psychological, psychiatric or other professional healthcare.

Participants should not discontinue or alter prescribed medication or treatment because of anything said or experienced at an HSM event without consulting an appropriately qualified healthcare professional.

8. EMERGENCIES

In an emergency, HSM may take reasonable steps to protect a participant's health or safety, including:

providing first aid;
contacting a participant's emergency contact;
contacting police, ambulance, fire or other emergency services; or
arranging emergency medical assistance.

Where lawful, any ambulance, medical, transport or other third-party costs remain the responsibility of the participant or their parent/guardian.

Nothing in these Terms requires HSM or its volunteers to provide treatment beyond their qualifications or competencies.

9. SPIRITUAL AND PRAYER MINISTRY

HSM is a Christian religious organisation and events may include prayer, worship, Scripture, preaching, testimony, spiritual formation, Adoration, prayer ministry or other Christian religious practices.

Participation in individual prayer ministry is voluntary.

HSM does not guarantee:

healing;
deliverance;
spiritual experiences;
financial outcomes;
reconciliation of relationships;
resolution of personal difficulties; or
any particular physical, psychological, emotional or spiritual outcome.

Participants remain free to accept or decline prayer ministry.

Prayer ministry must be conducted in accordance with HSM safeguarding requirements and applicable law.

10. SAFEGUARDING AND CHILD SAFETY

HSM is committed to providing environments that promote the safety and wellbeing of children and young people and has zero tolerance for child abuse, grooming, exploitation or inappropriate conduct.

HSM applies its safeguarding policies, Code of Conduct and applicable Victorian Child Safe Standards.

All participants must comply with reasonable safeguarding directions.

Any concern relating to the safety or wellbeing of a child or vulnerable person may be documented, escalated and reported to HSM's safeguarding personnel, police, child protection, the Social Services Regulator or another appropriate authority where required or permitted by law.

Nothing in these Terms limits any person's right to make a complaint or report directly to police, child protection, a regulator or another appropriate authority.

11. CHILDREN AND YOUNG PEOPLE

Unless an event is expressly advertised as providing supervised children's activities:

HSM does not provide general childcare;
a parent, legal guardian or other authorised responsible adult must remain responsible for each child attending under their care;
children must not be left unattended;
parents/guardians must know the whereabouts of children under their care; and
parents/guardians must comply with event-specific safeguarding arrangements.

Parental or guardian responsibility does not exclude or reduce HSM's own safeguarding obligations under applicable law.

12. DESIGNATED CHILDREN'S OR YOUTH SESSIONS

Where HSM expressly provides a supervised children's or youth session:

HSM supervision applies only during the designated session, at the designated location and during the communicated supervision period;
parents/guardians must comply with sign-in, sign-out, collection, identification and emergency-contact procedures;
children must not leave the designated area without authorisation;
parents/guardians must remain contactable where required; and
responsibility returns to the parent/guardian when the child is signed out, collected or the designated supervision period ends.

Specific safeguarding arrangements for an event override any inconsistent general provision in these Terms.

13. RESIDENTIAL EVENTS AND ACCOMMODATION

For residential retreats or events:

participants must comply with accommodation and venue rules;
bedrooms, dormitories and designated private areas may be restricted during program sessions;
participants must respect privacy and personal boundaries;
participants must not enter another person's bedroom or private accommodation area contrary to HSM or venue rules;
children must be accommodated and supervised in accordance with HSM safeguarding arrangements;
participants must not create circumstances that compromise safeguarding requirements; and
HSM may impose additional room-allocation or access requirements for safeguarding purposes.

Parents/guardians remain responsible for their children except during any expressly designated supervised activity.

14. PROHIBITED CONDUCT

The following conduct is prohibited:

violence or threats;
bullying;
harassment;
sexual harassment;
discriminatory abuse;
intimidation;
grooming;
child abuse or exploitation;
inappropriate physical contact;
deliberate breaches of safeguarding requirements;
possession or use of illicit drugs;
intoxication;
smoking or vaping in prohibited areas;
deliberate damage to property;
unauthorised access to restricted areas; or
behaviour that creates an unreasonable risk to another person's safety or wellbeing.

HSM may refuse entry or require a person to leave where HSM reasonably considers this necessary for safety, safeguarding, lawful operation of the event or protection of participants.

A person removed because of their own serious misconduct is not entitled to a refund except where required by law.

Serious conduct may be reported to police, child protection, regulators or other authorities where appropriate or required by law.

15. ALCOHOL, SMOKING, VAPING AND DRUGS

Unless HSM expressly states otherwise, HSM events are alcohol-free, smoke-free, vape-free and illicit-drug-free.

A person who possesses, supplies or uses illicit drugs, becomes intoxicated, or breaches applicable venue restrictions may be removed from the event.

Prescription medication legitimately used by a participant is not prohibited.

16. FOOD, ALLERGIES AND DIETARY REQUIREMENTS

Where food or refreshments are supplied, HSM will take reasonable steps appropriate to the circumstances but cannot guarantee that food or preparation environments are completely free from allergens or cross-contamination.

Participants with allergies, intolerances or special dietary requirements are responsible for:

notifying HSM where dietary information is requested;
checking whether available food is suitable;
bringing suitable food where necessary;
carrying required medication, including adrenaline injectors where prescribed; and
taking reasonable precautions appropriate to their condition.

Participants with severe allergies should not assume that an event or venue is allergen-free.

17. PERSONAL PROPERTY

Participants are responsible for their own money, vehicles, electronic devices, luggage and other belongings.

HSM is not responsible for loss, theft or damage to personal property except to the extent that liability cannot lawfully be excluded.

Participants should not bring unnecessary valuables to events.

18. VENUE AND THIRD-PARTY PROVIDERS

Events may take place at premises owned or controlled by third parties and may involve third-party providers.

Participants must comply with reasonable venue safety, security and access requirements.

HSM is not responsible for the independent acts or omissions of third parties over whom HSM has no control, except where HSM has a legal responsibility that cannot lawfully be excluded.

19. PHOTOGRAPHY, VIDEO AND RECORDING

Photography, audio recording or video recording may occur at HSM events.

Where practicable, HSM will notify participants that photography or recording is taking place.

Images or recordings may be used for legitimate HSM purposes including communications, reporting, promotion, education and historical records, subject to applicable privacy, safeguarding and consent requirements.

Additional consent requirements apply to identifiable children and young people in accordance with HSM safeguarding procedures.

A participant who has a concern about being photographed or recorded should notify the event team.

Participants must not photograph, film or record another person in circumstances that breach privacy, safeguarding requirements, venue rules or applicable law.

20. PRIVACY AND PERSONAL INFORMATION

HSM may collect personal information reasonably necessary to:

administer registrations;
operate events;
communicate with participants;
manage safeguarding and safety;
respond to emergencies;
satisfy legal obligations; and
maintain appropriate organisational records.

Personal information will be handled in accordance with applicable Australian privacy requirements and HSM's Privacy Policy.

Health, safeguarding and other sensitive information will only be collected, used or disclosed where permitted by law.

21. LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies:

rights or remedies under the Australian Consumer Law;
liability that cannot legally be excluded;
HSM's statutory safeguarding obligations; or
any other mandatory obligation imposed by law.

Subject to those rights and obligations, and to the maximum extent permitted by law, HSM excludes liability for indirect, incidental or consequential loss arising from attendance at, cancellation of or changes to an event where such loss was not caused by a breach of a legal obligation owed by HSM.

Participants acknowledge that they remain responsible for ordinary personal risks associated with voluntary attendance, travel to and from an event and activities undertaken independently of HSM.

22. PARTICIPANT RESPONSIBILITY AND INDEMNITY

Each participant is responsible for loss or damage caused by their own unlawful, deliberate, reckless or negligent conduct.

To the extent permitted by law, a participant agrees to indemnify HSM against third-party claims, losses or reasonable costs arising directly from the participant's unlawful, deliberate, reckless or negligent conduct.

This indemnity does not apply to the extent that the relevant loss was caused or contributed to by HSM's own negligence, breach of contract, breach of statutory duty or other legally actionable conduct.

23. DIRECTIONS, REFUSAL OF ENTRY AND REMOVAL

HSM may refuse entry, restrict participation or require a participant to leave where HSM reasonably believes this is necessary because of:

safety;
safeguarding;
serious misconduct;
harassment;
intoxication;
unlawful behaviour;
material breach of these Terms;
material breach of venue requirements; or
significant disruption to the event.

HSM may contact police, emergency services or other relevant authorities where appropriate.

24. FORCE MAJEURE AND CIRCUMSTANCES BEYOND REASONABLE CONTROL

HSM will not be responsible for failure or delay in performing an obligation where performance is prevented by circumstances genuinely beyond its reasonable control, subject always to rights that cannot lawfully be excluded.

HSM will take reasonable steps appropriate to the circumstances to communicate material disruptions and determine whether the event can safely proceed, be relocated, rescheduled or cancelled.

25. AUSTRALIAN CONSUMER LAW

Our services come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies.

Nothing in these Terms is intended to exclude, restrict or modify a consumer guarantee, statutory right or remedy where doing so would be unlawful.

If there is an inconsistency between these Terms and a mandatory legal right, the mandatory legal right prevails.

26. SEVERABILITY

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be read down to the extent legally possible or otherwise severed, and the remaining provisions will continue to apply.

27. GOVERNING LAW

These Terms are governed by the laws applicable in Victoria, Australia.

The parties submit to the jurisdiction of the courts and tribunals having jurisdiction in Victoria, subject to any applicable law providing otherwise.

28. ACCEPTANCE

By completing a booking or registration, the booking person confirms that:

they have read and agree to these Terms and Conditions;
the information provided in the booking is accurate;
where they are legally authorised to consent on behalf of a child, they accept the applicable terms relating to that child;
they understand that participation is voluntary;
they understand the applicable safeguarding and supervision arrangements; and
they acknowledge that nothing in these Terms removes rights that cannot lawfully be excluded.
