RUSH 2.0 – TERMS & CONDITIONS
By purchasing a ticket to, registering for, attending or participating in RUSH 2.0 (“the Event”), the participant and, where the participant is under 18 years of age, their parent or legal guardian agrees to the following Terms & Conditions.
1. Tickets & No Refund Policy
All ticket sales are final.
RUSH Dance does not offer refunds for change of mind, illness, injury, scheduling conflicts, travel issues, failure to attend or any other personal circumstances preventing a participant from attending the Event.
Tickets may only be transferred to another participant with prior approval from RUSH Dance.
Failure to attend the Event does not entitle the ticket holder to a refund, credit or transfer to a future RUSH event.
If RUSH Dance is required to cancel or materially reschedule the Event, participants will be contacted regarding the options available to them.
2. Participation & Assumption of Risk
Dance and physical activity involve inherent risks, including but not limited to falls, collisions, strains, sprains and other injuries.
By participating in RUSH 2.0, participants acknowledge and voluntarily accept the risks associated with dance classes, physical activity and participation in the Event.
Participants are responsible for ensuring they are physically capable of participating and must participate within their own abilities and limitations.
Participants must immediately stop participating and notify a RUSH staff member or teacher if they feel unwell, experience pain or believe they have sustained an injury.
3. Injury & Medical Responsibility
Participants are responsible for managing any existing injuries, medical conditions, allergies or physical limitations that may affect their ability to participate safely.
Where appropriate, participants or their parent/guardian should inform RUSH Dance of relevant medical information before participating.
In the event of an injury or medical emergency, the participant or their parent/guardian authorises RUSH Dance staff to obtain or arrange reasonable first aid or emergency medical assistance where considered necessary.
Any medical, ambulance or associated expenses remain the responsibility of the participant or their parent/guardian.
To the maximum extent permitted by law, RUSH Dance, its founders, staff, contractors, teachers, choreographers and venue will not be responsible for injury, loss or damage arising from the inherent risks of participating in the Event, except where liability cannot lawfully be excluded.
4. Junior Participants & Parent/Guardian Responsibility
Junior participants remain the responsibility of their parent or legal guardian.
By purchasing a Junior ticket or allowing a minor to participate, the parent or legal guardian confirms that they have authority to provide consent on the participant's behalf and agrees to these Terms & Conditions for the minor.
Parents/guardians are responsible for ensuring Junior participants are safely dropped off and collected from the venue at the appropriate times.
RUSH Dance, its teachers and staff are not a childcare or supervision service and do not assume parental responsibility for Junior participants outside the organised Event activities.
Parents/guardians must ensure RUSH Dance has appropriate contact information in case of an emergency.
5. Photography, Video & Media Consent
RUSH 2.0 will be professionally photographed and/or filmed.
By attending the Event, participants and, where applicable, their parent or legal guardian consent to the participant being photographed, filmed and recorded during the Event.
Participants grant RUSH Dance permission to use, reproduce, edit and publish this content for RUSH Dance promotional, marketing, advertising, social media, website, event recap and other business-related purposes without additional payment or approval.
This may include individual and group photographs, class footage, performance footage, behind-the-scenes content and promotional material.
Participants acknowledge that content published online or on social media may be publicly accessible and may be shared by third parties.
6. Teachers & Class Content
RUSH Dance engages independent teachers/choreographers to deliver classes at the Event.
Participants agree to follow reasonable instructions provided by RUSH Dance staff and teachers and to participate responsibly.
Choreography, class structure, difficulty and teaching style are determined by the individual teacher.
RUSH Dance reserves the right to substitute a teacher, adjust the timetable, alter class durations or make other reasonable Event changes where circumstances require.
A change of teacher, schedule or class structure does not automatically entitle a participant to a refund.
7. Behaviour & Safety
RUSH Dance is committed to creating a safe and respectful environment.
Participants must behave respectfully toward teachers, staff, other dancers, parents, venue staff and Event partners.
Bullying, harassment, discrimination, threatening behaviour, deliberate disruption, unsafe conduct or inappropriate behaviour will not be tolerated.
RUSH Dance reserves the right to remove any participant from the Event where their behaviour is considered unsafe, disruptive or inappropriate. A participant removed for behavioural reasons will not be entitled to a refund.
8. Personal Belongings
Participants are responsible for their own belongings at all times.
RUSH Dance, its staff, teachers and the venue are not responsible for lost, stolen, forgotten or damaged personal property to the extent permitted by law.
Participants are encouraged to clearly label their belongings and avoid bringing unnecessary valuables to the Event.
9. Venue Rules
All participants and attendees must comply with the rules, safety requirements and reasonable directions of the Event venue.
Participants may only access areas of the venue designated for RUSH 2.0.
Any deliberate damage caused to the venue or Event property may be the financial responsibility of the participant or, for a minor, their parent/guardian.
10. Spectators & Access
Only individuals holding the appropriate ticket, pass or authorisation from RUSH Dance may enter designated class or Event areas.
RUSH Dance may restrict spectator access during classes to minimise disruption and provide dancers with an appropriate learning environment.
Any spectator arrangements communicated by RUSH Dance before or during the Event must be followed.
11. Personal Photography & Recording
Participants and parents may only photograph or record classes where permitted by RUSH Dance and/or the relevant teacher.
Any personal filming must be respectful of other participants and must not interfere with the class.
RUSH Dance reserves the right to restrict photography or filming at any time.
12. Event Changes
RUSH Dance reserves the right to make reasonable changes to the Event, including teachers, schedules, class times, room allocations and other operational arrangements where necessary.
RUSH Dance will make reasonable efforts to communicate significant changes to ticket holders.
13. Release & Limitation of Liability
To the maximum extent permitted by Australian law, participants and their parents/guardians acknowledge that participation is undertaken voluntarily and at their own risk.
Participants agree that RUSH Dance, its founders, employees, contractors, teachers, choreographers, photographers, videographers, sponsors and venue are not liable for injury, illness, loss, damage or expense arising from participation in or attendance at the Event where that liability may lawfully be excluded.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under applicable Australian law.
14. Agreement
By purchasing or using a ticket, attending RUSH 2.0 or allowing a minor to participate, the participant and/or their parent or legal guardian confirms that they:
have read and understood these Terms & Conditions;
understand that dance and physical activity involve inherent risks;
accept responsibility for participating within the participant's abilities;
understand the no-refund policy;
provide photography and video consent as outlined above; and
agree to comply with RUSH Dance's Event and safety requirements.
For participants under 18 years of age, ticket purchase and participation must be authorised by a parent or legal guardian.
